AGENDA ITEM WORDING: Approval to renew Interlocal Agreement with the City of Marathon
for the Use of the Meeting Room at the Marathon Government Center, and the televising of Marathon
Council Meetings.
ITEM BACKGROUND: On September 30, 2001, the lnterlocal Agreement with the City of
Marathon for the Use of the Meeting Room at the Marathon Government Center will expire. In
accordance with Section 2(b) of the original Agreement dated May 17, 2000, the Agreement may be
extended for subsequent years, and fees adjusted to reflect changes in County costs.
PREVIOUS REVELANT BOCC ACTION: May 17, 2000, the BOCC granted approval and
authorized execution of an Agreement between Monroe County and the City of Marathon in reference
to the utilization 'of the County meeting room in the Marathon Government Center and the televising of
Marathon Council meetings. On April 19, 2000 the Board voted to approve the proposed agreement
given that the costs reflect the true cost of all services.
CONTRACT/AGREEMENT CHANGES: Renew Agreement for one (1) additional year
commencing October 1,2001. Increase annual cost from $7,878.00 to $8,351.20.

RENEW AL AGREEMENT
(City of Marathon - Interlocal Agreement for the Use of the Meeting Room at the Marathon
Government Center.)
TIllS Renewal is made and entered into this 15th day of August 2001, between
MONROE COUNTY and the CITY OF MARATHON, in order to renew the agreement between
the parties dated May 17, 2000, ( a copy of which is incorporated hereto by reference); as
follows:
1. In accordance with Section 2(b) of the original Interlocal Agreement dated May 17, 2000,
the Agreement will be extended for an additional year. Fees increase to' $8,351.20 for
approximately 26 City Council meetings, and are subject to the same guidelines as
outlined in Section 2(b).
2. The term of the renewed agreement will commence on October 1, 2001, and will
terminate on September 30,2002.
3. In al1.other respects, the original agreement between the parties dated May 17, 2000
remain's in full force and effect. .:

The parties to this agreement stipulate that each is a state governmental agency as defined by
Florida Statutes and represents to the other that it has purchased suitable Public Liability, Vehicle
Liability, and Workers' Compensation insurance, or is self-insured, in amounts adequate to
respond to any and all claims within the limitations of Florida Statute 768.28 and 440, arising out
of the activities governed by this agreement.
Each party sh~ll be rsponsible for any acts of negligence on the part of its employe~s, agents,
contractors, and subcontractors and shall defend, indemnify and hold the other party harmless
from all claims arising out of such actions.

THIS INTERLOCAL AGREEMENT 15 entsred Into pursuilnt to Sec. 163.01, FS, by
and between Monroe County, a pOlitical subdIvision of the State of Florida, whose
address Is 5100 College Road, Key West, FL 33040, hel'Mft8r COunty, and the City of
Marathon, a municipal c:orpor1ltion, whose address Is PO Box seo-4JO, Marathon, FL

WHEREAS, the County has a meeting room at the Marathon Government Center
with the technical recllltlu to enable meetings to be cablecast;
WHEREAS, the County desires to permit the aty to use the County meeting
room; now, therefore '
I~ CONSIDERATION of the mutual promISes and covenants set forth below, the
parties agree lI$ follows:
Section l.
a) The County authorizes the City to hold 26 CJty Council meetings per year
(October 1 - September 30) lit the Marathon Gqvemment Center meeting room with
each meeting approxlmatelv two weeks apart. . The Cltv must coordl~8te meeting
dates with County Administrator's Office so that no County/CIty schedule overlap occurs.
The City will provide a full year's meetlng schedule prior to OCtOber 1 each year. If a
schedule conrllct between IS City Council meeting and a mHtfng. of the County
Commission, County Planning Commission or County Code Enforcement hearing does
occur, then the CountY meeting or hearing will take precedence.
b) The County wJl1 televise live the City Council meetings, unless th.~ ill a
meetinQ of the County Commission, County Plzlnnlng Commission, County Code
Enforc,ment hearing or similar organization going on at the same tlm., and will
videotape all.Oty Coundl meetings. (f ther@ Is a County meeting or heating going on,
then the CitY Council meeting will be televised live on Channel 16 .~ soon as the
COunty meeting or hearing Is concluded. If the City COuncil meeting ends before the
County meeti"9 or hearIng condudes, then the tape of the City Council meeting will
be shown on Channel 16 twice on later dates.
c) Except as provided In Sec. l(b), the County will l"8play each City Council
meeting tape ~ne time before the next CIty CouncH meeting. The CIty may request a
spectflc time and date for each replay throuQh the County AdministmOr's Office who
shall accommOdate the OtY's reque$t unless the time l1tquested by the City would
con"lct with a live telecast d a County mHtlng or hearfno.
9) The County will furnish the City one video tape copy of each City Council
meetl~.
Section 2.
a) From the effective date of this ~greement, until September 30, 2000,

authorized above without addItIonal charge. If the City Council holds 'meetlngs in
excess of 29 during the period of October 1, 2000 through September 3D, 2001, and
desires that the extr8 meetings be held at the M~rathon Gov.rnment Center pUr5Liant
to this agreement, then the City must pay the County an addftlonal $303 for eaCh
meetfng held. If the Oty holds less than 23 meetings usIng thl MlJrathon .Govetnment
Center, pursuant to this agreement, during the period of OctOber 1, 2000 through
September 30, 2001 then the County must refund or credIt $303 to the City for ech
muting IIn.; than 23. If this zsgreement Is extended for subsequGnt ve~rs after
september 30, 2001, then for each year thereafter the fee will be adjusted to reflect
changes in County costs.

