ITEM BACKGROUND: It is recognized that there are business uses which because of their very nature are considered as having serious objectionable characteristics, particularly when several are concentrated in any given location. A Monroe County ordinance is needed to require any such business to locate at least 1,000 feet from a similar business or any park, school, church, library or day care center. The adult video and book store, which also will feature "clothes and gadgets," plans .to open its doors within weeks Tn the . old Boot Outlet and Furniture Now building 'across from John Pennekamp Coral , Reef State Park. Adult Video Outlet is part of a chain with. several Florida and Texas locations, , Morty Benowitz, one of the partners in the business, said the 6,000 square feet of space is much smaller than its 10 Texas stores, but should be sufficient for the Upper Keys. , "They average 18,000 square feet," he said. "We're like a Home Depot. We're an upscale adult store." The company is owned by Fine Arts Group of Pompano Beach, which has signed a long-term lease with the building's owners. "I posted a stop work order on both front and back doors," said Jack Reed, a county code enforcement officer. When asked if the 'company conducted ,a marketing study to see if the community would patronize such a store, Benowitz said he has never had an adult store that wasn't successful. "Sex and sports. That's what the AmeriCan people are in to,'" he said. New store manager Mark Soto; 29, previously of Pompano Beach, said the store should" open within two weeks. ' '. WHEREAS, the Bacc are concerned that adult USe type businesses are causing deleterious secondary effects in unincorporated Monroe County; WHEREAS, the BOCC recognizes that under Young v. American Mini Theatres. Inc., 427 US 50 (1976); and City of Renton v. Playtime Theatre Inc.. 475 US 41 (1986), land use regulations that restrict the location of adult businesses must be content neutral and limited in scope to remedying only those harmful secondary effects that have been determined to exist; and WHEREAS, it is desired to have the Planning Deportment to undertake 0 ~tudy of the unincorporated area of Monroe County to determine the number and nature of adult businesses, the adverse secondary effects, and the possible locations land use districts, and other content neutral regulations for such businesses that will result in the effects being limited; now, therefore 8E IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERs OF MONROE COUNTY, FLORIDA: Section 1. For the purpose of this resolution adult business means a commercial establishment which. os its principal business purpose, offers for rental or sale sexually explicit material or features sexually explicit or nude entertainment. Section 2.
