Resolution 167-2021 1 2 3 4 5 6 7 MONROE COUNTY,FLORIDA 8 BOARD OF COUNTY COMMISSIONERS 9 RESOLUTION NO. 167 -2021 10 11 A RESOLUTION BY THE MONROE COUNTY BOARD OF 12 COUNTY COMMISSIONERS APPROVING AN 13 INVENTORY OF COUNTY-OWNED REAL PROPERTY 14 WHICH MAY BE APPROPRIATE FOR AFFORDABLE 15 HOUSING, IN ACCORDANCE WITH FLORIDA STATUTE 16 § 125.379. 17 18 19 WHEREAS, Florida Statute § 125.379 requires a county to prepare an inventory list of 20 all real property within its jurisdiction to which the county holds fee simple title that is 21 appropriate for use as affordable housing, beginning July 1, 2007, and every 3 years thereafter; 22 and 23 24 WHEREAS, the Monroe County Board of County Commissioners ("BOCC", "Monroe 25 County", or the "County") adopted Resolution No. 404-2015, approving an inventory of county- 26 owned real property which may be appropriate for affordable housing on December 9, 2015; and 27 2s WHEREAS, such inventory list must include the address and legal description of each 29 such real property and specify whether the property is vacant or improved; and 30 31 WHEREAS, the governing body of the county must review the inventory list at a public 32 hearing and adopt a resolution that includes an inventory list of such property following the 33 public hearing; and 34 35 WHEREAS, the properties identified as appropriate for use as affordable housing on the 36 inventory list adopted by the county may be offered for sale and the proceeds used to purchase 37 land for the development of affordable housing or to increase the local government fund 38 earmarked for affordable housing,or may be sold with a restriction that requires the development 39 of the property as permanent affordable housing, or may be donated to a nonprofit housing 40 organization for the construction of permanent affordable housing; and 41 42 WHEREAS, the purposes of this statutory requirement, the term "affordable", Florida 43 Statute § 420.0004(3), shall mean that monthly rents or monthly mortgage payments including 44 taxes, insurance, and utilities do not exceed 30 percent of that amount which represents the 45 percentage of the median adjusted gross annual income for the households as referenced in 46 Florida Statute § 420.0004(9) ("Extremely-low-income persons"), Florida Statute § Resolution No. 167-2021 Page 1 of 3 47 420.0004(11) ("Low-income persons"), Florida Statute § 420.0004(12) ("Moderate-income 48 persons"),or Florida Statute §420.0004(17) ("Very-low income persons"); and 49 50 WHEREAS, in accordance with Florida Statute § 125.379, the Monroe County Board of 51 County Commissioners shall hold a public hearing on April 21", 2021, to review and revise the 52 subject inventory; 53 54 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 55 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 56 57 Section 1. Recitals and Legislative Intent. The foregoing recitals and statements of 58 legislative intent are true and correct and are hereby incorporated as if fully stated 59 herein. 60 61 62 Section 2.
