A RESOLUTION SETTING THE DATE, TIME AND PLACE FOR A PUBLIC
HEARING CONCERNING THE PROPOSED ABANDONMENT OF A ROAD
RIGHT-OF-WAY IN CORAL SHORES ESTATE9- SUBDIVISION, LITTLE
TORCH KEY. MONROE COUNTY. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida,
desires to renounce and disclaim any right of the County and the public in and to the
hereinafter described streets, alley-ways, roads or highways, and
WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public
hearing after publishing due notice of said hearing in accordance with said Chapter, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that the Board will hold a public hearing on December 19, 2001, at
3:00 PM at the Marathon Government Center, 2798 Overseas Highway, Marathon,
Florida, to determine whether or not the Board will renounce and disclaim any right of
the County and the public in and to the following described streets, alley-ways, roads or
highways as delineated on the hereinafter described map or plat, to-wit:
THE FOLLOWING LEGAL DESCRIPTION DESCRIBES A PORTION OF
THE WEST END OF ASTRANGIA AVENUE ON LlTrLE TORCH KEY,
SECTION 20, TOWNSHIP 66 SOUTH, RANGE 29 EAST TO BE
ABANDONED AND IS MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCE AT THE INTERSECTION OF THE DIVISIONAL LINE BETWEEN
LOT 27 AND LOT 28, BLOCK 6 Of THE CORAL SHORES ESTATES, MOBILE
HOME SECTION 2 WITH THE SOUTH RIGHT-OF-WAY LINE OF ASTRANGIA
AVENUE; THENCE COINCIDENT WITH SAID SOUTH RIGHT-OF-WAY UNE
WEST 24.51' TO THE POINT Of BEGINNING OF THE PORTION OF

We hereby petition the Honorable Board of County Commissioners to
renounce and disclaim any right of the County and the public in and to the
street. alleyway. road or highway as described in the following attachments:

outlined. and showing all adjacent properties.
(Exhibit B) Map of island/key on which road is located. clearly showing US 1. Mile
Marker number and portion of road to be abandoned.

Petitioners agree to be responsible for and pay for all costs of advertising and
recording fees incurred relative to this request for the vacation.
Petitioners further agree to grant any easement necessary for the furnishing of
utilities, including without limitation, electric power, wate~, sewer, telephone, gas,
cable and other electric communication services to the same extent as is
common within this area as to height, width and degree. upon request for such
service or by the Board of County Commissioners through its authorized agents. If
easements are so required. copies of the executed documents will be provided
to the County before the petition is presented to the BOCC.
Petitioners certify that the road to be abandoned does not end at water or that. if
it does, the road is not a dedicated and accepted right-of-way (including by
operation of law due to construction or maintenance by County).
WHEREFORE. Petitioners formally requests the Honorable Board of County
Commissioners to grant this petition.

Our engineering department has reviewed the above referenced request. Presently, BellSouth
has no existing facilities nor plans to construct facilities along the area in question. BellSouth

Petition for Road Abandonment for a portion of Astrangia Avenue located on Little Torch
Key, Florida.
Descriptions
1. Edward O. Russell, Jr. owner of Lot 30 Block 6 and Diane and Thomas Cope of Lot 29 Block 6 in
the Coral Shores Estates subdivision, Little Torch Key Monroe County, Florida, has petitioned the
Board of County Commissioners to abandon that portion of Astrangia Avenue that ends at lots 29
and 30 Block 6 in the Coral Shores Estates subdivision, LittleTorch Key, Florida.
2. Abandonment of road right of way located at lot 30 block 6 of Coral Shores Estate, Mobile Home
Section 2, part of Government Lot 1, Section 20, Township 66 South, Range 29 East, Little Torch
Key, Monroe County, Florida, described as the last 25' of Astrangia avenue excluding any
easement dedicated specifically to Bellsouth Telecommunications. (See exhibit "1")
3. The proposed abandonment area is adjacent to lots 29,30 and the radius of lot 28 of Block 6 of the
Coral Shores Estates subdivision. The Monroe County Land Use District Map indicates the property
is located in the Urban Residential Mobile Home (URM) Land Use District. The Future Land Use
Map (FLUM) designation for the property is Residential High (RH).
Staff Review
A review of our records and an on-site inspection of the subject property revealed the following:
1. The right-of-way for Astrangia Avenue was deeded to Monroe County by Coral Shores Estates
Subdivision recorded in Plat Book 6 Page 81, public records of Monroe County, Florida.
2. The applicant states the reason for the road abandonment is to restore area originally set aside by
lots 29 and 30 for a turn around by Coral Shores Estates. This turn around at the end of Astrangia
Avenue provides a turn around area for Emergency Vehicles as well as the public.

3. The proposed abandonment of Astrangia Avenue serves Edward Russell owner of lot ~ Diane
& Thomas Cope who own lot 29 and Harry & Helen Marsh owners of lot 28. As required by Monroe
County Code sec 16-1b both parties have presented letters of concurrency.
4. Property owners have encroachments within the right-of-way. ( see "Exhibit 2")
5. Letters of No Objection has been received from Bellsouth Telecommunications, AT&T Broadband &
Internet Services, Florida Keys Aqueduct Authority and City Electric System. A Letter of No

Objection was also received from Harry and Helen Marsh owners of lot 28 Block 6 Coral Shores
Estates, Little Torch Key, Florida.
6. The Florida Keys Aqueduct Authority request that the owner of lot 29 have the meter that serves
account 25346 relocated to the proposed new right-of-way on Astrangia Avenue. The City Electric
System requests an easement permitting the crossing of lot 29 with electrical service by way of lot
28.
7. The subject roadway surface is partially paved. The roadbed is currently used for access to both
properties abutting the subject right-of-way as well as a turn around.
8. The road does not terminate on a body of water and therefore meets the requirements of the
requirements of Monroe County Code Section 16-1 a.
Conclusions:
1) The abandonment would create a dead-end street with a width of 50 feet that has been determined
to be an adequate area for a turn around.
Recommendation:
Staff recommends APPROVAL of the request for road abandonment
