In accordance with Interlocal Agreement executed May 17, 2001 and the Supplemental
Agreement approved by the Board of County Commissioners on July 12, 2001, I am
forwarding our work plan for the subject improvements. As you can see from our
included schedule we anticipate beginning engineering and testing activities within thirty
(30) days, Ifwe can compress the SFWM/pEP permitting time (five 5 months) we would
advance the actual bidding and construction schedule.
Your assistance with this matter has been greatly appreciated. Should you, or appropriate

Per approved inte..rlocal agreements, we ~ve submitted several previous invoices for
payment. This letter is to provide additional backup for these invoices and to again
provide OUT work: plan for improvements to County Road ~04 as follows:
FirelEMS Equipment - Parae:raph 5. of the Interlocal Agreement effective 6/17/01
Attached is a list of capital equipment and vehicles which are within the authorized
purposes of the above named interlocal agreement. This agreement was for $ 440,000.
Enclosed are:
1) Receipts, invoices and cancelled cheeks totaling $ 150.161 for previous
expenditures to procure an ambulance with associated equipment. Our
previous submittal did not contain copies of the cancelled checks.
2) A list of additional capital items ~otaling $ 289,994 for which we will be
requesting the balance of the commitment ($'289,839). These items.will be
ordered and invoices sent to you and/or Danny Kohlage for payment.

We previously submitted an invoice in the amount ofS 480,751, which is the total of the
negotiated settlement. There was neve( a specific list of projects associated with this

Old Road Resurfacing - Supplementallntertocal Agreement for Road and Bridge Funds
See project costing and scheduled work plan attached, totaling $ 969,000 as per our
supplemental agreement. Please note that original schedule dates have passed. due to the
uncertainty of obtaining funds under this agreement. The Village will advertise for
competitive bids and invoice you and the County Clerk on a monthly basis as the work is
completed. I will not initiate this project until we have received the above previously
authorized funds for EMS and Growth Management.

Jim, in a few days (February 6, 2002) exactly one year will have lapsed since this Village
negotiated a good faith settlement with you and your Commission. To date, not one
dollar of the agreed upon funds have been received by the Village.

RESOLUTION NO. 01-06-35
A RESOLUTION OF THE VILLAGE COUNCIL OF
ISLAMORADA, VILLAGE OF ISLANDS, FLORIDA,
APPROVING AN INTERLOCAL AGREEMENT
("INTERLOCAL AGREEMENT") RESOLVING THE
FUND BALANCES ISSUES ADDRESSED BETWEEN THE
VILLAGE COUNCIL AND THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, IN
ACCORDANCE WITH THE PROCEDURES PRESCRIBED
BY THE FLORIDA GOVERNMENTAL CONFLICT
RESOLUTION ACT; AUTHORIZING THE MAYOR TO
EXECUTE THE INTERLOCAL AGREEMENT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, subsequent to the VILLAGE's incorporation, certain funds in the
COUNTY's possession derived from taxes and assessments and other revenues originating from
taxpayers and properties located within the VILLAGE remained in the COUNTY's budget and
treasury; and
WHEREAS, pursuant to Chapter 97-348, Laws of Florida, the Village was incorporated
on December 31, 1997 and all municipal type services, including planning functions, duties and
authority became, after December 31, 1997, vested in the jurisdiction of the VILLAGE and the
Village Council; and
WHEREAS, prior to the VILLAGE's incorporation, certain funds were budgeted by the
COUNTY for services and projects within the VILLAGE, including, but not limited to, roadway
improvements, planning assistance, parks and beach facilities, and other VILLAGE purposes;
and
WHEREAS, such funds were budgeted but not expended by the COUNTY for such
VILLAGE purposes; and
WHEREAS, pursuant to Section 125.01(6), Florida Statutes, the VILLAGE adopted
Resolution Nos. 98-1 and 00-10-42 in order to request the COUNTY to remit a proportionate
share of ad valorem and non-ad valorem revenues, special assessments, service charges, impact
fees, and other assessments, taxes, and revenues; and
WHEREAS, the VILLAGE and the COUNTY have participated in the procedures
prescribed by Chapter 164, Florida Statutes, the "Florida Governmental Conflict Resolution
Act," insofar as necessary to resolve this dispute; and
WHEREAS, Chapters 125 and 166, Florida Statutes, allow counties and municipalities
to contract for services to be rendered by the COUNTY to the VILLAGE and by the VILLAGE
to the COUNTY; and
WHEREAS, pursuant to Section 163.01, Florida Statutes, the "Florida Interlocal
Cooperation Act of 1969," local governments may enter into interlocal agreements to cooperate
with other localities to provide services in accord with geographic, economic, population, and
other factors; and
WHEREAS, the COUNTY has approved the Interlocal Agreement in the fonn attached
hereto as Exhibit "A."
NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
ISLAMORADA, VILLAGE OF ISLANDS, FLORIDA, AS FOLLOWS:
Section 1.
Adootion of Recitals. The above recitals are true and correct and
incorporated herein by this reference.
Section 2. The Interlocal Agreement is approved.
Section 3. The Mayor is authorized to execute on behalf of Islamorada, Village of
Islands, Florida, the Interlocal Agreement between Islamorada, Village of Islands, Florida, and

Monroe County, Florida, substantially ill the form attached hereto as Exhibit "A" and
incorporated herein by this reference.
Section 3.
This Resolution shall become effective immediately upon its adoption.
