COMMISSIONERS APPROVING EXEMPTION FROM THE NON-

POLICY 101.3.4 OF THE MONROE COUNTY YEAR 2010
COMPREHENSIVE PLAN FOR THE MOTE MARINE LABORATORY,
INC. FOR CHANGING THE USE OF THE SECOND FLOOR OF A
BUILDING FROM A COMMERCIAL APARTMENT TO A MARINE
LABORATORY. THE PROPERTY IS LOCATED OFF U. S. HWY 1 LOT

WHEREAS, Policy 101.3.4 of the Year 2010 Comprehensive Plan allows the Board of
County Commissioners to exempt federally tax-exempt non-profit organizations from the
nonresidential permit allocation system after a finding by the Planning Commission that such
activity will not adversely affect the hurricane evacuation objectives of the Comprehensive Plan;
and
WHEREAS, Mote Marine Laboratory INC. has requested an exemption from the non-
residential permit allocation system; and
"NHEREAS, during a regular meeting held October 10, 2001, the Monroe County
Planning Commission conducted a public hearing on the request of the Mote Marine Laboratory,
Inc. for an exemption to the non-residential permit allocation system for changing the use of the
second floor of a building from a commercial apartment to a marine laboratory; and
recommended approval of the request to the Board of County Commissioners based on the
following findings of fact and conclusions of law:
1. Mote Marine Laboratory, Inc. is a federally tax-exempt non-profit organization; and
2. An exemption to the non-residential permit allocation system pursuant Monroe County
Year 2010 Comprehensive Plan Policy 101.3.4 is required to change the use of the
second floor of a building from a commercial apartment to a marine laboratory; and

3. This laboratory is considered an institutional use and permitted as-of-right m the
Suburban Commercial (SC) land use district; and
4. The proposed change of use will add 779sf of floor space to institutional use; and
5. The proposed change of use of the floor space will not have any impact on hurricane
evacuation time as the commercial apartment use is being vacated; and
6. The institutional use must comply with County level of service standards and all
applicable land development regulations and the Monroe County 2010 Comprehensive
Plan prior to development approval; and
7. Pursuant to approval of the exemption by the Monroe County Board of Commissioners,
the applicant will possess a transferable development right that is not effected by ROGO.
8. The Transfer of Development Rights process requires a pre-application conference and
Minor Conditional Use approval for the sender site and receiver site;
Therefore, we conclude that based on numbers 1-8 above, that Mote Marine Laboratory Inc. will
not adversely affect the hurricane evacuation objectives of the Year 2010 Comprehensive plan;
and
WHEREAS, the Board of County Commissioners has duly considered the
recommendations and findings of fact and conclusions of law of the Planning Commission
adopts them as their own; NOW THEREFORE,
BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS, that the preceding Findings of Fact and Conclusions of Law, support their
decision to APPROVE to the request filed by Mote Marine Laboratory Inc. as a federally tax-
exempt, non-profit organization, for an exemption to the non-residential permit allocation system
pursuant to Policy 101.3.4 of the Monroe County Year 2010 Comprehensive Plan.

Dear Mr. Cadbury,
To complete installation of a laboratory fume hood, 1 tmderstand that you need additional
information regarding the use of the hood, It will be used as a general laboratory hood to permit safe
handling of volatile liquids. "Good Laboratory Practices" require that the handling of strong acids, strong
bases, tissue preservatives,~uchdej)md solvents be conducted in a hood to eliminate inhalation or
contact wtth mucous membranes by such materials. The materials are diluted or transferred into closed
containers within the hood before being used elsewhere in the lab.
The Center for Tropical Research conducts a variety of research procedures that involve such
materials, It is not a specialized lab that uses just one or two materials on a routine basis. However. 1 have
included a list below of the most common materials that would be used in the hood:
A. acids: hydrochloric, nitric, sulfuric, phosphoric
B, bases - sodium hydroxide, calcium hydroxide, potassium hydroxide
C. preservatives - formaldehyde, glutaradehyde
D. solvents - acetone, ethanol, methanol
NOT be used in this hood or anywhere at this facility.

On January I, 2000, Mote officially took possession of the entire seven lot troperty 8nd
mow.d into tho building in question expecting to use it as a marine research and education
laboratory. However, in October, Monroe County Growth Management's Senior Commercial
Planner, Barbara MitchelL advised that she could not issue a building permit for iDstBllaOOn of an
exterior-vented fume hood. We have the simple 1011 diameter PVC parts in hand and a sealed
letter, from P.E. Rosenblatt (att~cl1ed) states installation woukl not affect nor alter the structural
adequacy of the buildin& nor the safety or adequacy of its Y8D1ilation system.
Due to previous use as an apartment, claimed by Charles River Laboratories, Ms. Mitchell
maintains the building's second floor is so classified, and Mr. Joe Pasca1ik, Monroe County's
Building Official stated a proti:ssional engineer must evaluate the change in property uscage. A
current floor plan oftbc seooDd tloor, scaled by Mr. Rosenblatt is also attached.
This buildina is on Lot #17, Block 2 Summerland Key Cove, Addition No.2, and is the
eastern-most, oldest building oftbe three concrete block structures on the properties. During sales
negotiations it was known that the same second floor housed Charles River Laboratory's steam
autoclave, their Jab dishwasher, all their laboratory glassware, and assorted other laboratorY
equipment (precision sca1~ a centrifuge, a small fume hood, etc.) as well as a number of computers
and filing cabinets. Over the et)$Jdng years, in. reporting to Monroe County Building and, pl~nnmg
Dept., the Tax Appraiser and their own insuraIwc agents, Charles River Laboratories carried the use
of that entire second floor as a residential apartar.mt.
Mote Marine LaboratDry requests Mo1Jl'oc County permit the use of that approximately 1600
square feet second floor as a non-profit, non-commercial, research and education laboratoIY, at a
Standard Industrial Classification of 8733 - Scientific Research. Noncommercial, and erant
permission for us to install the exterior-vented fume hood. Monroe County Tax Appraisers have
already classified its use as such after an October '00 visit (pcn College or private school).
Certainly a fume hood is in keeping with their tmting classification.

Exhaust Connection
(Integral Blower Hood)
The exhaust connection on this hood features a molded plastic duct connection sized
~ to accept standard sized PVC duct material. The exhaust duct size has been designed to
~ allow for a minimum of static pressure loss through the hood at normal operating face
. velocities. and still generate a sufficient transport velocity through the ductWork to safely
exhaust the toxic materials being handled inside the hood.
