RESOLUTION NO.165-2021
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
REQUIRING THE CONTRACTORS EXAMINING BOARD TO
SCHEDULE AN OPPORTUNITY FOR INDUSTRY MEMBERS
TO BE HEARD AT EACH CONTRACTORS EXAMINING
BOARD MEETING.
WHEREAS, at a Special Meeting of the Board of Monroe County Commissioners, held on
March 31, 2021, the construction industry indicated a desire to have a consistent avenue to address
concerns regarding various issues that may arise when doing business with the Monroe County Building
Department; and
WHEREAS, the County acknowledges that situations, such as hurricanes and the current
pandemic, often impact how the County is able to conduct business; and
WHEREAS, the County welcomes the opportunity for open communication with the industry
on the consequences of the County's adopted practices; and
-- - - WHEREAS, on December 8, 1975, the Board of County Commissioners (BOCC) enacted
Ordinance No. 16-1975, which created the Contractors Examining Board (CEB); and
WHEREAS, Monroe County Code Sec. 6-270, Powers and duties, provides, in part, that the
CEB has the power to call upon members of the industry to advise and assist it; and
WHEREAS, Monroe County Code Sec. 6-267, requires the CEB to hold at least four regular
meetings each fiscal year; and
WHEREAS, Monroe County Code Sec. 6-266 requires the Building Official or his designated
agent be present at every CEB meeting; and
WHEREAS,having time reserved on each CEB agenda for"Industry Input"is within the powers
of the CEB to consider and will allow the public and/or industry members to have a meaningful
opportunity to be heard;
NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1: The -Whereas" clauses set forth above are incorporated herein as findings by the
Board.
Section 2: The Contractors Examining Board shall include an agenda item for"Industry
Input"at each scheduled meeting. Based upon the input received, the
Contractors Examining Board may make recommendations to the County
Commission; the County Administrator, or his designee; the Building Official,
or his designee; and/or the Director of Planning and Environmental Resources or
her designee. The Commission directs the aforementioned staff members to
attend the Industry Input portion of the Contractors Examining Board meetings.
The Contractors Examining Board may schedule additional meetings as
necessary.
Section 3: This resolution shall take effect upon adoption.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida,at a regular meeting of said Board held on the 21 s'day of April, 2021.
