Dist. 5 October 12, 2001 To: From: Re: Kim McGee, Marine Projects Coordinator Richard Jones, Marine Resources Planner Additional work needed at Jolly Roger regulatory zone A survey earlier this week indicated that three additional regulatory markers are down at the Jolly Roger boating restricted area. American Underwater Contractors is already slated to install markers in the area next week, and it would be cost effective to have them perform the additional repairs while they are in the vicinity. They can use one of the remaining shallow water markers being removed from Sombrero Beach to replace one of the three broken markers. I have spoken to David Foster and he has provisions to repair the two other broken markers on site using couplings. Please amend the current contract with American Underwater Contractors to complete the following work: Site Jolly Roger (at Little Torch Key) Problem Need to replace a broken shallow water marker with one removed from Sombrero beach. Permit number on marker should be changed accordingly. CONTRACT AMENDMENT THIS AMENDMENT TO THE AGREEMENT is made and entered into this day of 2002, between the County of Monroe. hereafter County, and American Underwater Contractors, Inc. hereafter Contractor, in order to amend the agreement between the parties dated October 18,2001 a copy of which is attached to this amendment. The County and American Underwater Contractors, Inc., amend section 4 of the October 18, 2001 agreement as follows: 4. The Board shall pay the Contractor the total sum of $3,474.00 for the work listed in Exhibit A of this Contract. Payment shall be upon completion by the Contractor and review and approval of the close out documentation by the Marine Projects Coordinator. The Contnlctor and the Board, for the consideration named, agree as follows: 1. The Contractor shall furnish all the materials for the repair of regulatory aids located offofSombrero Beach, Marathon. and Jolly Roger, Little Torch Key, Monroe County as specified by Exhibit A. 2. The work perfonned under the Contract shall commence immediately from the date the Liaison provides the Notice to Proceed and shall be completed by November 30, 2001. 3. The Contractor understands the roles and procedures instituted by the Board to ensure an orderly progress to the project. Both the intent and the requirements of the Specifications attached as Exhibit A & B are understood by the Contractor. 4. The Contractor wamurts that it has not employe~ retained or otherwise bad act on its behalf any former County officer or employee subject to the prohibition of Section 2 of Ordinance No. 010-1990 or any County officer or employee in violation of Section 3 of Ordinance No. 020-1990. For breach or violation of this provision, the owner may, in its discretion, terminate this contract without liability and may also, in its direction, terminate this contract without liability and may also, in its discretion, deduct from the contract or purchase price, or otherwise recover the full amount of any ke. commission, percentage, gift, or consideration paid to the fonncr County officer or employee. 13. A person or affiliate who has been placed on the convicted vendor list following a conviction for public entity crime may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a bid on a contract with a pubHz entity for the construction or repair of a public building or public work, may not submit bids on leases real property to a public entity, may ~t be awarded or perform work as a contractor, supplier. subcontractor, or consultant under a contract with any public entity in excess of the threshold amount provided in Section 287.017, for CATEGORY TWO (510,000.00) for a period of36 months from the date of being placed on the convicted vendor list. 14. The Board may tenninate this Agreement with or without cause at any time upon giving the Contractor up to 10 days notice in writing.
