RESOLUTION NO. ~ -2002
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, ACCEPTING A GRANT FOR THE UPPER KEYS
COMMUNITY POOL PROJECT
WHEREAS, ON December 14, 2000, Monroe County leased to Upper Keys Community Pool, Inc, a
portion of the Key Largo Community Park for the purposes of constructing and operating a community
swimming pool; and
WHEREAS, said lease was for a period of twenty years; and
WHEREAS, the lessee corporation did apply for and receive a grant agreement in the name of
Monroe County; and
WHEREAS, there has been no action of the Board of County Commissioners authorizing said grant
agreement to be executed in its name; and
WHEREAS, the Board of County Commissioners of Monroe County finds that it is in the best
interest of the public to endorse said grant agreement and to apply the grant monies to the construction
costs incurred to establish the community pool on the grounds of the Community Park, which is owned by
Monroe County for the benefit and welfare of the residents of Monroe County; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA that:
1. DEP Contract Number F0208, a project grant agreement for the Upper Keys Community Pool
project, is hereby accepted as a grant to Monroe County and a sub-grant to Upper Keys
Community Pool, Inc.
2. The Mayor of Monroe County is hereby authorized to endorse said contract.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a
regular meeting of said Board held on the day of February, 2002.

Dear Mr. Roberts,
Monroe County recently received a check, for 90% of a $200,000 FRDAP
matching grant, awarded for 2000-2001, The remaining 10% is provided
upon completion of the work related to the grant. Upper Keys Community
Pool, Inc" hired a grant consultant to write and manage the grant, and has
already spent an amount exceeding the matching grant requirement for
which the funds were intended, and satisfied state requirements for
issuance of the check, Monroe County was, by necessity, the sponsor of
the grant.
Acting under authority I had assumed was inferred by the lease between
UKCP and Monroe County, and a resolution, submitted for consideration
by the BOCC, providing support for our efforts to obtain state funding
(which I have since learned apparently never made it before the SOCC), I
served as a contact person, agent, and designee for the application and
contract. Our intention to pursue these funds were described to you, in a
written communication, in October of 2000,
The Clerk of the Court has informed me that I did not have the authority to
sign either an application or a contract related to the above-referenced
grant program. He has further informed me that he will not release the
funds to UKCP.
Susan Hutton, of the County Attorney's Office, has forwarded to you a
draft resolution that may solve this problem, I have not seen the draft so
