FOR A BENTHIC SURVEY OF TUBBYS CREEK BRIDGE (#904982) AND MOSQUITO CREEK BRIDGE (#904984) ON CARD SOUND ROAD This Task Order is entered into on this 6th day of May2021, in accordance with the Continuing Contract for On Call Professional Engineering Services for Category C Environmental Engineering Services made and entered on the IP day of April, 2017, Amendment No.1 dated June 20, 2018, and Amendment No. 2 dated March 17, 2021, between Monroe County, hereinafter referred to as the "County" and Wood Environment & Infrastructure Solutions, Inc. hereinafter referred to as "Consultant" where design services are allowed if construction costs do not exceed $2,000,000. Florida Department of Transportation (FDOT) Work Program has funds in FY2022 for Monroe County to perform a Project Development and Environment (PD&E) Study for the replacement of two bridges on Card Sound Road. Although bridge replacement projects usually require an environmental assessment under the National Environmental Policy Act (NEPA), FDOT District 6 staff is willing to support a recommendation to FDOT Central Office that this project be considered for a Category 1 Exemption, which would eliminate the requirement for the PD&E Study. The benthic survey is needed to support the recommendation for exemption. This Task Order is effective May 6th , 2021 and shall expire 90 days from the effective date. A. Article II Scope of Basic Services, Paragraph 2.1.1 is amended as follows: The scope of work will include the completion of a Submerged Aquatic Resource Survey (Benthic Survey) at and in the vicinity of the Tubby's Creek Bridge 4904982 and Mosquito Creek Bridge 4904984 on Card Sound Road to determine the presence of aquatic resources and listed species and critical habitat, as more fully described in Attachment A. (Wood) is pleased to provide this proposal for professional environmental services to Monroe County (County) fora benthic assessment/sun/eyTubbvs Creek and Mosquito Creek bridges along Card Sound Road. BACKGROUND AND NEED SECTION The two bridges 904982 and 904984,Tubbys Creek and Mosquito Creek are 101 ft. long and the County has funds in the Florida Department of Transportation (FD(]T) work program in FY2O22 to do a Project Development and Environment Study (PD&B' but in working with FD(]T Planning they are willing to support a recommendation (needs to be approved at the central office) to allow the bridge replacements to be considered a Cat 1 exemption under National Environmental Policy Act (NEPA)' (the funds are federal funds). The County will be widening the bridges to meet new design standards by about 8'9 ft. totai According to FD(]T resources like seagrass or coral are not a fatal flaw but if there is an endangered species that will be impacted it will kick the County out of Cat 1 exemption. The activities below outline the services needed to complete the benthic assessment/survey for Tubbvs Creek and Mosquito Creek. Wood'/,a trading name mr/o»n Wood Group PLC and its subsidiaries SCOPE OF SERVICES Task 1: Benthic Survey Wood will conduct a submerged aquatic resource survey of the project limits to determine the presence of listed species and critical habitats. The objective of the benthic survey is to inspect the bridge structures and adjacent submerged lands for corals, seagrass, fish, and wildlife. The survey area will include the two bridges and extend 50 feet on both sides of the bridges. The survey will be performed in accordance with the National Marine Fisheries Service (NMFS) and the Florida Fish and Wildlife Conservation Commission (FWC) protocols and guidelines. Wood will prepare figures and maps to review project limits and known extents of aquatic resources including seagrasses and hard bottom habitats.The dive supervisor will also prepare a comprehensive health and safety plan for boating and diving operations to ensure the safe execution of the program. The survey will be conducted by our in-house dive team via skin and scuba divers using appropriate scientific diving protocols. Staff scientists will survey the project limits to identify and map the presence of aquatic resources including submerged aquatic vegetation (seagrasses), corals, hard bottom habitats, oyster bars, and mangroves. The survey will focus on species listed as threatened or endangered by state and federal agencies. Locations of the discovered resources will be mapped. If present, listed corals will be identified to species level, the maximum dimension measured (to nearest centimeter), and water depth will be recorded. Seagrass beds, if present, will be mapped, dominant species identified, and average percent cover recorded. Observations of sea turtles, fish, mammals, and other listed wildlife species in the survey area will also be documented. Photographs will be taken of observed resources. Deliverables: A brief report submitted electronically in PDF format of observed benthic resources will be produced. This will include figures showing the location of the resources as well as representative photographs. SCHEDULE The anticipated time frame for project execution is two months to be completed from written Notice-to-Proceed (NTP). PROPOSED FEE Fees for the services described above will be charged according to Wood's standard rate schedule and on a Lump Sum of $19,968. The proposed fee includes the labor and expenses which can reasonably be anticipated to complete the scope of services as proposed and includes travel costs and expendable supplies. The proposal is valid for 60 days.The terms and conditions of the Agreement for On-Call Professional Engineering Services for Category C Environmental Engineering Services between Monroe County and Wood Environment & Infrastructure Solutions, Inc. (Wood), dated April 12, 2017, are incorporated by reference. COVID-19 Notwithstanding anything mentioned in this proposal, the attached documents or any terms or conditions applicable to Wood's work, if Wood's work is delayed, disrupted, suspended, or otherwise impacted as a direct or indirect result of COVID-19 (coronavirus), including, but not limited to, by (1) disruptions to material and/or equipment supply;(2) illness of Wood's or Subcontractors'workforce and/or unavailability of labor; (3) government quarantines, closures, or other mandates, restrictions, and/or directives; (4) Wood's or Subcontractors' restrictions and/or directives; and/or (5) fulfillment of Wood's or Subcontractors' contractual or legal health and safety Page 2 obligations associated with COVID-19; then, Wood shall be entitled to a reasonable adjustment to the schedule and duration to account for such delays, disruptions, suspensions, and impacts. To the extent the causes identified herein result in an increase in the price of labor, materials, or equipment used in the performance of these services, Wood may be entitled to a mutually agreed-upon equitable adjustment to the price for such increases, provided Wood presents documentation of such increases (including the original prices).
