Agenda Item Wording: Approval to purchase property in Cahill Pines and Palms subdivision with
Preservation 2000 funds.
Item Background: This purchase is proposed to provide administrative relief under ROGO. The
owners of the subject property have competed unsuccessfully in ROGO for four years to build a single-
family home. Their 1/13/01 ROGO score was 4, while a score of 19 was necessary to receive an
allocation. Their application was ranked #81 in the Lower Keys. The subject property is located in
Cahill Pines and Palms subdivision on Big Pine Key, is zoned Improved Subdivision (IS), and is located
in the National Key Deer Refuge. The vegetation consists of exotics (Australian pines). The owners
had a building permit and constructed a concrete slab and columns before letting the permit expire in
1994. At that point they had to re-apply for a permit under the more strict ROGO point criteria.
Funding for this purchase will come from the State's Preservation 2000 program, which will restrict
future use of the property to conservation and public recreation. The Land Authority's standard
purchase contract will be used. The agenda packet spreadsheet lists the legal descriptions, purchase
prices, and closing costs for this transaction.
Advisory Committee Action: On June 28, 2001 the Advisory Committee voted 4/0 to approve this
purchase.
Previous Governing Board Action: Sitting as both the Land Authority and the BOCC, the Board's
policy with respect to ROGO administrative relief has been to purchase rather than permit as long as
sufficient acquisition funding is available.
