NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Monroe
County, Florida, will hold a public hearing on February 21, 2001, at 3:00 PM, at the Key
Largo Library, Tradewinds Shopping Center, Key Largo, Florida, for the purpose of
determining whether or not the following streets, alley-ways, roads or highways shall be
abandoned:

COUNTY, RENOUNCING AND DISCLAIMING ANY RIGHT OF THE COUNTY AND
THE PUBLIC IN AND TO A PORTIONS OF MORRIS AVENUE, CROSS KEY, KEY
LARGO. MONROE COUNTY. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter described
streets, alley-ways, roads or highways, and
WHEREAS, due notice has been published and a publiC hearing has been held in accordance
with Chapter 336, Florida Statutes, and
WHEREAS, at said publiC hearing the Board considered the argument of all parties present
wishing to speak on the matter, and all premises considered concerning the renouncing and
disclaiming of any right of the County and the public in and to the hereinafter described streets,
alley-ways, roads or highways as delineated on the hereinafter described map or plat, and
WHEREAS, the Board has determined that vacation of the said road is for the general public
welfare, and conforms to the requirement of Florida Statutes Secs. 336.09 and 336.10, now,

Subsequent 10 rc:celVll1g a copy of your September- 21 letter to the County
Commissionc:rs. the County Attorney aud I reviewed the issues SUITOUnding a downsizing of
Morris AYCDue. Although there arc Ic'gitimatc conccms concerning access and distribution of the
portion of road proposed to be abandoned, we were able to determine that these issues can be
resolved and the abandonment can go forward as bas been contemplated and agreed to by the
property owners for some two years.
The issue of a 20' wide access from the County Road to the last lot can be resolved by a
Unity ofTit1c with the other 1011 which ara ill COIDnlon ownership. As soon as I can 8SCeI1ain that
a Unity of Tide ha$ been filed in the County's Public Records and can obcain a metes and bounds
legal description for the area to be ~ I wiD be placing this on the County Commission
AgauIa 10 request approval to advertise a public hearing to abandon the road. As you arc no
doubt aware. the abandonment of a portion of width of this road is cxtn:mely unusual since roads
arc generally abandoned by the entirety of their width. or course, having a ) 00' width of side
street platted is also extremely unusual. Tho County has bad to be inno~ative wbile being careful
cot 10 violate any raws goyerning road abandonmcnts.
As soon as the Public Hearing can be scheduled. the owners along Morris Avenue will be

This item has some revisions to legal descriptions for the following two
reasons;
A. After submitting the paperwork to County Administrator, our
Engineering staff discovered some discrepancies in the metes and
bounds descriptions of several parcels, The configuration remains the
same for those parcels but slightly different descriptions are provided
with this memo,
B. The end of the road was reconfigured to square it off rather than run it to
a point, thereby increasing access to the last lot, Lot # 6, Both affected
property owners have agreed to the change & their letters, plus a copy of
the reconfigured end of the road is enclosed.
