NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Monroe
County, Florida, will hold a public hearing on November 20, 2001, at 3:00 PM, at the Key

WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter described
streets, alley-ways, roads or highways, and
WHEREAS, due notice has been published and a public hearing has been held in accordance
with Chapter 336, Florida Statutes, and
WHEREAS, at said public hearing the Board considered the argument of all parties present
wishing to speak on the matter, and all premises considered concerning the renouncing and
disclaiming of any right of the County and the public in and to the hereinafter described streets,

Petitioners seek the abandonment fDr the fOllowing reasons:
Petitioner seeks to aJ01n alleyWay to prOVide additional planted
bUfferyards for both properties.
Petitioner further seeks to clean up and maintain the grounds
which currently are an Unsanitary Nuisance. The grOunds are
covered with mOsquito harboring debris such as: auto parts,
tires, a mattress, rOofing material. buckets, jugS, etc.

Petitioners agree to be responsible for and pay for all costs of advertising and recording
fees incurred relative to this request for the vacation.
Petitioners further agree to grant any easement necessary for the fumishing of utilities,
including without limitation, electric power, water, sewer, telephone, gas cable and other
electric communication services to the same extent as is common within this area as to
height, width and degree. Upon request for such service or by the Board of County
Commissioners through its authorized agents. If easements are so required, copies of
the executed documents will be provided to the County before the petition is presented
to the BOCC.
Petitioners certify that the road to be abandoned does not end at water or that, if it does,
the road is not a dedicated and accepted right-of-way (including by operation of law due
to construction or maintenance by County).
WHEREFORE, Petitioners formally requests the Honorable Board of County
Commissioners to grant this petition.

Request from Reginald Rothing for a Road Abandonment
of portions of an alley between Lots 18-20 and Lot 21, Block 6,
of Pamela Villa Subdivision, Key Largo, FL., MM 102.
Reginald Rothing, owner of Lot 20, Block 6 and Lot 21, Block 6 of Pamela
Villa Subdivision has requested the abandonment of the entire southern
portion of an unnamed alley between Lot 20, Block 6, and Lot 21, Block 6
of Pamela Villa Subdivision (further shown as description (1) on the sealed
survey submitted with the application), and the abandonment of the
eastern portion of the same alley between Lot 18, and a Pc;lrt of Lot 19 of
Block 6 and Lot 21 of Block 6 of Pamela Villa Subdivison (further shown as
description (6) on the sealed survey submitted with the application) at
approximate MM 102, Key Largo, FL.
Lots 18, 19 and 20, Block 6 of Pamela Villa Subdivision are zoned Suburban
Commercial (SC). Lot 21, Block 6 is zoned Improved Subdivision (IS).
There are commercial buildings on Lots 18, 19 and 20. Lot 21 is vacant.
Roadway Description
The portion of the roadbed which Is the subject of the request for
abandonment is shown as an unnamed alley between Mahogany Drive and
Lignumvitae Dr. in Plat Book 3, Page 125 of the Public Records of Monroe
County. There is no evidence of any paving on the property, and the
property is completely covered with vegetation.
Use of the Road
There is no current use of this portion of the alley.
Development Potential
There is no development potential for the property.

The portion of road being proposed for abandonment does not tenninate
on open water.
Staff Review
A review of the records and an on site Inspecllon of the property revealed
the following:
1. The ortglnal plaited roadbed shows no signs of ever having
been completed. The entire property is covered with grass
and trees.
2. The occupants of the adjoining parcels of property have
submitted letters to the applicant stating that they have no
objections to the abandonment.
3. The applicant has received letters of concurrency from the
Florida Keys Aqueduct Authority, BellSouth, the Florida Keys
Electric Cooperative Association and TCI Cablevision of
Florida. No easements are anticipated in the proposed
abandonment area from any utility.
4. The applicant has stated that the roadbed proposed for
abandonment serves no other property owner.
Conclusion
Staff recommends APPROVAL of the request by Reginald Rothing for a
road abandonment of a portion the unnamed alley based on the following:
1. The road. proposed for abandonment serves only the
applicant. Therefore the request for abandonment meets the
requirements as outlined in the Monroe County Code Section
16-1.
2. The road does not terminate on a body of water, and is
consistent with goal 213 of the Monroe County Year 2010
Comprehensive Plan.
3. Based on the application and supporting documentation, the
abandonment will not impair the distribution of utilities in the
neighboring area.
