Resolution 205-1998 County Attorney RESOLUTION NO. 205 - 1 998 A RESOlUTlOt'-J PROVIDING FOR DEFINITIONS; PROHIBITIt'-JG THE POSSESSION OF OPEN CONTAI~'~ERS OF ALCOHOLIC BEVERAGES AT EITHER KEY WEST INTERNATIOt'~AL AIRPORT OR THE MARATHON AIRPORT EXCEPT AT LICENSED PREMISES; PROVIDING FOR PENALTIES FOR VIOLATIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Definitions a) A/coho/ic beverages means distilled spirits and all beverages containing one- half of one percent or more alcohol by volume. The percentage of alcohol by volume is determined by meosuring the volume of the standard ethyl alcohol in the beverage ond comparing it with the remoinder as though the rernoinder ingredients were distilled water, b) Licensed premises meons that podion of the terminol building at either Key West International Airport or the Marathon Airport leased to a lounge and restaurant operator and licensed by the State of Florida for the sale and on premises consumption of ~ oS :!! alcoholic beverages, $("Ji; 5! ~ 0,....% -< 0 "':x-< c) Open container means any container which is immediately c~D1e J;gb~ c;:ij::x ::0 %'0 ""0 :::0 consumed from, or the seal of which has been broken. ~C"). :It FT1 _ -c::C ('") .." .)> -::- - Section 2. Prohibition on the possession of open containers of a!c~l~b~r~2.... at Key West International and Marathon Airport. It is a violation of this resolution, and punishable as provided in Section 3, for ony person to possess an open container of alcoholic beverage at either Key West International Airport or the Marathon Airport, including the sidewalks, internal roads, grossy areas and parking lots of such airports, This prohibition on the possession of open containers of alcoholic beveroges does not apply to licensed premises. Section 3. Penalties. Violations of this Resolution are misdemeanors of the second degree, punishable as provided in See, 775.082, FS or Sec. 775.083, FS. Section 4, Effective date. This Resolution will take effect following the promulgation required by Sec. 332.08(2)(b), FS PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 13th day of May, 1998.
