AN UNCODIFIED ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA REPEALING
ORDINANCE 032-2020, WHICH REQUIRED WEARING FACIAL
COVERINGS TO COMBAT THE SPREAD OF INFECTION CAUSED
BY THE COVID-19 PANDEMIC.
WHEREAS,the world has been dealing with a global pandemic caused by the COVID-
19 virus for over a year; and
WHEREAS,the State and County have been operating under a state of emergency since
March of 2020; and
WHEREAS, in reliance upon advice of the Florida Department of Health and guidance
from the Centers for Disease Control (CDC), the Board enacted a series of ordinance requiring
the wearing of facial coverings culminating in Ordinance 032-2020; and
WHEREAS,that ordinance was a temporary ordinance that is scheduled to sunset on
June 1,2021, unless extended further by the Board; and
WHEREAS,on May 3, 2021,the Governor issued Executive Order 21-102 which
suspended all local orders and ordinances that restrict personal freedoms; and
WHEREAS, the County Attorney has advised the Code Compliance Department that it
should stop enforcement efforts of Ordinance 032-2020 until further notice; and
WHEREAS,the Board finds that the public interest would be served by enacting a clear
repeal of Ordinance 032-2020;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section I. The above recitals are incorporated herein as findings of the Board.
Section 2. Ordinance 032-2020 is hereby repealed in its entirety retroactive to May 3, 2021.
Section 3. Nothing in this ordinance shall invalidate any action already taken under the
authority of Ordinance 032-2020 or any of its predecessor versions.
PASSED AND ADOPTED at a special meeting of the Board held on May 5, 2021 in Marathon,
Florida.
