A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, PROVIDING FOR THE ACQUISITION
OF CERTAIN REAL PROPERTY IN MONROE COUNTY FOR THE
ENHANCEMENT OF EMERGENCY VEHICLE ACCESS TO DEVELOPED
LOTS ABUTTING CUDA LAN I;, RAE'S CUDA CANAL SUBDIVISION
WHEREAS, the Board of County Commissioners of Monroe County has
determined that the acquisition of a ten foot wide strip of real estate abutting, and
southerly of, Cuda Lane, is necessary for the public purpose of providing better
emergency vehicle access to the developed lots along said road; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1. Removal of the fence on the southerly side of Cuda Lane is a
necessary public purpose to remove impediments to the use of fire trucks and the
firefighting equipment contained thereon.
Section 2. The County Attorney is hereby authorized and directed to do all
things necessary to institute proceedings for the acquisition, by eminent domain, of real
property southerly of and adjacent to Cud a Lane as shown on Exhibit A, attached hereto
and incorporated herein by reference, and which is more particularly described, pending
a metes and bounds legal description to be developed in accordance herewith, as
follows:
Commencing at the northwest corner of the parcel having RE No. 483390
and lying in Tract 9 Southcliff Estates, as shown on Plat Book 2, Page 45,
Public Records of Monroe County, Florida, also known as the Point of
Beginning; thence in a southeasterly direction along the southerly right-of-
way line of Cuda Lane approximately 920' to a point which is the
southwesterly corner of Lot 29, Rae's Cud a Canal Subdivision; thence
southwesterly at a perpendicular angle 10'; thence northwest along a line
parallel to the southerly right-of-way line of Cud a Lane 50'; thence following
an arc which shall end in a line perpendicular to Cuda Lane southwesterly
for a distance of 40' from the southerly right-of-way line of Cuda Lane;
thence at a 900 angle to the northwest 20'; thence at a 900 angle to the
northeast to a point arcing back to the line parallel to the southerly right-of-
way line of Cud a Lane; thence following the extension of the line parallel to
and 10' from the southerly right-of-way of Cuda Lane a distance of 890' to
the westerly line of said tract; thence 900 northeast 10' back to the Point of
Beginning.

Section 3. This Resolution is being executed by the Board of County
Commissioners pursuant to the authority vested in the County under Sec. 127.01, FS
and in compliance with Sec. 127.02, FS.
Section 4. County Attorney is further directed to proceed with supplemental
quick-take proceedings under Chap. 74, FS in order to obtain title at the soonest possible
date.
