Adoption of a Resolution to the Florida Fish and Wildlife Conservation commission supporting the
prohibition of diving for lobster in the confined waters of the Monroe County, such as man-made
canals, basins, and marinas.
ITEM BACKGROUND:
At the last meeting of the Fish and Wildlife Conservation Commission (FWC) held in KeX Largo, the
issue of modifying the legislation concerning lobster mini-season was discussed. Suggestions such as
the establishment of a shoreline buffer were considered. The Fish and Wildlife Conservation
Commission Law Enforcement staff (formerly the Florida Marine Patrol) indicated that the latter
suggestion would not be enforceable, as it would be too hard to determine the apparent boundary of a
shoreline buffer zone. In subsequent conversations with Major Long of FWC, he indicated that he
,would support the establishment of a prohibition within the clearly definable confined waters of the
County, such as canals. The municipalities have indicated similar support for this effort

A RESOLUTION OF THE MONROE COUNTY BOARD OF
COMMISSIONERS SUPPORTING A CHANGE TO
LEGISLATION SUPPORTING A PROHIBITION OF
LOBSTERING ON AND WITHIN THE WATERS OF ALL MAN-
MADE CANALS, BASINS, OR MARINAS WITHIN THE
JURISDITION OF MONROE COUNTY, FLORIDA, INCLUDING
ITS MUNICIPALITIES.
WHEREAS, an increasing number of residents and visitors to the, Florida
Keys have registered grave concerns for real risks to life and safety du'e to the
allowed practice of taking lobster within man-made water bodies such as canals,
basins, and marinas;
WHEREAS, the taking of state resources (i.e. lobster and finfish) is
regulated by the state of Florida and its agency, Florida Fish and Wildlife
Conservation Commission (FWC);
THEREFORE, BE IT RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS, MONROE COUNTY, FLORIDA THAT:
In order to make the taking of lobster and finfish safer and to reduce the
number of complaints from property owners that are adversely impacted by diving
activities, we request that the FWC take the following actions:
1. Prohibit the taking by diving of state resources, such as lobster andfinfish,
on and within the confined waters of Monroe County, such as clearly
demarcated man-made canals and basins or its marinas. The waters affected
by this prohibition should include the confined waters within the municipal
jurisdictions of Key West, Marathon, Key Colony Beach, and Islamorada.
2. That consideration of this request should be taken up as soon as possible at
the next meeting of the FWC.
