ITEM BACKGROUND: To help alleviate the parking problems for the State Attorney's office at Jackson Square, Cayo Hueso Parking, Inc. will lease 10 parking spaces located at 416 Southard Street, for $8.00 per space/per day plus applicable sales tax, Monday through Friday from 8:00 a.m. to 5:00 p.m. excluding Holidays. PREVIOUS RELEVANT BOCC ACTION: On May 17, 2000, BOCC approved to enter into a Lease Agreement with Cayo Hueso Parking, Inc. for 20 parking spaces at $10.00 per day (plus applicable sales tax), to help alleviate the parking problems at Jackson Square. The lease expired September 30, 2000. STAFF RECOMMENDATION: Same as noted above. NOW "THEREFORE, in consideration of the covenants hereinafter to be kept and performed, the lessor hereby leases unto the Lessee that certain property described as follows: 1. PREMISES: 10 Assigned Parking Spaces 416 Southard Street Key West, Florida 33040 2. TERM: The term of this agreement shall be for four (4) months commencing March 1, 2001, and shall terminate June 29, 2001, unless extended pursuant to the terms of this agreement. 3. EXTENSIONS: This agreement may be extended for two (2) four (4) month periods upon approval by Cayo Hueso Parking, Inc. and the Monroe County Board of County Commissioners. 4. Either party hereto may cancel this agreement with or without cause by giving the other party sixty (30) days written notice sent by certified U.S. Mail of its intentions to do so. 5. RENTAL: The Lessee shall pay the Lessor a monthly rent in arrears for 10 parking spaces @ $8.00 per space per day plus applicable sales tax, upon receipt of an invoice, from Monday through Friday 8:00 a.m. to 5:00 p.m. excluding Holidays. All payments shall be made payable to CAYO HUESO PARKING, INC. and mailed directly to ,,1408 Olivia Street, Key West, Fl 33040. G. Lessee shall not make any additions, improvements, repairs, or alterations to the leased premises. 7. USE OF PREMISES: The premises described in paragraph #1 above shall be actively used for parking services from Monday through Friday, 8:00 a.m. through 5:00 p-n-L excluding Holidays. Lessee shall at all times be responsible or assuring that the parking services does not create a nuisance or become used for any illegal or immoral purposes, including allowing any alcoholic beverages or unlawful narcotics to be possessed, used or consumed by persons on the premises. 8. MODIFICATIONS AND AMENDMENTS: Any and all modifications to this agreement or to any of the services provided shall require an amendment to this agreement to be approved in writing by both parties hereto. 9. NO ASSIGNMENT: Lessee shall not assign this agreement or sublease the premises. 10. AUTHORIZED SIGNATORY: The signatory for lessor, below, certifies and warrants that: (a) Lessor's name in this agreement is its full name as designated in its corporate charter, or the full name under which lessor is authorized to do business in the State of Florida. (b) He or she is empowered to act and contract for the lessor. (c) This agreement shall be approved by the Board of Directors of lessor, if lessor is a corporation. (d) Cars parked at lessee's risk. Lessor will not be responsible for fire, theft, or damage to vehicles. Lessor and his agents shall not be liable for any damage or injury to Lessee occurring on the premises, or any part thereof, or in common areas thereof, if any, and Lessee agrees to hold Lessor and/or his agents harmless from . any claim of damages. Vehicle Liability Insurance in the amount of $1,000,000.00 per incident and Comprehensive insurance of $2,000,00.00 aggregate coverage is carried by the Lessor. 11. 12. I know that lot was not fully used in the past, but we would now be able to assign specific employees to park there that could free up spaces in the back. The biggest reason for not using it before was the provision that the cars had to be out by 5:15 p.m. and many of our employees are still at work at that time; however, we are willing to assign our employees who definitely leave at 5:00 p.m. to park there. If you could negotiate a contract that would allow us to stay in that lot longer, even more employees would be able to use it. In addition, the State Attorney's Office has old cars parked in the Thomas Street lot that are waiting to be picked up to be sold at State auctions. If the county has any space available anyplace else that we could leave the cars until the auction company picks them up, that would also free up a few additional spaces. I�rFE 1 2001
