ITEM BACKGROUND: This application for relief under ROGO has been filed under provisions of Section 9.5
(h) of the Monroe County Code that allows any applicant, who has been denied a ROGO allocation for more than 4
consecutive years, to file for relief with the Board of County Commissioners. This relief may take the form of an
offer to purchase the applicant's property, issuance of a building permit, or suggestions of such other relief as may
be deemed appropriate by the Board of County Commissioners. The applicant has remained in the allocation
system for four consecutive years, starting December 11, 1996.

Dear Mr. Hirsch:
The Monroe County Growth Management Division has notified our office that you applied for
administrative relief with respect to the County's rate of growth ordinance (ROGO) for the above
referenced property.
Based on the environmental sensitivity of the property, I am prepared to recommend that the Monroe
County Land Authority purchase the property for $18,786.40, which corresponds to 115% of the

Background on Subject Property
The subject property for which the applicant is seeking Administrative Relief is located at
Summerland Beach, Addition 2, Lot 1, Summerland. The property is in the Improved
Subdivision (IS) Land Use District.
The property is on Summerland Key and is within the c.A.R.L. Summerland Estates Acquisition
Project. The plant community on the lot is known habitat for the endangered Keys Mud Turtle
and is wide ranging habitat for the Key Deer according to the Monroe County Endangered
Species Map.
Permitting History
A building permit and Rate of Growth Ordinance (ROGO) allocation was applied for in
September 1995 and remains pending. When the lot was first scored in. 1995 it received a score
of 9, re-scoring of the property after adoption of additional negative points for wildlife habitat, as
required in the 2010 Comprehensive Plan, resulted in a reduction of points. The lot currently has
a score of 3, which includes 6 perseverance points.
Development Potential
Zoning - The Improved Subdivision Land Use category allows one single family residential
dwelling and accessory uses. As an improved subdivision, they have no TDR value under the
current code.
ROGO - The ROGO point system is designed to direct growth to protect natural resources and
encourage infill to improved subdivision lots. In response to Objectives 101.5 of the Monroe
County 2010 Comprehensive Plan, which directs the County to implement a point system which
protects environmental quality. Land development regulations have been adopted that scores
minus points for any lots in critical habitat areas. The subject parcel has a minus 10 points for
habitat type, a minus 12 for endangered species and a minus 10 for being in a critical habitat
area. The lot is not competitive for a ROGO allocation.
Land Acquisition - Policy 207.7.3 and Policy 207.7.4 directs the County to identify key deer
habitat areas as priority acquisition sites and to coordinate programs for acquisition with
federal, state and non-profit conservation organizations.
Eligibility for Administrative Relief
Section 9.5-122.2 (f) of the Monroe County Land Development Regulations and Policy 101.6.1
of the 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not
received an allocation award in ROGO may apply to the Board of County Commissioners for
administrative relief. The applicant is eligible for Administrative Relief having complied with
all requirements of the dwelling unit allocation system and been considered in at least 3 of the
last four consecutive annual allocation periods.
Relief under Administrative Relief
The remedies available to an applicant for Administrative Relief include issuance of a building
permit or just compensation by purchase of the property or such other relief as may be necessary
or appropriate.
Policy 207.7.3 and Policy 207.7.4 of the 2010 Comprehensive Plan directs the County to identify
Key deer habitat areas as priority acquisition sites and to coordinate programs for acquisition
with federal, state and non-profit conservation organizations. Policy 101.2.14 specifically states,
''for those ROGO applications and properties which have been denied a ROGO award for four
consecutive years and have applied for administrative relief which are located in a CARL
project or the National Wildlife Refuge and have received negative habitat scores under ROGO,
the County or the state shall offer to purchase the property if funding for such is available.
Refusal of the purchase offer shall not be grounds for granting a ROGO award".
Therefore, the Administrative Relief appropriate for the subject property is an offer to purchase
the lot; it is located within a conservation area or areas proposed for acquisition by governmental
agencies for the purpose of conservation and resource protection and has received negative
habitat scores under ROGO.
Recommendation:
It is recommended that the Board of County Commissioners find that the applicant has met the
criteria and qualifies for Administrative Relief. It is further recommended that an order be
prepared that establishes this relief as an offer to purchase the lot for fair market value by
Monroe County.

INTRODUCTION: At your request, a site visit was made to the above property to perform an
environmental evaluation of the property in conjunction with a beneficial use application. The
applicant currently has an building permit application on file with Monroe County and is
asking for administrative relief in the form of an allocation.
SITE CONDITIONS: This lot is a portion of a relatively large tropical hardwood hammock on
Summerland Key. It is bounded by Ocean Drive to the southeast, a single family residence
to the southwest, and hammock to the northeast and northwest. The lot is completely and
heavily vegetated with native hammock plant species. Many of these native plants are listed
(threatened or endangered) species and one (poisonwood) is a critical food source for the
endangered White-Crowned Pigeon. Due to the size of the overall hammock and to its
relative lack of disturbance/invasion by exotic plant species, I believe that this hammock
would receive a designation as "low elevation high quality" hardwood hammock under the
current Habitat Evaluation Index (HEI) evaluation. A designation as high quality hammock
would require an open space ratio of 0.80, or 80% open space. Any development within the
20% allowable clearing would involve minimizing impacts to listed species and would also
involve rescue and/or transplantation of vegetation removed from the building site. This
desirable plant community is also known habitat for one endangered species (Keys Mud
Turtle) and is wide-ranging habitat for one species (Key Deer) according to the Monroe
County Endangered Species Maps. Due to its environmental sensitivity, the property is
located within the C.A.R.L. Summerland Estates Acquisition Project. Under the current
ROGO system, the project would receive Environmental points as follows:
Habitat type: -10 (low elevation high quality hammock)
Endangered Species: -12 (one known and one wide-ranging)
Critical Habitat Area: -10 (within C.A.R.L. acquisition area)
Total Environmental pts: -32
FINDINGS: Although it is technically a buildable lot, the environmental sensitivity of this
property makes it non-competitive in the ROGO system. A County building permit
application for the property (application #951-1173 under the name Gallo) is currently ranked
#82 out of 99 in the Lower Keys. The County Land Authority offered to buy this property in
1999 (see letter in beneficial use file) and it could also be sold as a ROGO lot. Award of a
building allocation would result in further fragmentation of this sensitive protected habitat and
would have a direct impact on one endangered species, both of which are undesirable
environmental consequences. These undesirable environmental consequences have been
sufficient to rank this building application near the bottom of Lower Keys ROGO ran kings for
the last 6 years. The applicant could sell the land, either as a ROGO lot or to the Monroe
County Land Authority (or some other governmental agency); however, the question under
99.5-172(b) of the Monroe County Code is whether this monetary value constitutes
"reasonable economic use" of the property.
