ITEM BACKGROUND: The County has received notification of the settlement of a class action suit against General Motors. For each eligible vehicle that the County may have owned as of 12:01 a.m. on July 4, 1996, the County will receive discount certificates for $250 to $1,000 to apply toward the future purchase of new General Motors vehicles. Hutton, Assistant County Attorne# DATE: RE: May 14, 2001 General Motors Settlement. I have reviewed the materials, which you sent me in connection with a Class Action filed against General Motors. There are two options in agreeing to the settlement. One is to receive a settlement certificate for a discount on the purchase of an eligible new GM vehicle and another is to obtain a check for $100.00 in lieu of the settlement certificate. The time frame for receiving the $100.00 check alternative is almost past, with a requirement that the business reply mail envelope be postmarked no later than May 17, 2001. Even if that was not the case and we had plenty of time, I would still advise accepting the Class Action Settlement certificate, as opposed to cash, for any vehicles that we owned at the critical point time. The settlement certificate would provide us with the possibility of reducing the purchase price of any new GM truck by $1,000.00 for fifteen months and thereafter, for an additional thirty-five months by $250.00. That is slightly over four years during which it is very likely we would make a GM purchase. It appears from our discussion and the materials sent that we do not actually own any other the vehicles in question at this time. Further, the settlement does not preclude a claim for personal injury or property damage, so there is no reason not to settle. Accordingly, it is my advice to place before the County Commission a recommendation of executing the application for certificate on each eligible vehicle. The item which you sent to me indicates a VIN #, and I would presume that there are other possible vehicles to which this might apply. Accordingly, request the authorization for executing the application to apply to as many certificate applications as you received.
