A RESOLUTION SETTING THE DATE, TIME AND PLACE FOR A PUBLIC
HEARING CONCERNING THE PROPOSED ABANDONMENT OF TWO
PORTIONS OF SECOND STREET FROM AVENUE E TO AVENUE F AND
FROM AVENUE F TO AVENUE G IN SANDS SUBDIVISION, BIG PINE
KEY. MONROE COUNTY. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter described
streets, alley-ways, roads or highways, and
WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public hearing
after publishing due notice of said hearing in accordance with said Chapter, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Board will hold a public hearing on January 16, 2002 at 3:00 PM, at the
Harvey Govt. Center - Truman School, 1200 Truman Avenue Street, Key West, Florida,
to determine whether or not the Board will renounce and disclaim any right of the County and the
public in and to the following described streets, alley-ways, roads or highways as delineated on
the hereinafter described map or plat, to-wit:
TWO PORTIONS OF SECOND STREET, BIG PINE KEY, MONROE COUNTY, FLORIDA, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
THAT PORTION OF SECOND STREET FROM THE SOUTHERLY RIGHT OF WAY UNE OF
AVENUE G TO THE NORTHERLY RIGHT OF WAY UNE OF AVENUE F, AND THAT PORTION
OF SECOND STREET FROM THE SOUTHERLY RIGHT OF WAY UNE OF AVENUE F TO THE
NORTHERLY RIGHT-OF-WAY UNE OF AVENUE E, SANDS SUBDIVISION, BIG PINE KEY,
FLORIDA, AS PLATTED IN PLAT BOOK 1, PAGE 65, OF THE OFFICIAL RECORDS OF
MONROE COUNTY, FLORIDA.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting of the Board held on the day of December, 2001.

NAME
We hereby petition the Honorable Board of County Commissioners to
renounce and disclaim any right of the County and the public in and to the
street. alleyway, road or highway as described in the following attachments:
{Exhibit A} Survey
Description of roadway to be abandoned and survey showing that portion
marked with diagonal lines with petitioners' property clearly delineated and
outlined, and showing all adjacent properties.
{Exhibit B} Map of island/key on which road is located, clearly showing US 1, Mile
Marker number and portion of road to be abandoned.

Petitioners certify that they are the sole owners of Lot(s) I ~tcxt"3 ~
and that the abandonment of said road will not take away from other property
holders' right of ingress and egress to their property, and that the 19..2JJ!!.. taxes on
their subject land have been paid.
(Exhibit O) Legal description of that portion of roadway which petitioners seek
to have abandoned.
{Exhibits E-l, E-2, E-3, E-4} - Letters of no objection from utility companies -
including, but not limited to, water, electricity, telephone, cable TV.
(Exhibit F) - Letters of no objection from all adjacent property owners and
list of names and addresses of all adjacent property owners.
Petitioners seek the abandonment for the following reasons:

Petitioners agree to be responsible for and pay for all costs of advertising and
recording fees incurred relative to this request for the vacation.
Petitioners further agree to grant any easement necessary for the furnishing of
utilities. including without limitation. electric power. water. sewer. telephone. gas.
cable and other electric communication services to the same extent as is

common within this area as to height. width and degree. upon request for such
service or by the Board of County Commissioners through its authorized agents. If
easements are so required. copies of the executed documents will be provided
to the County before the petition is presented to the BOCC.
Petitioners certify that the road to be abandoned does not end at water or that. if
it does. the road is not a dedicated and accepted right-of-way (including by
operation of law due to construction or maintenance by County).
WHEREFORE. Petitioners formally requests the Honorable Board of County
Commissioners to grant this petition.

The FKAA Board of Directors approved at the February 21, 2001 meeting, the above referenced
project.
Pursuant to your request for the abandonment of the above-reference property, Staffhas
researched your request and have no objection to the abandonment of that part of Second Ave.,
that lies South of the Southern right-of-way of Ave. G and Northern right-of-way of Ave. F and
also that part of 2nd Ave. that lies South of the Southern right-of-way of Ave. F and the Northern
right-of-way of Ave. E, Sands Subdivision, Big Pine Key, FL. The FKAA has no objection to
the abandonment of this portion of right-of-way which is not cleared and is already encroached
upon by fences and trees. The FKAA does not have facilities within this right-of-way nor will it
be needed in the future.

We have reviewed the above-referenced petition for road abandonment and offer these
comments. This is an unusual request in that the platted right-of-way runs from Ave. A
to beyond Ave. J. Parts ofthe right-of-way are in use. Requests like this make it very
difficult for our crews to keep track of our responsibility. Also, I thought we were trying
to avoid piecemeal abandonments. With all that said, I would prefer that we not abandon
this but I could support it ifthe BOCC thinks it's a good idea.

Luis Cardoso owner of Lot 1, Block 35, Sands Subdivision has requested
the abandonment of 2nd Street between Avenue E and Avenue G. The
County Attorneys Office have requested the road abandonment of 2nd
Street between Avenue E and AventJl;) P for other adjacent property
owners. Properties which would be effected by the road abandonment:
Lots 8 and 9, block 36, Lots 8 and 9, Block 39, Lots 1 and 16, Block 35, and
Lots 1 and 16, Block 40, Sands Subdivision, Big Pine Key. The properties
are zoned Improved Subdivision (IS).
Roadway Description
The portion of the roadbed which is the subject of the request for
abandonment is shown as 2nd Street located between Avenue E and
Avenue G in Plat Book 1, Page 65 of the Public Records of Monroe County.
There is no evidence of any paving on the roadway, and the roadway is a
dirt road partially covered with grass and other vegetation.
Use of the Road
There is limited use of the road.
Development Potential
There is no development potential for the property.
Shoreline Access
The portion of road being proposed for abandonment does not terminate
on open water.
Staff Review
A review of the records and an on site inspection of the property revealed
the following:
1. The original platted roadbed shows no signs of ever having
been completed. The roadway is covered with gravel, grass
and trees.
2. The occupants of the adjoining parcels of property have
submitted letters to the applicant stating that they have no
objections to the abandonment
3. The applicant has received letters of concurrency from the
Florida Keys Aqueduct Authority, BellSouth, the Florida Keys
Electric Cooperative Assooiatic;m, . AT & T and TCI Cablevision
of Florida for the road abandonment of 2nd St between Avenue
E and Avenue G. No easements are anticipated in the
proposed abandonment area from any utility.

4. The applicant has stated that the roadbed proposed for
abandonment would be fixed up and maintained.
Conclusion
Staff recommends APPROVAL of the request by Luis Cardoso and the
County Attorney's Office for other adjacent property owners for a road
abandonment of a portion of based on the following:
1. The road proposed for abandonment serves only the applicant
and the other adjacent property oWilers who submitted letters
of no objection. Therefore the request for abandonment meets
the requirements as outlined in the Monroe County Code
Section 16-1.
2. The road does not terminate on a body of water, and is
consistent with goal 213 of the Monroe County Year 2010
Comprehensive Plan.
3. Based on the application and supporting documentation, the
abandonment will not impair the distribution of utilities in the
neighboring area.
4. The intersections of Ave. G & 2nd St, Ave. F & 2nd St, and Ave.
E & 2nd St are the only areas not included as part of the Road
Abandonment
