RESOLUTION SETTING THE DATE, TIME AND PLACE FOR A PUBLIC
HEARING CONCERNING THE PROPOSED ABANDONMENT OF A
PORTION OF WASHINGTON AVENUE, LARGO BEACH, TAVERNIER,
FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires
to renounce and disclaim any right of the County and the public in and to the hereinafter
described streets, alley-ways, roads or highways, and
WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public
hearing after publishing due notice of said hearing in accordance with said Chapter, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that the Board will hold a public hearing on November 20, 2001, at
3:00 PM, at the Key Largo Library, Tradewinds Shopping Center, Key Largo,
Florida, to determine whether or not the Board will renounce and disclaim any right of
the County and the public in and to the following described streets, alley-ways, roads or
highways as delineated on the hereinafter described map or plat, to-wit:
ALL OF WASHINGTON AVENUE ADJACENT TO AND LYING BETWEEN LOT 1, BLOCK
10, AND LOTS 1 THROUGH 3, BLOCK 9, LARGO BEACH, TAVERNIER, MONROE
COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 1, PAGE 108, OF THE OFFICIAL
RECORDS OF MONROE COUNTY, FLORIDA.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of the Board on the 17th day of October, 2001

incurred relative to this request fo~ the vacation.
Petitioners further agree to grant any easement necessary for the furnishing of utilities, including
without limitation, electric power, water, sewer, telephone. gas, cable and other electric
communication services to the same extent as is common within this area as to height. width
and degree. upon request for such service or by the BOCC through its authorized agents. If
easements are so required, copies of the executed documents will be provided to the County
before the petition is presented to the BOCC.
Petitioners certify that the road to be abandoned does not end at water or that. if it does, the
road is not a dedicated and accepted right-or-way (including by operation 01 iaw due to
construction or maintenance by County).
WHEREFORE. Petitioners formally request the Honorable Board of County Commissioners

COMMENCE at the intersection of the southwesterly right-of-way line of Cocoanut Row with the Southerly right-of-way line of
Washington Avenue as shown on the Plat of LARGO BEACH, recorded in Plat book 1, at Page 108 of the public records of Monroe
County, Florida, said point being also the Point of Curvature of a curve to the left, having: a radius of 25.00 feet, II central angle

arc of said curve, being also the said Southerly right-of-way line of Washington Avenue, for 15.84' to the POINT OF BEGINNING;

or related underground facilities by any other person, association, or corporation; and the right to enter upon, cross and use other
lands of the Grantors to provide access to the easements granted herein.

project.
Pursuant to your request for the abandonment of part of Washington Ave., that borders Lots 1 &
2, Blk. 10 and Lots 1,2,3, & 4, Blk. 9, Key Largo Beach, FL., staffhas researched your request
and have no objection to the abandonment of portion of this road since no facilities exist therein
and the road dead ends into native area which is presently being used an illegal dumping ground.

Request from Sophie Boudreau for a Road Abandonment
Sophie Boudreau, co-owner of Lots 1 & 2, Block 10, Largo Beach,
Tavernier, Key Largo, Florida has requested the abandonment of a portion
of Washington Avenue.
Lots 1 & 2 of Block 10, and Lots 1, 2, 3 & 4 of Block 9 are in the Improved
Subdivision (IS) land use district. There are residential units on all the
properties except Lot 4 of block 9. Access to all the residential units is
from either Cocoanut Row or Tavernier Drive.
Roadway Description
The portion of the roadbed which is the subject of the request for
abandonment is shown as Washington Avenue in Plat Book 1, Page 108 of
the Public Records of Monroe County. There is no evidence of any paving
on the property, and the property is completely covered with vegetation.
Use of the Road
There is no current use of this portion of the road. There is a metal shed
that is encroaching on the portion of Washington Avenue that is the
subject of the road abandonment request.
Development Potential
There is no development potential for the property.
Shoreline Access
The portion of road being proposed for abandonment does not terminate
on open water.

Boudreau Road Abandonment
Staff Review
A review of the records and an on site inspection of the property revealed
the following:
1. The original platted roadbed shows no signs of ever having
been completed. The entire property is covered with grass
and trees, and there is a metal shed in the eastern portion of
the parcel for which the abandonment is requested.
2. The occupants of the adjoining parcels of property have
submitted letters to the applicant stating that they have no
objections to the abandonment with the exception of the
owner of Lot 4, Block 9. The records of the Monroe County
Property Appraisers Office show the owners of Lot 4, Block 9,
to be Harold P. & Dina G. Fitzpatrick. A copy of the property
record card is attached.
3. The applicant has received letters of concurrency from the
Florida Keys Aqueduct Authority, BellSouth, the Florida Keys
Electric Cooperative Association and AT&T Broadband. No
easements are anticipated in the proposed abandonment area
from any utility.
Conclusion
Staff recommends APPROVAL of the request by Sophie Marie Boudreau for
a road abandonment of a portion of Washington Avenue based on the
following:
1. The road proposed for abandonment serves only the applicant
and other property owners who have consented to the
abandonment with the exception of the owner of Lot 4, Block 9
of Largo Beach. Therefore the request for abandonment
meets the requirements as outlined in the Monroe County
Code Section 16-1.
2. The road does not terminate on a body of water, and is
consistent with goal 213 of the Monroe County Year 2010
Comprehensive Plan.
3. Based on the application and supporting documentation, the
abandonment will not impair the distribution of utilities in the
neighboring area.

that the entire right-of-way be abandoned from Coconut Row to Ocean Blvd. This road