Dear Ms. Johnson:
In reviewing our documents for agreements that have terms that are shortly due to
expire, it was brought to my attention that the aforementioned agreement between
the County and the City of Marathon is due to expire on September 3~, 2001.

The City Manager, Craig WratheII, has expressed an interest in extending the
agreement, as referenced in Section 2.(b). I have attached a copy of that agreement
for your reference. In addition, it would be appreciated if we could ~e notified as to
the documents that would be needed in our to facilitate the request for an extension
of said agreement. The City of Marathon's next Council Meetings are scheduled for
August 151 and August 2151. If these documents could be provided to my attention
within that time period, I would be more than happy to arrange for the documents to
be placed on the neces~ary meeting agenda for approval and signatury.

questions or concerns, please do not hesitate to contact my office directly.

1. In accordance with Section 2(b) of the original Interlocal Agreement dated May 17, 2000,
the Agreement will be extended for an additional year. Fees remain at $7,878 for
approximately 26 City Council meetings, and are subject to the same guidelines as
outlined in Section 2(b).
2. The term of the renewed agreement will commence on October 1, 2001, and will
terminate on September 30,2002.
3. In all other respects, the original agreement between the parties dated May 17, 2000
remains in full force and effect.

THIS INTERLOCAL AGREEMENT 15 entered Into pursuant to Sec. 163.01, FS, by

address Is 5100 College Road, Key West, FL 33040, hereafter COunty, and the City of

WHEREAS, the County has a meeting room at the Marathon Government Center
with the technical 'ac:llltles to enable meetings to be cablecast;
WHEREAS, the County desires to permit the Cty to use the County meeting
room j now, thereforll
I~ CONSIOERATION Of the mutual promISes and covenants set forth below, the
parties agree as fOllOws:
Section 1.
a) The County authorizes the City to hold 26 CIty CouncU meetings per year
(October 1 - September 30) at the Marathon Government Center meeting room with
each rrtHting approXlmatelv two weeks apart. The City must coordinate meeting
dates with County Administrator's Office so that no County/Oty schedule overlap occurs.
l11e City will provide a full year's meetJng schedule prior to OCtOber 1 each year. If a
schedule conflict between e City Council meeting and a m88tln~ of the County
Commission, County Planning COmmission or CountY Code Enforcement hearing does
occur,.then the County meeting or hei!lrtng will take precedence.
b) The COUnty will televise live the City Council meetIngs, unless there is a
meeting of the County Commission, County PI~nnln9 CommiSSion, County Code
Enforcement hearing or similar organization going on at the same time, and will
vIdeotape allOty Coundl meetings. If there Is a County meeting or heartng gOing on,
then the City Coundl meeting will be tele"lsed live on Channel 16 ., soon as the
County meeting or hearing Is conduded. If the City Council meeting ends before the
County meeting or heartng condudes, then the tape of the City Council meeting will
be shown on Channel 16 twice on later dates.
c) Except as provided In Sec. l(b), the COunty will replay each City COUnl:t1
meeting tape ~ne time before the next CIty Coundl meeting. The City may request a
specific time and date for each replay through the County AdrniniatrIdOr's Office who
shall acx:ommOdate the OtY's request unless the time ,.quested by the City would
con"lct with II live telecast r:# II County meeting or hearing.
d) The CountY will furnish the City one video tape copy of each City Council
meetll'lQ.
Section 2.
a) From the effectjve date of thIs agreement, until September 30, 2000,

b) Beginning October 1, 2000 through September 30, 2001, the Cjty~shlJlI
pay the County $7,878 in advance for approximately 26 City Council meetIngs (two
per month) to be held at ttre Marathon Government Center, televised live (If there is
no conflict with a County meeting or hearing), meeting 'Vid~ .tapes, and one rap lay of
each meeting on Channel 16. The City may add th~ additional meetings to the 26
authorized above without addltJonal charge. If the City Council holds meetings in
excess of 29 during the period of October 1, 2000 through September 30, 2001, and
desires that the extra meetings be held at the Marathon Gov.-nment Center pursLiant
to this agreement, then the City must pay the County an additional $303 for eaCh
meeting held. If the aty holds less than 23 meetings using the Marathon Government
Center, pursuant to this agreement, during the period of OctOber 1, 2000 through
September 30, 2001 then the County must refund or credit $303 to the City fOr each
mHtlng I... than 23. If this agreement Is extended for subsequent ve~rs after
September 30, 2001, then for each year thereafter the f. will be adjusted to reflect
changes in County costs.

filed in the Offlce of the Cieri< of the Sixteenth Judicial Crcuit and In the Office of the
