ITEM BACKGROUND: The item was considered by staff, the Development Review Committee and the
Planning Commission and all recommended approval.
PREVIOUS RELEVANT BOARD ACTION: During the 1986 planning process a motion was made
and later withdrawn regarding a possible change to the text to include private clubs in IS districts. A later
motion was made and the BOCC approved a designation to SC on the Upper Keys Sailing Club property.
No other records were found for the 1986 planning process concerning the Club, however there had to
have been others because the SC rezoning was never completed.
No records were found, however the acknowledgement of the Club most certainly a factor in the subject
property being categorized as Recreation (R) on the Future Land Use Map.

WHEREAS, the Monroe County Board of County Commissioners, during a regular
meeting held on November 20,2001, conducted a review and consideration of the request filed
by the applicant's agent to amend the land use district map from Improved Subdivision (IS) to
Park and Refuge (PR) for properties located in the Amended Plat of Point Pleasant, Key Largo,
Section 29, Township 61 South, Range 39 East, Monroe County, Florida, having the real estate
identification number 00496430.000000; and
WHEREAS, the Development Review Committee (Resolution D22-0 1), Planning
Commission (Resolution P73-0l)" and staff report all recommend approval of this land use
district (zoning) map amendment from IS to PR; and
WHEREAS, the Board of County Commissioners made the following Findings of Fact:
I. Section 9.5-511 of the Monroe County Code specifies that the Board of County
Commissioners may consider a land use change if at least one of six criteria is met. Section
9.5-511 also prohIbits a change which negatively impacts the community character.
Objective 101.4 of the Monroe County Year 2010 Comprehensive Plan requires that the
County regulate further development to maintain the character of the community.
2. The subject property is developed with three structures built between 1938 and 1944. It is
surrounded by residential neighborhoods. It is designated Improved Subdivision (IS) on the
land use district (zoning district) and Recreation (R) on the Future Land Use Map.

3. The applicant has requested the Park and Refuge (PR) land use (zoning) district, which is the
only zoning that is compatible with the Recreation (R) Future Land Use category (Policy
101.4.9).
4. The pre-l 986 zoning of the subject properties was BU-2 Medium Business District.
5. There will be no additional negative impacts on natural resources as a result of the proposed
land use change.
6. Sufficient public facilities capacity exists to accommodate the proposed land use change; and
WHEREAS, the Board of County Commissioners made the following Conclusions of Law:
I. The subject property meets the purpose of the proposed land use (zoning) district as well as
that of the current Recreation (R) Future Land Use Map designation and therefore would not
negatively impact community character, and is consistent with Objective 101.4. (Findings 1-
3)
2. There is a basis for consideration of the proposed map amendment because of Data Errors.
(Findings 1,3, and 4)
3. The proposed map amendment is consistent with Goal 102 and Objective 101.11 since it will
not negatively impact natural resources or overtax public facilities. (Findings 5-6)
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT

Subdivision (IS) shall be designated Park and Refuge (PR) as shown on the attached map, which
is hereby incorporated by reference and attached as Exhibit I.

Section 4. If any section, subsection, sentence, clause, item, change or provision of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 5. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of said conflict.

Section 6. This ordinance is hereby transmitted to the state land planning agency for review
and comment pursuant to Chapter 163, Florida Statutes.

Florida, but shall not become effective until a notice is issued by the Department of Community
Affairs or Administration Commission finding the amendment in compliance with Chapter 163,
Florida Statutes.

Club. Lots 7 and 8 were purchased by the Club in 1977 and Lot 8
was purchased in 1983.

The vicinity of the subject property is characterized by residential
neighborhoods. The subdivisions are the Amended Plat of Point
Pleasant and Buttonwood Shores.
The subject property's three structures were constructed between
1938 and 1944.

