ITEM BACKGROUND:
On December 8, 1992 and each year thereafter, the Board of County Commissioners approved and
authorized execution of a Letter of Engagement with the firm for Land Use-Growth Management
representation. The total billing amount is set at $350,000.

CONTRACT/AGREEMENT CHANGES:
Increase of $150,000 over amount in current Letter of Engagement due to Shadek litigation; an
increase in the hourly billing rate for attorney's fees; and the addition of a billing rate for law clerk
fees.

RE: Land Use - Growth Management Representation - Letter of Engagement
Dear Mayor and Commissioners:
The law fimi of Morgan & Hendrick ("Law Firm") and the Board of County Commissioners
hereby agree to renew for an additional term of one year the Letter of Engagement initially entered into
between the parties dated December 8, 1992. All terms and conditions shall be as set forth in the
December 8, 1992 engagement letter except that the cap on total fees for the fiscal year ending
September 30, 2002, shall be set at $350,000.00 per annum, subject to the budget for that fiscal year,
allocating sufficient funds.
Beginning October 1,2001, attorney's fees shall be billed at $225.00 per hour, law clerk fees at
$150.00 per hour (must have law degree), and paralegal fees at $75.00 per hour.
The County also agrees to reimburse the Law Firm for all costs that are incurred in the course of
representation. Normal costs include expert witness fees, copying charges, long distance telephone
calls, travel and lodging expenses, mailing charges, fax charges, mileage, research charges, court
reporters and other out-of-pocket expenses. Further, the County will reimburse the Law Firm for the
acquisition of legal informational materials specifically related to the legal representation of the County,
including the cost of seminar fees, travel and lodging not to exceed $2,500 per year. A statement
showing the amount of fees and expenses will be forwarded monthly. Each statement is payable upon
receipt.
The Law Firm will not bill for any services performed by James T. Hendrick while he serves as
County Attorney.

Item P. 9. COUNTY ATTORNEY - Approval of Interlocal Agreement
with the Village of Islands wherein the County agrees to pay $440,000 to
the Village for the pur~base of emergen~y mediul service vehi~1es and
equipment.
Comments:
1. The source of the $440,000 was originally identified as the Village of
Islamorada portion of Upper Keys Trawna District Funds.
2. The issue of the Trauma District has been resolved and nothing has
changed.
3. The Village of Islamorada is still part ot: and receives benefit from,
the Upper Keys Trauma District ftmds.
4. How does oW' BOCC justify giving Islamorada $440,000 :from any
other ftmd?
5. If the Village ofIslamorada still feels entitled to $440,000, should
they not be asking their constituents, in a vote, whether they want to
continue participation in the Upper Keys Trauma District?
6. If a mistake was made in identification of available funds, and our
BOCC plans to pay for that mistake - what funds, specifically are the
new source of the $440,0001
7. If the $440,000 is approved from a general ftmd, for the pmchase of
emergency medical service vehicles, are we also proposing to
identify, with signage on the side of the vehicles that the vehicles are
"Paid for by all Monroe County Taxpayers"?

Comments:

Item V. BUDGET PUBLIC HEARINGS - Public input and discussion
of the Tentative Fiscal year 2002 Budget.
Comments:
1. Will there be a budget hearing in Key Largo? If so, when?
2. I understand the COWlty Administrators concern in not wanting to show
favoritism between departments, but I disagree that all the departments are
suffering equally, or that any other departments are suffering as much as the
planning department.
Even since the last budget hearing I understand we have "hired" and "lost"
yet another planner. (How much did that exercise cost - both in tenns of
dollars and morale?) I know of no other department that is on the front lines
with the public and has such a high turn over as that of our Planning
Department.
I believe it is costing us more to run a department inefficiently with only
50% of the positions filled than to offer financial incentives and keep the
planning department at 100%.
To ignore the seriousness of the problem is to do nothing. I urge the
BOCC to initiate a start and take immediate action to remedy the serious
problem in keeping plamlers. TIlls is having a great impact on oW'
communities.
