Resolution 126-2021 RESOLUTION NO. 126 - 2021 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, EXTENDING PAID SICK LEAVE AND LEAVE-OF- ABSENCE PROVISIONS OF THE FAMILIES FIRST CORONAVIRUS RESPONSE ACT (FFCRA) FOR COUNTY EMPLOYEES FROM APRIL 1, 2021 THROUGH SEPTEMBER 30, 2021. WHEREAS, in early 2020, the Federal government passed the Families First Coronavirus Response Act (FFCRA), which required certain employers (including Monroe County) to provide job protected leaves of absences and paid leaves to employees affected by the COVID-19 virus, when certain circumstances apply; and WHEREAS, those Federal requirements expired on December 31, 2020 and the recent COVID-19 relief package passed by the Federal government did not address a mandatory extension or modification of FFCRA beyond 12/31/2020, but the Federal government did authorize employers to voluntarily extend FFCRA through March 31, 2021; and, WHEREAS, in April of 2020, the Board of County Commissioners of Monroe County did adopt Resolution No. 105-2020, which set Administrative Leave as the method by which the County would comply with the FFCRA; and WHEREAS, the Federal government gave employers the option to continue the provisions through March 31, 2021, and The Board of County Commissioners did pass Resolution 002-2021, which exercised this extension; and, WHEREAS, via the American Rescue Plan Act of 2021 (ARPA), the Federal government has now given employers an option to extend the provisions of the FFCRA and American Rescue Plan Act of 2021 through September 30, 2021; and, WHEREAS, the Monroe County Board of County Commissioners (BOCC) now wishes to extend the provisions of the Families First Coronavirus Response Act and American Rescue Plan Act of 2021 as allowed through September 30, 2021. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, THAT: 1. Monroe County BOCC employees absent for one or more stated reasons under the Families First Coronavirus Response Act (FFCRA), shall have Administrative 1 Leave applied as the form of payment to comply with the Act, at the full or partial rate defined in the Act, through September 30, 2021. 2. This shall serve as an extension of the provisions of the FFCRA through September 30, 2021, and shall now include additional provisions included in the American Rescue Plan Act of 2021 (ARPA), including paid sick leave for awaiting results of a test for or a diagnosis of COVID-19, when an employee is obtaining COVID-19 immunization, and when an employee is recovering from any injury, disability, illness or condition related to COVID-19 immunization. The ARPA provides a new allotment of 10 paid sick days for the April 1 to September 30 extension. 3. This Resolution shall be effective as of April 1, 2021.
