McGarry, AI CP Director of Growth M;magem~ February 7, 2002 DATE: SUBJECT: Supplemental Information for Agenda Item L-9 c); First Day, February 13, 2001, BOCC Meeting Enclosed are a spreadsheet and supporting maps for the above referenced agenda item related to the EP A funded project for provision of on-site wastewater treatment systems through a decentralized wastewater management entity. The maps depict Cold Spot areas proposed for initial inclusion in the EP A, State, and County funded project to upgrade existing permitted on- site systems to meet wastewater treatment standards. The spreadsheet provides specifics on the number of unknown systems (will or are currently being upgraded), unknown systems-resolved (already upgraded), permitted systems (developed lots), and total number of lots by subdivision within each Cold Spot. The candidate Cold Spot areas were recommended by staff based on such factors as thF:. I) number and proximity of existing permitted systems yielding opportunities for clustering of on-site wastewater treatment and disposal systems; and 2) the likelihood that existing systems will not be incorporated into any central systems proposed for nearby Hot Spots. We got them because we worked in partnership with the associated agencies. EP A' s Bob Freeman, in fact, deserved no letter reprimanding him for clarifying a situation that had been left far from clear. No one has worked harder to make sure that these grant funds stayed designated for Monroe County through the months that followed our a~tions at November's HOCC meeting, actions which caused the FKAA to back away from accepting and moving forward with the grant. You've already heard from EP A: Valerie Nelson is not an EP A employee, and, while she is a true onsite aficionado and provides advice on onsite systems, she does not have the ability or the authority to change the rules of the grant program, which remain exactly as presented to you at our last BaCC meeting, That's the reason why, at this meeting, just like last one, you've been presented with a possible path for this grant money that is (I) in keeping with the master plan, (2) in keeping with the path originally laid out when this grant was first pursued, and (3) in keeping with the efforts ofFKAA on behalf of this grant. If the BaCC chooses to go in another direction, then so be it. I could care less, frankly. I just care that, however we spend it, we play by the rules and respect them. I don't want to see every federal relationship we've worked so hard to build and strengthen turn into the mess that is our current relationship with FEMA. So 'J you choose another direction than the one set before you at the last meeting, then here are the steps you will need to follow to stay respectful of the rules and the process as laid out by EP A: (1) The Master Plan will need to be refmed to reflect this new direction - it simply isn't enough to say that the Master Plan gets changed because we say so. I would suggest that we turn over any new direction to our Sanitary Wastewater Master Plan Technical Advisory Committee to ask them to flesh out whatever concept the Commission wishes to pursue. (2) Action will need to be taken to assure EP A that the commitment to onsite systems for the areas in which we plan to use the grants is a long term one. That means you can't use them in Key Largo, where you are attempting to pass those responsibilities off to an elected Board that will make these determinations. If, however, you wish to withdraw the legislation, then you could make such assurances, For other areas that are not designated as Cold Spots in the Master Plan, upon what would we base our long-term commitment? If our Key Largo legislation passes, the Mar 18 02 11:58a Commissioner Williams (305) 289-6306 p.3 FKAA has asked Ken Sorenson to remove them as the wastewater authority. So those regions are currently in question in terms of future direction. The strongest grounds for promising a long-term commitment would be to declare that this Commission is NOT committed to carrying out the work of the Master Plan in the next decade, i.e. that we're going to accomplish so little it doesn't make sense to hold out on the hot spots fOT more cost-effective options. Again. for simple clarity: the only reason to change direction is if you are not committed to cost-effective wastewater improvements throughout the Keys. And if you believe the FKAA shares your lack of commitment, We've done the research and we know the facts: a $2.2 million Master Plan accepted by every associated State and Federal agency has determined that the only areas where onsite systems are cost-effective are the Cold Spots. A resolution of our commitment to failure to implement the Master Plan should still be passed along to the SWMPT AC for consideration so that that Technical Advisory Body could determine the least damaging process for limited implementation and the highest priorities for treatment given the current circumstances. Of course, in terms of nutrient reduction, it really doesn't matter much whether we're replacing cesspools or 5eptic systems, since neither one was designed to do anything about nutrient reduction. And few of those who have had to put in place the new onsite systems have been pleased with the cost-efficacy of that alternative. That's one of the main reasons it's always been seen as wise to limit the use of these funds to areas where we know there just isn't a more cost-effective solution. This is the path staff has laid out for you in the materials presented at the last meeting.
