The agreement provided for specific equipment to be transferred to the City when they were prepared to assume service. The City of Marathon plans to commence service on April 1,2002. PREVIOUS RELEVANT BOCC ACTION: At their September 20, 2000 meeting, the Board approved an Interlocal Agreement with the City of Marathon concerning the delivery of emergency medical and fire rescue services. At February 13, 2002 meeting, Public Hearing was held concerning the issuance of a Certificate of Public Convenience and Necessity to City of Marathon Fire-Rescue, effective April 1,2002. University Drive, Suite 702, Coral Springs, Florida 33071, entered into this 20th day of March. 2002. WHEREAS, it has been determined to be in the best interest of the public for the County to transfer to City certain emergency medical vehicles and equipment; and WHEREAS, Sec. 163.01, Florida Statutes authorizes local governmental units to enter into Interlocal Agreement to provide services and facilities to best meet the needs oflocal communities; now, therefore, In consideration of the mutual consideration and promises set forth below, the parties agree as follows: 1. EFFECTIVE DATE is April 1,2002. 2. COUNTY'S OBLIGATION: County shall transfer to City ownership and any accompanying bills of sale, and any other documents pertaining to the tangible personal property, ownership of which shall be transferred to the City. The personalty to be transferred includes: A. EMS Mobile Home: 1998 Chancellor Mobile Home, Manufacturer's Identification No. lAC FL 18801, Value: $35,751.38. B. All other property to be transferred is described on the pages attached hereto as Exhibit A., each page entitled Monroe County Inventory Deletion Request and dated April 1, 2002. 3. CITY'S OBLIGATION: City shall accept ownership of the property described in Exhibit A and shall have total responsibility for maintenance, liability and control. 4. NON-WAIVER. No waiver of any covenant or provision of this agreement shall constitute a waiver of any other covenant or condition or authorize the non-observance of the completion of the covenants or conditions of this agreement. 5. LAW. This agreement shall be construed in accordance with the laws of the State of Florida. Venue for any law suit arising out of this agreement shall be in Monroe County.
