AGENDA ITEM WORDING:
Requesting direction from the County Commission to go forward with preparation of easement
documents whereby City of Key West will grant access easement along northern property
boundary (Item on Exhibit) for Bayshore Manor; and County will grant to City:
1) sewer line from proposed restrooms for Botanical Gardens to lift station, said easement
crossing County property south of Bayshore Manor (Item 2 on Exhibit); and
2) access easement along Aguero Circle (Item 3 on Exhibit) to proposed entrance to Botanical
Gardens, which entails a commitment to provide City with an access easement to the Botanical
Gardens entrance as shown on the attached map, even though the access easement may be
varied slightly when development of County property to the south of Bayshore Manor is finally
determined.
ITEM BACKGROUND:
Botanical Gardens has developed a plan which would create a new entryway to the Garden
from the County property, some of which was until recently used as a drive to County
buildings. In order for the City to issue building permits, a commitment is needed from the
County to provide an access easement to said proposed entryway. A rendering of the area in
question is attached as backup and shows three separate easements as well as the proposed
entryway. When the County develops or disposes of the property to the south of Bayshore
Manor and the Botanical Gardens, an access easement will continue to be necessary, although
the configurement may vary from what is currently pictured as Aguero Circle (note name is
misspelled on rendering). Before developing the legal descriptions for the easements, County
staff seeks clear direction that the County is committed to providing an access easement to
proposed entryway, even though the legal description may be altered in the future. The
easement documents will have to be approved by the County Commission but require
considerable time and effort of Staff to develop.
PREVIOUS RELEVANT BOCC ACTION:
December 9, 1992, County and City entered into an interlocal agreement providing easements
to each other for encroachments on City and County properties. Said interlocal agreement
expires December 8, 2007, and will probably need to be terminated early or amended upon the
removal of the old Public Service Building and the development of the County property.
