Murphy, District 5 This item requests approval for the settlement of a workers' compensation claim on a County employee with the initial date of accident on March 1, 2002. The claimant injured his lower back when he was employed as a Maintenance Worker. The claimant resigned on August 31, 2007. Since the date of injury the claimant has seen numerous physicians. We have spent approximately $506,436 on the medical portion of the claim and approximately $182,392 on indemnity. The claimant's continued life expectancy is eighteen years. The claim is already being covered under the County's Excess Insurance Policy. We have received the insurance company's permission to move forward with the settlement of $344,800 and this amount will therefore be reimbursed to the County. It is recommended that the BOCC approve this settlement.
