ITEM BACKGROUND: The Art in Public Places Committee was established by Ordinance at the
May Board of County Commissioners meeting. The Ordinance states that each Commissioner shall
appoint one voting member whose term shall run concurrently with the term of the appointing
Commissioner. The names attached were submitted to the Administrator's office by each
Commissioner for approval.

AN ORDINANCE CRE-ATI46 SEC. 2-332(A), MONROE COUNTY CODE, PROVIDING
FOR FUNDING OF ART IN NEW PUBLIC CONSTRUCTION AND MAJOR
RENOVATIONS PROJECTS: PROVIDING FOR SEVERABILITY: PROVIDING FOR THE
REPEAL OF ALL. ORDINANCES INCONSISTENT HEREWITH; PROVIDI46 FOR
INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS. the County finds it in the best interest of its citizens to increase public access to art;
WHEREAS, the County desires to promote understanding and awareness of the visual arts and to
enrich the public environment for residents and visitors; now, therefore
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA,
Section 1. Sec. 2-332(A) Is hereby created to read as follows:
A. The Board of County Commissioners recognizes the extent of cultural resources
available in the County for development, promotion, and enjoyment of the arts. It is the
intent of the County Commission by enacting this ordinance to enrich culturally and benefit
the citizens of this County through the establishment of art in public places.
1) One percent (1%) of the construction costs for County construction, except
for any sewage treatment plant, shall be set aside for the acquisition, commission,
installation and maintenance of works of art in said buildings. This appropriation shall apply
only to new construction exceeding $500,000 or renovations exceeding $100,000 In cost.
a) Construction costs do not include architectural and engineering fees,
asbestos abatement or other environmental preparation, site work, or contingency
costs.

2) The art-in-public-ploces appropriations and gifts, grants and donations made
to Monroe County for the purpose of acquiring and installing art in public places shall be
separately accounted for and may be used only for the following purposes: to acquire,
commission, install, or maintain art in public places.
Section 2. There is hereby established an Arts in Public Places Committee, which shall be an
advisory body to the County Commission, The Arts in Public Places Committee shall be composed of five
voting members and two non -voting members, and shall have the sole purpose of reviewing responses to

Requests for Proposals for art to be acquired and installed in each public construction project subject to the
Arts in Public Places set aside requirement.
Section 3. Each County Commissioner shall appoint one voting member whose term shall run
concurrently with the term of the appointing commissioner and who shall live or work in the appointing
commissioner's district. There shall be one voting member who is either a board member or staff of the
Monroe Council for the Arts Corporation. Each remaining voting member must represent one or more of the
following:
a) working artist;
b) art professional:
c) landscape architect or interior designer:
d) curator, or
e) general public.
section 4. The County Administrator shall appoint to the committee the two non -voting members
on a project by project basis. The non -voting members shall be familiar with the project through their
position or contract as the architect, the building/project supervisor, or a similar nexus to the project.
Section 5, If any section, subsection, sentence, clause or provision of this ordinance. is held
invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 6. All ordinances or parts of ordinances in conflict with thisordinance are hereby
repealed to the extent of said conflict.
Sedion 7. The provisions of this ordinance shall be included and incorporated In the Code of
Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately
renumbered to conform to the uniform numbering system of the Code.
Section S. This ordinance shall take effect immediately upon receipt of official notice from the
Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.

Nance Frank has been involved with the world of art since she was
born in Key West in 1949. A third generation collector, Ms. Frank has
traveled extensively and seen all the great museums of Europe and North
and South America. She has a background as a museum curator in
Switzerland and Chile.
Ms. Frank has been a part of the Monroe Council of the Arts since it
was founded, serving as the Chair of the Council and as Chair of both the
WPA Committee and the Nominating Committee.
Bi-annually she has published the Florida Keys and the Key West Art
Gallery Guides, an organization which she founded, serving as the first
President and currently serves as Vice President. She owns and directs the
Gallery on the Greene, where she shows her own three-dimensional work.
Ms. Frank is the Donor Advisor of the Jeff MacNelly Scholarship
working with four Pulitzer Prize winners and others in selecting recepients.
In 1997, she authored and published a book with the venerated Cuban
American artist Mario Sanchez, titled "Before and After."

and after law school. Began writing stage plays
while living in Key West during the late 1970's.
1983 Production of first play by Etcetera Theater of Tallahassee.
1984 WFSU-TV of Tallahassee produced and aired a teleplay of
mine entitled "Cross Creek Under Cross Exam."

"Cross Creek" was also broadcast by other Florida public
TV stations later in the same year.
1990-92 Attended screenwriting workshops at UCLA
and developed a draft screenplay, set in
the Keys, entitled "Extinction." In
June 1992, I was invited by Florida
State University's English Department to
give public readings of my short
fiction.
1994 In September, my three -act play "Grunt
Bone Alley" was selected for a staged
reading at the Key West Theatre
Festival, Red Barn Theatre, Key West,
Florida. The play portrays the struggles of
Conchs in Key West.

Michael Jason Bier, A.I.A., a resident of South Florida for over forty-three
years, has been a licensed, practicing architect with his own firm for
twenty-seven years, of which the fast seventeen have been in the Florida
Keys.
Mike received, with Honors, his Bachelor of Architecture degree from the
University of Florida, where he was �ppoirited by the President of the Student
Body to tie the only student representative on the UniversWs Campus

he was inducted into Gargoyle and Tau Sigma Delta, both honor societies in