Pre-1986 Zoning:
Although the vicinity was all RU-l, the entire subject property was
zoned BU-2 Medium Business District.
Considerations During the
1986 Comprehensive
Planning Process:
During the 1986 planning process the subject property was discus-
sed several times. February 18, 1986 BOCC minutes state Staff
discussed a possible change in the Text to include private clubs as
a conditional use in the IS districts. A motion was made to not
change the current designation and the motion was withdrawn.
The item was continued to February 21st. On February 21st a
motion was made and the BOCC approved a designation to SC on
the Upper Keys Sailing Club.
No other records were found for the 1986 planning process
concerning the Club, however there had to have been others
because the SC rezoning was never completed.

Data Errors:
Using the land use map which became effective in 1973, the
subject property was correctly zoned for commercial uses. In the
1986 comprehensive planning process, the subject property was
changed to Improved Subdivision (IS) although this action made
the Sailing Club a nonconforming use. 1986 BOCC public hearing
minutes indicate that the Club was discussed several times with
comments including a possible change in the text to include private
clubs as a conditional use in the IS districts, which was continued
but brought up as a rezoning to Sub Urban Commercial (SC).
Staff believes an error was committed because the Club was
recognized as a nonconforming use in IS and the BOCC voted to
change the subject property to SC, however actions which
evidently changed the zoning to IS could not be located in BOCC
minutes.
The 2010 comprehensive planning process recognized the property
as Recreation (R) and staff is recognizing an error in the 1986
planning process which resulted in the property being designated
IS. Staff further acknowledges that correcting this error will bring
the subject property into compliance with Goal 101, Objective
101.4, and specifically Policy 101.4.9 of the Year 2010
Comprehensive Plan, which states that the principal purpose of the
Recreation land use category is to provide for public and private
activity-based and resource-based recreational facilities.

FINDINGS OF FACT:

Section 9.5-511 of the Monroe County Code prohibits anyamend-
ments which would negatively impact community character. Ob-
jective 101.4 calls for the County to maintain community charac-
ter and protect natural resources through a distribution of land uses
Consistent with the designations shown on the Future Land Use
Map. While the current IS zoning maintains the community char-
acter, only the proposed Park and Refuge zoning completely furth-
ers Objective 101.4.
Due to the fact that the subject property is less than one acre and is
developed on disturbed habitat, the proposed map amendment
supports Goal 102 and Objective 101.11.

WHEREAS, the Development Review Committee made the following Conclusions of Law:
1. The subject property meets the purpose of the proposed land use (zoning) district as well as
that of the current Recreation (R) Future Land Use Map designation and therefore would not
negatively impact community character, and is consistent with Objective 101.4. (Findings 1-
3)
2. There is a basis for consideration of the proposed map amendment because of Data Errors.
(Findings 1,3, and 4)
3. The proposed map amendment is consistent with Goal 102 and Objective 101.11 since it will
not negatively impact natural resources or overtax public facilities. (Findings 5-6)
NOW THEREFORE, BE IT RESOLVED BY THE DEVELOPMENT REVIEW
COMMITTEE OF MONROE COUNTY, FLORIDA, to recommend APPROVAL to the
Momoe County Planning Commission the request filed by the applicant's agent to change the
land use district (zoning) map from Improved Subdivision (IS) to Park and Refuge (PR) for the

in the lease, and the specific activities described in the lease is subject to all the tenns and conditions conwned in

Therefore, you will be required to inunediately:bring the facility intO full compliance if a subsequent inspection of
the facility is made and it is discovered that the facility is not in full compliance with all terms and conditions of
the lease. Any unauthorized stIUctUre and/or activity occurring on sovereignty submerged land associated with this

conjunction with an upland sailing and VOlent club. without fueling faciliues, with a sewage pump out facility if it meets the
regulatory requirements of the Department of Envirorunental Protection or local authority, which~er entity applies the more
stringent criteria, and without liveaboards. as shown and condiuoned In Attaclunent A ,
2. LEASE FEES: The Lessee hereby agrees to pay to the Lessor an annual lease fee of S1.380,87 ,plus sales we
pursuant to Section 212.031, Florida Statutes, if applicable, within 30 days of the dale ofrecelpl of the invoice, The Lessee
funher agrees to pay, within 30 days of receipt of an invoice, an annuallealie fee In a.'1 amounllo be delennined by the
provisions of section 18-21.011, Florida Administrative Code, for 3.116 square feet, beginning January I, 1998, or an earlier
dale determined by the provisions of section 18-21.00405, Florida Administrative Code, plus sales !a.x, if applicable, pursuant
to section 212,031, Florida SUtutes. The annual fee for the remaining years of the lease shall be adjusted pursuant to
provisions of Section 18-21.0 II, Florida Administrative Code, The Division of State Lands will notify the Lessee in writing

