ITEM BACKGROUND: On January 29, 1992, Permit #921003982 was issued to Ms. Joyce Sweeting of
Sweetwater Homes, Inc. to build a single family residence for Joseph and Pamela Pellerito. After the issuance
of the building permit, Mr. Pellerito experienced chronic heart problems which made it impossible for him to
manage contractors on his residence. His permit expired on July 30, 1993.
Since that time, Mr. Pellerito has regained his health. He is ready to begin work on completing his residence
and has filed a variance request under Section 6-40(f)(1), as provided due to a health incapacity. The staff finds
that the applicant does not meet the criterion under Section 6-40(f)(1) and recommends denial of the variance.

The applicants, Joseph and Pamela Pellerito are requesting a variance to the time
limitations for mandatory building inspections to reactivate their building permit, which
expired in July 30, 1993, in accordance with the provisions of Section 6-40(f)(1) Monroe
County Code. The staff recommends denial of the variance request.
Background
On January 29, 1992, Permit #921003982 was issued to Ms. Joyce Sweeting of
Sweetwater Homes, Inc. to build a single family residence for Joseph and Pamela
Pellerito. A needed mechanical permit fee was not issued and the impact fees were not
paid [At the time of permit issuance, impact fees were payable prior to the structure
receiving a certificate of occupancy rather than prior to the permit being issued.]
The auger, column and slab inspections were made. There was a one-time extension
granted on January 22, 1993, allowing the permit to remain active through March 25,
1993. No further inspections were made and the permit expired on July 30, 1993.
On September 23, 1993, the Assistant Building Official allowed an application to be
submitted to renew the aforementioned permit (exempt from ROGO) based on the fact
that the permit was less than five years old and had previously approved inspections
within the preceding two years. It was determined that the permit be renewed, pending
an on -site inspection and photos with a new permit number. Payment for all fees minus

percentage of completion as well as go through the DCA waiver period process was
required. Building Department records indicate that the renewal was never issued.
According to County records, in January 1995, Ms. Sweeting made an inquiry as to the
status of this permit. The Building Coordinator (Ms. Lisa Masci) advised Ms. Sweeting
that the permit was dead and in order to re -permit it would now have to go through
ROGO. Ms. Sweeting acknowledged that fact and indicated that when the owners were
ready, they would go through ROGO.
The Department of Health (DOH) permit had expired over this period. Prior to returning
to the Building Department, the Pelleritos would need to renew their DOH permit. It
appears that they had renewed the DOH permit on February 18, 1994 and had a final
inspection on September 29, 1995.
As depicted in the photos provided by Sandra Walters Consultants, Inc. dated May 18,
2001, the on -site wastewater treatment plant is installed and the columns have been
demolished. Presently an augured foundation composed of reinforcing steel and
concrete exists on the property.
Request for Variance
On behalf of the applicants, Ms. Sandra Walters submitted an application on May 18,
2001, for a variance to the time limitations for the expired permit in accordance with
Section 6-40(f) (1), Monroe County Code. Attached is her cover letter and supporting
information explaining how she believes that her client meets the requirements for a
variance.
The application requests a variance from the time limitations of Section 6-40 in
accordance with a provision of paragraph (f) of that section which provides for variances
to the permit time limitations of the Code, if the "literal enforcement of the provisions of
this section would constitute a severe and undue hardship upon the permit holder," upon
the demonstration and finding that one of four conditions is met. The condition which the
applicant has provided documentation is subparagraph (1), the death or incapacity of an
owner or immediate family member of the owner.
In the application package, Ms. Walters has provided numerous exhibits documenting
Mr. Pellerito's health problems. These health problems directly led to his failure to meet
a required 120 day inspection resulting in the permit expiring in July 1993. [The permit
expired in July 1993, not late in 1995 as stated in the applicant's package. ]
Analysis
The background documentation and medical correspondence provided clearly
demonstrate that the applicant's on -going health problems significantly contributed to his
inability to meet necessary required inspections. - Unfortunately, the staff believes that
the period of time for which he would have been eligible for obtaining a variance from the

