A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA REQUESTING THAT THE U.S. CONGRESS PASS
LEGISLATION PROHIBITING FEMA FROM REQUIRING THE DEMOLITION
OF AN INHABITABLE PORTION OF A STRUCTURE BELOW THE BASE FLOOD
ELEVATION LEVEL AS A CONDITION OF OBTAINING FEMA SPONSORED
FLOOD INSURANCE AND ALLOWING FEMA TO WITHHOLD INSURANCE
COVERAGE FOR THE INHABITABLE PORTION OF THE STRUCTURE BELOW
THE BASE FLOOD ELEVATION LEVEL AND PROVIDING THAT A CERTIFIED
COpy OF THIS RESOLUTION BE SENT TO U.S. SENATORS BOB GRAHAM,
BILL NELSON AND U.S. REPRESENTATIVE PETER DEUTSCH
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA:
Section 1.
The Board of County Commissioners of Monroe County, Florida, hereby
requests that the U.S. Congress enact legislation providing that:
a) A property owner may not be required as a condition of eligibility for FEMA
sponsored flood insurance, to demolish any portion of a structure that was built prior to 1996
below the base flood elevation level, as established by the Federal Emergency Management
Agency (FEMA) flood zone maps, and which portion is otherwise suitable for human habitation.
No local government shall be ineligible for participation in the National Flood Insurance Program
(NFIP) due to its failure to reqUire demolition of residential structures, or portions thereof,
constructed below base flood elevation prior to 1996.
b) Nothing herein shall be construed as a requirement that portions of structures
below the base flood elevation level, as established by FEMA flood zone maps, be eligible for
FEMA sponsored flood insurance coverage.
Section 2.