entire term of this lease, plus three (3) additional years. This period shall be extended for an additional two (2) years upon
reqt:.est for examination of all records and accounts for lease payment ver'.ncation purposes by the Lessor.
7. AGREEMENT TO EXrE1'-.'T OF USE: This lease is given to the Lessee to use or occupy the leased premises
only for those purposes specified herein. The Lessee shall not alter the approved use of the soverelgnty lands or the type of
use of the riparian uplands (e. g., co=ercial to multi-family residential) without first obtaining the Lessor's .",Tinen
authorization in the form of a modified lease and the pa}'IIlent of additional fees, if applicable, and the removal of that portion
of the original structures which are no longer authorized under the modified lease.
8. PROFERTI'" RlGHTS: The Lessee shall make no claim of title or interest to said lands hereinbefore described by
reason of the occupancy or use thereof. and all title and interest to said land hereinbefore described is vested m the Lessor,
9. IN"'TEREST IN RlPAJUAN "lJPLAA'D PROFERTI'": During the term of this lease, the Lessee shall maintain:l
leasehold or fee simple title inte~s; 1Il the riparian upland property and if such interes; is temunated, the lease may be
terminated at the option of the Lessor. Prior to sale and/or termination of the Lessee's fee simple utle interest in the upland
property, Lessee shall inform any potential buyer or transferee of the Lessee's upland property interest of the existence of this
lease and all its terms and conditions and shall complete alld execute any documents required by the Lessor to effect an
asSlgnment of this lease, if consented to by the Lessor. Failure to do 50 will not relkve the Lessee from responsibility for full
compliance ",'ith the terms and conditions of this lease which include, but are not limited to, payment of all fees and/or
penalty asses=ents in=ed prior to such act.
10, ASSIGNMENT OF LEASE: This lease shall not be assigned or otherwise transferred without prior written
consent of the Lessor or its duly authorized agen:. Such assignment or other transfer shall be subject to the terms, conditions
, and provisions of management standards and applicable laws, rules and regulations ;;l effect at that time. Any assignment or
other transfer without prior written consent of the Lessor shall be null and void and without legal effect.
11. !NTIEM}.1FICATIONlINVESTIGATION OF ALL CLAl},1S: The Lessee shall invesugate all claims of every
nature arising out of this lease at its expense, and shall indemnify, defend and save and hold harmless the Lessor and the
State of Florida from all claims, aCllons, lawSUlts and demands arising out of this lease,

litigation between Lessor and Lessee shall be initiated and maintained only in Leon County, Florida,