time limitations of Section 6-40(e) Permit Paid For, Picked Up, and Work Started has
long since passed.
Section 6-40 (f) states that "The relief granted by variance shall be limited to a time
extension not to exceed one (1) year and shall be further limited to the minimum
extension necessary to obviate the demonstrated hardship." Therefore, the staff believes
the applicants should have brought their request to the County before or shortly after the
expiration of the permit in 1993, not eight years later.
Even though the staff is very sympathetic with the applicant's situation, it does not believe
the intent of the Code is to allow expired permits to be revived many years later.
Therefore, as was explained to the applicant's agent (Ms. Sweeting) in 1995, the permit
has expired and the applicants will have to revise their building plans and compete under
ROGO.
The Building Official, Planning Director and Director of Growth Management all concur
with this interpretation of Section 6-40(e); however, if the BOCC agrees with the
applicant's interpretation and finds that the applicant has met the conditions for a
variance, the staff suggests that all the following conditions be placed on the variance:
• The contractor or owner shall have 90 days from the grant of the variance by the
Monroe County Board of County Commissioners to submit all relevant paperwork to
the Building Department for processing.
• New drawings engineered to current standards including 150-mph wind load shall be
submitted. The engineered drawing is to be coordinated with the Florida Keys
Aqueduct Authority, City Electric and Department of Health.
• The existing auger piling and existing steel shall be removed or an engineer's
certification submitted.
• The revised plan drawings shall be priced for permit and impact fees at today's rates
and these fees shall be paid in full at the time of issuance of the permit.
• The new permit shall have the same time limitations as all other permits.
Recommendation
The staff recommends DENIAL of the variance, because it has been since it has been
almost 8 years since the permit expired and Section 6-40 (f) limits relief to a time
extension not to exceed one year.

One of my clients, Mr. Joseph Pellerito, has an ongoing and very serious cardiac condition which has
forced him to delay construction on his home at Lot 12, Bay Point, Saddlebunch Key, FL, Permit
#9210003982. 11is health is now improved and he would like to resume construction; however, the permit
has expired.
Mary Ann Johnson in my office spoke with your assistant Colleen Gardner, on April 23, 2001, and was
directed to prepare a new building permit application and include the existing building permit number. We
were also directed to make a statement in the general remark section that the building delay has been due
to health problems.
Attached to the building permit application is a report outlining the specific requirements of Section 640,
MCC describing how Mr. Pellerito qualifies for the specified variance oftime limitations due to his medical
condition. Two attachments and a number of exhibits contain extensive documentation of the circum-
stances and hardship. Also enclosed is a check for $750.00 as anew application fee.
We appreciate your review ofthis information, and request that we schedule a meeting to discuss the

Section 6-40 of the Monroe County Code outlines the application procedures for expired and inac-
tive building permits. It clearly states that, even though a building permit expires, it can be granted
a variance to time limitations by the Board of County Commissioners.
Sec. 640. Application procedures for expired and inactive building per-
mits.
(f) Variances to Time Limitations: the board of county commissioners
may, upon application and public hearing, grant a variance to the time limi-
tations set forth in this section, upon a demonstration and finding that due
to one of the following conditions, the literal enforcement of the provisions
of this section would constitute a severe and undue hardship upon the per-
mit holder:
(1) Death or incapacity of an owner or immediate family member of
the owner. (emphasis added)
Exhibits 1-26 show the correlation between Mr. Pellerito's health concerns and the progress on his
building permit. Exhibits 1-12 reflect prior medical procedures and pre -building permit activities.
On January 10, 1992, Mr. Pellerito obtained a building permit (Exhibit 13) and proceeded with all
the necessary inspections and additional required authorizations (Exhibits 14-25). However, as
progress was being made on his home, Mr. Pellerito's health was deteriorating. As more time passed
since the life-saving cardiac procedures done in 1989, chest pain and pressure again began taking
over his life. Eventually, Mr. Pellerito was incapacitated and unable to manage the contractor work-
ing on his home. Increased medical expenses also affected his financial situation. Clearly, Mr.
Pellerito was physically and financially incapacitated, which prevented him from proceeding with
work on his house. In 1995, when he was unable to meet the next scheduled inspection, the building
permit expired. Luckily, due to a triple by-pass surgery performed in 1996 (Exhibit 26), Mr. Pellerito
is now on his way to recovering his health and wishes to complete his retirement home.

