AGENDA ITEM WORDING: Approval of directing Growth Management to
prepare an ordinance similar to Dade County's 33.255.1 to limit businesses having
serious objectionable characteristics from concentrating in any given location, or areas
frequented by minors.
ITEM BACKGROUND: It is recognized that there are business uses which because of
their very nature are considered as having serious objectionable characteristics,
particularly when several are concentrated in any given location. A Monroe County
ordinance is needed to require any such business to locate at least 1,000 feet from a
similar business or any park, school, church, library or day care center.

(b) For the pUIpOse of this section the following
definitions for terms used herein shall apply:
(1) Adult bookstore. Any busmes& engaged in
di$playing, distributing, bartering, renting
or selling printed matter, pictures, films,
graphic or other materials which activity
requires the exclusion of minors pursuant
to Chapter 847, Florida Statutes, unless
such activity comprises no more than fif-
teen (15) pert8nt oftbe total t1.oor area and
is kept from clear view of minors.
(2) Adult thsa.ter. Jmy business engaged in
presentingfilms, theatrical productions, per_
formances, recitals, displays, printed mat-
ter or other entertainment which activity
. requires the acl.usion of minors pursuant
to Chapter 847, Florida Statutes.

(3) Adult nieht club. Any business which fea-
tures live entertaimnent requiring the ex-
clusion ofmin~ pursuant to Chapter 847,
Florida Statutes.
(4) Adult video store. Any bUSiness engaged in
displaying, renting or selling videotapes

minors pursuant to Chapter 847, Florida
Statutes, unless such activity comprises no
more than fifteen (15) percent of the total
floor area and is kept from clear.view of

date of this ordinance; provided, however.

satisfies the spacing requirements set forth
at Section 33-255.1(d) shall not be required
to discontinue. During the aforementioned
three-year period, upon approval of the
Zoning Appeals Board after a publie heat'-
ing", any SUM nonconforming me which is
not in compliance with Section 83-255.1(d)
may be transferred to a site which satisfies
the requirements of Section 33-255.1(d) in
a BU~3 or IU zoning district.

Depot" of adult-oriented shops is
coming to Key Largo as soon as
it can get around the red tags. .
The adult video and book
store, which also will feature
"clothes and gadgets," plans .to
open its doors within weeks Tn
the . old Boot Outlet and
Furniture Now building 'across
from John Pennekamp Coral
, Reef State Park.
Adult Video Outlet is part of a
chain with. several Florida and
Texas locations,
, Morty Benowitz, one of the
partners in the business, said the
6,000 square feet of space is
much smaller than its 10 Texas
stores, but should be sufficient
for the Upper Keys. ,
"They average 18,000 square
feet," he said. "We're like a
Home Depot. We're an upscale
adult store."
The company is owned by Fine
Arts Group of Pompano Beach,
which has signed a long-term
lease with the building's owners.
They have not yet requested a
permit for a sign or remodeling,
but workers were busy painting
the interior and erecting wire

When asked what makes his

showroom.
"The staff will wear uniforms,
and they will not have sleazy
characters' hanging around," he
said.
When asked if the 'company
conducted ,a marketing study to
see if the community would
patronize such a store, Benowitz
said he has never had an adult
store that wasn't successful.
"Sex and sports. That's what
the AmeriCan people are in to,'"
he said.

'. He said his Pompano Beach
clientele is a mixed group.
"Men mostly come in and buy
books and videos, but 65 percent
of our clientele is. women," Soto
said. "They're the ones who buy

Dear Commissioner Nelson,
We are strongly opposed to the opening of the adult video and book store which is
planning to open in Key Largo in the old Furniture Now building across from John
Pennekamp Coral Reef State Park.
We object to this store being allowed to open its doors as we believe it will change the
character of our community.
Because we value the character of our community, we also request an adult business
ordinance which will restrict adult business operating in the vicinity of schools, state and
county parks, churches and residential communities. We request that the ordinance
require notification to community members of such applications in sufficient time for
objections to be made to Monroe County.
We urgently request that you to everything in your power to help us eliminate this very
real threat to our family-oriented community.

A RESOLUTION OF THE BOARD OF COUNlY COMMISSIONERS OF
MONROE COUNTY, FLORIDA DIRECTING THE PLANNING DEPARTMENT
TO PREPARE A REPORT ON ADULT BUSINESSES IN THE
UNINCOAPORATED AREA OF MONROE COUNTY.
WHEREAS, the Bacc are concerned that adult USe type businesses are causing
deleterious secondary effects in unincorporated Monroe County;
WHEREAS, the BOCC recognizes that under Young v. American Mini Theatres. Inc., 427
US 50 (1976); and City of Renton v. Playtime Theatre Inc.. 475 US 41 (1986), land use
regulations that restrict the location of adult businesses must be content neutral and limited in
scope to remedying only those harmful secondary effects that have been determined to exist;
and
WHEREAS, it is desired to have the Planning Deportment to undertake 0 ~tudy of the
unincorporated area of Monroe County to determine the number and nature of adult businesses,
the adverse secondary effects, and the possible locations land use districts, and other content
neutral regulations for such businesses that will result in the effects being limited; now,
therefore
8E IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERs OF MONROE
COUNTY, FLORIDA:
Section 1. For the purpose of this resolution adult business means a commercial
establishment which. os its principal business purpose, offers for rental or sale sexually explicit
material or features sexually explicit or nude entertainment.
Section 2. The Planning Deportment is hereby directed to prepare for the Boord's use
in determining the need for an adult business land use regulation and, if needed, the scope of
the regulations. a report containing the following:
a)
County;
the location of existing and proposed adult businesses in unincorporated Monroe
b) the trade: area of adult businesses. in othe:r words, from what areas do the adult
businesses draw their customers;
c) on evaluation of the impacts of adult businesses including:

(0 the incidence of crime in the vicinity of the businesses;
(ii) the effect on the value of commercial property in the vicinity of adult
businesses;
(iii) the effect on the value of residential property in the vicinity of adult
businesses.
d) recommendations for potential locations and land use districts for adult
businesses and recommendations for other regulations, e.g. mandatory distances between adult
businesses and non-adult uses, that will minimize the harmful secondary effects that the
Planning Deportment hos found to have occurred, or likely to occur, with existing or proposed
adult businesses.
Section 3. The Planning Deportment is directed to complete the report described in
Section 2 within six months of the date of this resolution, if possible.

florida, at a regular meeting of said Board held on the 20th day of November, 2001.