14. TAXES AA"D ASSESSJI.1:EN'TS: The Lessee shall assume all responsibility for liabilities that accrue to the
subject property or to the improvements thereon, including any and all drainage or special assessments or taxes of every land
and description which are now or may be hereafter lawfully assessed and levied against the subject prope~' dunng the
effective period of this lease. '
15. NUISANCES OR TI..LEGAL OPERATIONS: The Lessee shall not permit the leased premises or any pan
thereof to be used or occupied for any purpose or business other than herein specified unless such proposed use and occupancy
are consented to by the Lessor and the lease is modified accordingly, nor shall Lessee knowingly permit or suffer any
nuisances or illegal operations of any kind on the leased premises.
16. MAINTENANCE OF F ACTI..ITY IRlGHT TO INSPECT: The Lessee shall maintain the leased premises in
good condition, keeping the strUctUres and equipment located thereon in a good state of repair in the interests of public
health, safety and welfare. The leased premises shall be subject to inspection by the Lessor or its designated agent at an)'
reasonable time.
17. NON-DISCRTh-fINATION: The Lessee shall not discriminate agamst any individual because of that indi\'idual's
race, color, religion, sex. national origrn, age, ha.'1dicap, or marital status ....'ith respect to any acti\'ity occurring ....ithin the
area subject to this lease or upon lands adjacent to and used as an adjunct of the leased area. During the lease term. the
Lessee shall post and maintain the placard furnished to the Lessee by the Lessor in a prorrunent and visible location on the
leased premises or adjacent business office of the Lessee. It shall be the responsibility of the Lessee to post the placard in. a
manner which will prO'.'ide protection from the elements, and, in the event that SaId placard becomes illegible at any time
during the term of this lease (including any extensions thereof), to notify the Lessor m writing, so that a replacement may be
prO'.'ided,
18. ENFORCEJI.1:EN'T OF PROVISIONS: No failure, or successive failures, on the pan of the Lessor to enforce any
provision, nor any waiver or succesSlve waivers on its pan of any provision herein, shall operate as a discharge thereof or
render the same inoperative or impair the right of the Lessor to enforce the same upon any renewal thereof or m the event of
subsequent breach or breaches.

21. REMOVAL OF STRUCTlJRES! ADMINISTRA TI'/E FINES: If the Lessee does not remove said s:rucrures
and equipment occupying and erected upon the leased premises after expiration or cancellauon of this lease, such S1IU~'t\lres
and eqUlpment \\-ill be deemed forfeited to the Lessor, and the Lessor may authorize removal and may sell such forfeited
S1IUctUres and eqUlpment after ten (10) days wrinen notice by certified mail addressed to the Lessee at the address specified in
Pa.-agraph 13 or at such address on record as provided to the Lessor by the Lessee. Howe\'er, such remedy shall be in addluon
to all other remedies available to the Lessor under applicable laws, rules and regulations mcluding the right to compel
removal of all S1IUctUreS and the right to impose administrative fines,
22. REMOVAL COSTSILJEN ON RIP ARIAN UPLAND PROPERTY Any costs inCUlTCd by the Lessor in
removal of any S1IUctUres and equipment constnl::ted or maintained on state lands shall be paid by Lessee and any unpaid
costs and expenses shall constitute a lien upon the interest of the Lessee in its uplands enforceable in summ:uy proceedmgs as
provided by Law,
23 . RECORDATION OF LEASE, The Lessee, at its own expense, shall record this fully executed lease in its
entirety in the public records of the county within which the lease site is located within fourteen (14) days after reCClpt, and
shall provide to the Lessor within ten (l 0) days following the recordation a copy of the recorded lease in its entirety which
contains the O.R. Book and pages at which the lease is recorded.
24. RIPAIUAN RJGHTSIF1NAL ADJUDICATION: In the event that any pan of any StrUCture authorized
hereunder is determined by a final adjudicanon issued by a court of competent jurisdl::tion to encroach on or interfere with
adjacent riparian rights, Lessee agrees to either obtain written consent for the offendlng structUre from the affe..""ted riparian
ov.'Iler or to remove the interference or encroachment within 60 days from the date of the adjudlcation. Failure to comply
with this paragraph shall constitute a material breach of this lease agreement and shall be grounds for immediate termination
of this lease agreement at the option of the Lessor.
2S. AMENDl'vfEN!'SIMODIFI CATIONS: This lease is the entire and only agreement between the parties. Its
provisions are not severable, Any amendment or modification to this lease must be in writing, must be accepted,
acknowledged and executed by the Lessee and Lessor, and must comply with the rules and statutes in existence at the time of
the execution of the modification or amendment. Notwithstandlng the provisions of this paragraph, if mooring is authorized
by this lease, the Lessee may install boatlifts within the leased premises without formal modific:uon of the lease provided that
(a) the Lessee obtains any state or local regulatory permit that may be required; and (b) the location or si:te of the lift does not
increase the mooring capacity of the facility.