Attachments A and B are letters written by cardiologists in Key West, FL and Wilmington, DE and
refer to Mr. Pellerito's ongoing cardiac condition from 1980 to the present. They also note that Mr.
Pellerito is currently being treated for his condition and is in an improved state of health since his by-
pass surgeries.
Mr. Pellerito's serious medical problems caused such incapacity that it prevented him from meeting
the inspection requirements set forth in Section 6-40. His and his wife's primary focus was on
keeping him alive and paying for his much -needed medical care. As a result, the literal enforcement
of the provisions set forth in Sect 6-40 MCC would indeed constitute a severe and undue hardship
upon the permit holder. Since then, Mr. Pellerito has been slowly recovering. Not until now did his
medical and financial situation permit him to complete building his retirement home in the Florida
Keys. The one year maximum for the time limitation variance specified in Sect. 6-40 is fully ad-
equate for Mr. Pellerito to complete his home, as he has now relocated to the Florida Keys and
plans to proceed rapidly with construction.

Dear Jack:
Mr, Pellerito returns in follow-up. Ile's 47 years old. He
underwent his initial triple bypass in 1981. A follow-up cardiac '
cath this year after an abnormal stress test and symptoms of
chest pain revealeda 'saphenous vein graft to the LAD with an
orifical stenosis of 9'0% requiring a coronary angioplasty with
blockage reduced from'95 to 30% and gradient from 45 to 5 mm of
mercury. He's on Proclardia, 10 t.i.d.; Persantine, 50 t.i.d. and
1 Ascriptin. He has a past history of hypercholesterolemia. He
was last seen August 10. His angioplasty had been performed on
August 2. It's now been 5 weeks since the procedure.
His follow-up studies revealed a normal stress thallium exercise.
test, negative thallium perfusion scan with excellent functional
capacity, normal blood pressure response to exercise. A lipid
profile revealed the cholesterol was 184, tr.iglycerides 170.
Coronary risk was 0..7'times average, JIDL was 41. Normal CBC and
SMA-18. He's had no angina and no complaints.
Exam -- Blood pressure 105/80, pulse 70. Lungs are clear. S4
gallop. No murmurs. No edema.
EKG -- Sinus rhythm at 60. PR .12, QRS .06. Normal axis.
Normal tracing. No change,
He's doing quite well,'at this time about 5 weeks post
angioplasty. We'll see him back in about 2 months. Lipid
studies are to be repeated in about 2 months; we will check a
lipid profile and an HDL. Continue same meds for now. Resume
exercise program and call me PRN.

This is one of multiple ermdical admissions for this patient who ha`s;?:;::;
had severe coroanry arterl disease with CABG in 1980 and a CABG ,reCnt`ky"
at The Christiana Hospital within the last month. The recent CABG ,,4�,. �>+j
was complicated by pleural effusion which as an outpatient has worBe11eC1
He now has shortness of breath and chest pain especially with deep,
breathing over the last 2 wks. and on x ray has a significant pleural;.;"::Y:,
effusion. He is here for evaluation and treatment of the pleuraleffiis;on

SIGNIFICANT LABS & TESTS DURING THE HOSPITAL STAY: The SMA was esgentioA,;Y°
al ly within nromal limits I except for a mildly elevated LDH at '261.,
His pH was 7.47, PCO2 27.5, bicarb 20, P02 75 and 02 sat. 96. Thlsts:,; Y �
was on room air. The urine had trace protein, otherwise was essential'.ly
benign. White blood cells 7,700 on admission. There was an h/h. of
8.6/27/1 due to this recent surgery. There was no signfiicant shift];a3;r >;
with these white blood icells. Tap was done of pleural fluid. No'._patt'i'
growth. The glucose was 79 and fluid amylase was 50. There were J,0 -Ad0'
white blood cells and 60,000 red blood cells in the tapped fluid.''I

consisted of Digoxin 0425 mgs P.O. ocne daily, Persantine 75
tiems a day and 2 aspirin 4 times a day. He was specifically
notto take any antibiotics. He did have p.o. Augmentin when he left:.`;.;.
Christiana Hospital. He has also taken Percocet q. 4 hrs. as neede"d'
for pin. The patient is quite intelligent, understands his instru"c.t'i'Ons

