ITEM BACKGROUND: School Board, with which County has an interlocal agreement to obtain school buses to evacuate special needs citizens and to also provide nursing homes and hospitals buses for same purpose, has requested termination of this agreement due to numerous egregious violations of our agreement with Country Health Associates, Inc. WHEREAS, on September 8, 1999, Monroe County, Golden Leaf Management, Inc. and Country Health Associates, Inc. entered into an agreement whereby the evacuation transportation agreement of June 18, 1997 was assigned to Country Health Associates, Inc. WHEREAS, the County has an Interlocal Agreement with the Monroe County District School Board to obtain school buses for evacuation of persons who have special needs or who are medically needy or transportation disadvantaged; and WHEREAS, said Interlocal Agreement expressly allows the County to enter into agreements for use of said buses for hurricane evacuation; and WHEREAS, Golden Leaf Management, Inc. manages the Key West Convalescent Center, Marathon Manor Convalescent Center, and Plantation Key Convalescent Center; and WHEREAS, the County entered into an agreement to provide 10-15 school buses for evacuation purposes in the event of hurricane category 3 and above strength storms; and WHEREAS, the School Board has notified the County of egregious breaches of the agreement which the County has with the management company for the nursing homes; now therefore BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Pursuant to Article V of the original agreement, Country Health Associates, Inc. shall be given 120 days notice of the County's termination of said agreement.
