AGENDA ITEM WORDING: Approval of a Lease Agreement with Vincent Grandelli concerning

ITEM BACKGROUND: If the event of a hurricane or disaster, this contingency site is
available, if needed, to hold vegetative waste and hurricane debris until disposal. The lease
cost is $100 per term, and $250.00 per acre per day if the property is actually used to store
hurricane debris
PREVIOUS RELEVANT BOCC ACTION: On 2/21/01 the BOCC approved a similar
agreement with Toppino's Inc, for a contingency site on Rockland Key.

VEGETATIVE WASTE AND HURRICANE DEBRIS LEASr: AGREEMENT
This Agreement Is entered Into this 12th day of ~, 2001, by and between VINCENT
GRANDELU, 5 Dawson Circle, Staten Island, New York 10314, hereafter Lessor, and MONROE
COUNTY, FLORIDA, a political subdivision of the State of Florida, hereGJfterCounty, the Lessee,
In exchange for the mutual promises and consideration set forth below, the parties agree as follows:
1. The County, or its contractors, shall deliver hurricane debris to the Lessor's land site known
as Tract C, Blue Water Trailer Village Section 4, PB6-100, Key Largo, Florida, RE# 488730-
000000, for storage, if needed, due to a hurricane or disaster, Third parties authorized by
the Lessee may also deliver vegetative waste and hurricane debris to the land site.
2. Upon execution of this lease, the Lessee must pay Lessor $100,00 in consideration for
reserving the Lessor's site for hurricane debris storage during the term described In
paragraph 6. When the land site Is utilized to store hurricane debris, the County must pay
the Lessor $250 per acre utilized per day. The Lessor consents to the presence of County
employees at the Lessor's site for the purpose of monitoring its contractors.
3, The County may discontinue use of the site If, in Its discretion, it determines that the
storage site is no longer necessary. If the County discontinues use of the storage site, then
the County will have no further obligation or liability to the Lessor except for the days
actually used for storage of debris,
4, The County shall furnish all necessary insurance to properly protect liability and property
damage.
5. This agreement may not be amended except through written amendment signed by both
parties.
6. The term of this agreement is from July 1, 2001 until December 3:'_, 2001, unless specifically
cancelled by either party by providing at least 60 days prior writte,l notice to the other party
of their intent to cancel.
7, Monroe County's obligation to pay under this agreement is contingent upon an annual
funding appropriation by the Board of County Commissioners.
8. This written agreement represents the entire Agreement bl~tween the parties and
supersedes any prior written documents or memoranda or oral communications.

Hurricane Debris Storage
Staff has reviewed the parcels at both MM 93 (intersection of Burton Drive mld U.S. 1) and
MM 98 (MmT property). Both of these sites appear adequate for the storage of hurricane de-
bris. Both parcels have buffers that can help to screen any debris from residential areas
nearby.