The following documents must be included in an application for a
conditional use approval.
1) Location map showing where the project is ''Located on the key.
The purpose of this is to enable people to easily find the
project.
2) Photographs of sits; looking N, E, S, & al. from perimeters of
property and from the main adjacent road. A recent aerial
photograph with property boundaries delineated may bs substituted.
3) Sealed and signed survey by a surveyor registered ,in Florida.
The survey should indicate topography, al.1 existing structures,
paved areas, location of all, utility structures, bodies of water,
docks, piers, mean high water lisle, acreage by Land Use
District, and acreage by habitat.
4) Vegetation survey or habitat analysis, as applicable, by a
biologist qualified by the Monroe County Department of
Environmental Resources.
5) Site plan prepared by a Florida registered architect, engineer, or
landscaped architect at a standard engineering scale as
appropriate for the size and shape of the project. Including but
not limited to:
a) Property lines and mean highwatesr shoreline .and outside
dimensions of the entire parcel;
b) All areas and dimensions of existing and proposed structures;
c) Adjacent roadways and uses of adjacent property;
d) Setbacks required by the Lard Development Regulations;
a) Parking and loading zone locations and dimensions;
f) Improvements for the handicapped meeting state requirements;
g) Calculations for open space ratios, floor area ratios,
density and parking;
h) Outdoor lighting location and type;
i) Extent and area of wetlands, open space areas, and landscape
areas;
j) Provision for solid waste separation, storage, and removal;
k) Existing and proposed grades;
1) Type of ground cover such as asphalt; grass, pea rock,
permeable paving;
m) Storm water retention areas and drainage swnless;
n) Existing and proposed utility lines;
o) Sewage treatment facilities; and
p) Existing and proposed fire hydrants or fire wells.
5) Conceptual floor plans at an appropriate standard architectural
scales

the site plan and may be on a separate plan or shown on the site

plan should include but not be limited to:

8) Conceptual drainage plan prepared by a registered en8ineer. This
should be at the same scale as the site plan and may be on a
separate plan or shown on the site glen, as is most appropriate
for the particular project. The plan should show existing and
proposed topography, all drainage structures, retention areas,
and drainage swales.
9) Elevation drawings of all structures (existing and proposed) with
the elevation referenced to NGW datum of the following
features: existing grade, finished graded, top of foundation,
floor elevations, roofline, and highest mint of the structure;
10) Traffic study in accordance with, the Traffic Study handbook;
11) Phasing schedule,
12) Typewritten list of the names and addresses of all :all owners of
property within 300 feet of the borders of the project. This
list should be compiled from the current tax rolls located in
property appraiser's office. Also, please indicate the
subdivision name, lot & block #'s and •t;ie re # for: each address
and rote those that are adjoining the*project. Please realize
adjoining is not disrupted.by a canal or -street.
13) Written narrative. Section 9.5-65, Srand4rds applicable to all
conditional uses establishes the general criteria 'Applicable to
all conditional use$, 'Therefore, in a written format with
supporting documentation attached; please address the extent to
which:
(a) The conditional use is consistent with the purposes, goals,
and objectives of the Monroe County Cowiprehensive Plan and
Land Development Regulations;
(b) The conditional use is consistent with the community
character of the Immediate vicinity of the parcel proposed
for development;
{c) The design of the proposed development minimizes adverse
effects, including visual impacts, of the proposed use on
adjacent properties;

specifically modified by the public facilities capital
improvements adopted in the annual rapport required by this
chapter;
(f) The applicant for conditional use approval has the financial
and technical capacity to complete the development as

the provision and development of any open space and other
improvements associated with the proposed development;
(g) The development will not adversely affect a known
archaeological, historical or cultural resource;
(h) Public access to pub %r beaches and other waterfront areas
is preserved as a part of the proposed development; and
14) If the project is a maior .conditional use, the application must
include an environmental designation survey and cornunity impact
statement as required by sec. 9.5-69(a)(2) of the Monroe County
Land Development Regulations.
15) List of all other agency permits received or applied for on this
site.
