NOTICE OF INTENTION TO CONSIDER
ADOPTION OF COUNTY ORDINANCE
NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday, May
16, 2001, at 3:00 PM at the Key Largo Library, Tradewinds Shopping Center, Key
Largo, Monroe County, Florida, the Board of County Commissioners of Monroe
County, Fforlda, intends to consider the adoption of the following County
ordinance:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, AMENDING SEC. 13.5-5 (m) AND (n), MONROE COUNTY CODE, IN ORDER TO
ADD OLD SElTLERS PARK OF TAVERNIER TO THE UST OF PARKS WHICH ALLOW
ANIMALS; PROVIDING FOR SEVERABIUTY; PROVIDING FOR THE REPEAL OF All
ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE
MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person
decided to appeal any decision made by the Board with respect to any matter
considered at such hearings or meetings, he will need a record of the
proceedings, and that, for such purpose, he may need to ensure that a verbatim
record of the proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
Copies of the above-referenced ordinance are available for review at the various
public libraries in Monroe County, Florida.

INCORPORAnON INTO THE MONROE COUNTY CODE OF
ORDINANCES: AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE BOARD OF COUNlY COMMISSIONERS OF MONROE
COUNlY, FLORIDA:
Section 1. Sec. 13.5-5, Monroe County Code is hereby amended by the addition
of the following:
(m) Except for animals that assist disabled persons, all domestic animals are
prohibited from all county parks other than Key Largo Park in Key Largo, .Ql.d
Settlers Park In Tavernier, Higgs Beach County Park in Key West (except as
allowed under subsection (0) below), Wilhelmina Harvey Park in Big Coppitt~ and
Sombrero Beach Park in Marathon. No person may cause or allow, any domestic
animal (of whatever size) other than an animal that assists a disabled person to
be brought to, or remain on, any county park other than those listed above.
(n) All pets at Key Largo Park, Old Settlers Park, , Higgs Beach County
Park, Wilhelmina Harvey Park and Sombrero Beach Park are subject to the
following regulations:

(I) Pets must be leashed on a leash no greater than 8 feet long,
unless and while in the water and wet sand area of Sombrero Beach
Park.
(ii) Owners must clean up after pets and properly dispose of waste.
The County shall provide Mutt Mitts and Doo-Drop In stations for this
purpose.
(iii) Pets exhibiting aggressive behavior or creating a nuisance must
be immediately removed from the p'ark. ,~

Section 2. If any section, subsection, sentence, clause or provision of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity .
Section 3. All ordinances or parts of ordinances in conflict with this ordinance
are hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in
the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment
thereto, and shall be appropriately renumbered to conform to the uniform numbering
system of the Code.
Section S. This ordinance shall take effect Immediately upon receipt of official
notice from the Office of the Secretary of State of the State of Florida that this ordinance
has been filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the 16th day of May, 2001.
