AGENDA ITEM WORDING: Approval of emergency repairs by D.L. Porter Constructors, Inc. to
the Old Courthouse Clock Tower.
ITEM BACKGROUND: A dispute exists with the Contractorl Rovel Constructionl concerning
work needed at the Old Courthouse Clock Tower. The Contractor has stated that such work is
not in the scope of his Contract. The County and our Architect disagree. There has already been
damage caused by recent rains. Approving D.L. Porter to perform the needed repairs will
alleviate this problem. The work will be paid for on a time and materials basis. Money for this
work is being held from Rovells pay.
PREVIOUS RELEVANT BOCC ACTION: On October 171 2001 the Board approved to waive
purchasing policies and procedures in order to make emergency repairs to the Clock Tower at the
Old Courthouse in Key West.
CONTRACT I AGREEMENT CHANGE: N/ A
STAFF RECOMMENDATIONS: Approval as stated above.

Dear Stephanie:
Attached is the estimated costs for the work outlined on pages D-3 and D-4 dated 8n/98. drawn
by Gonzalez Architects on the above referenced project.
It is our professional opinion the estimated cost to complete the above referenced work should
not exceed S 126.568.00. However. because of the na~ of the plans and. the existing
conditions, our {inn cannot guarantee this amount and therefore, suggest this project be
completed on a time and material basis. Prior to entering into an agreement, a meeting is
requested to review the actual requirements insuring that both owner and contractor arc clear as
to the intent and the expectation of the product supplied at completion.
D.L. Porter Constructors, Inc. agrees to commence work within 10 days of receipt of ~tten
"Notice to Proceed" and a building permit has been obtained from the bwlding department
whichever is the laner and complete the work in a timely manner.
