AGENDA ITEM WORDING: Approval of a Resolution to authorize the Voluntary Home Buyout
Program (VHBP) project manager to act as the Fair Housing Coordinator for the duration of the
VHBP Subrecipient Agreement, and to perform Fair Housing Activities as required under the VHBP
Subrecipient Agreement to ensure CDBG-DR grant compliance.
ITEM BACKGROUND: Hurricane Irma, a Category 4 hurricane, made landfall in the Florida
Keys on September 10, 2017, causing the destruction or major damage to over 4000 homes.
Congress appropriated $616 Million for the State of Florida in the aftermath of Hurricane Irma to be
administered by the US Department of Housing and Urban Development. The Department of
Economic Opportunity (DEO) developed a Community Development Block Grant - Disaster
Recovery (CDBG-DR) Action Plan that detailed how the State will administer the funds statewide.
The State Action Plan provided $20 Million for Monroe County with a $5 Million maximum award
for each applying jurisdiction. Ultimately, and in order to direct these funds to where they were
most needed, Marathon was awarded $5 Million and unincorporated Monroe County was awarded
the remaining $15 Million. The purpose of Rebuild Florida's CDBG-DR Voluntary Home Buyout
Program (VHBP) is to acquire properties that are in high-risk flood areas to help reduce the impact
of future disasters. These funds will support property acquisition, structure demolition and
conversion of the land to open space or storm water improvements that alleviate flooding. The
property must be deed-restricted in perpetuity to open space uses or to restore and/or conserve the
floodplain functions.
The VHBP Subrecipient Agreement (agreement) detailing the $15 Million program award and
program requirements was approved by the BOCC through Resolution 150-2020 on May 20, 2020,
and fully executed on June 4, 2020. Pursuant to the agreement, and as a condition for the receipt of
CDBG-DR funds, the County must affirmatively further fair housing in its community and
demonstrate its commitment to affirmatively further fair housing by implementing specific activities.
The agreement further requires that the County designate an employee as the Fair Housing
Coordinator to receive fair housing calls. This resolution will designate the County staff member
assigned as the Project Manager and named as the Local Government Project Contact in the
agreement as the Fair Housing Coordinator and this appointment will be in effect for the duration of

the VHBP Subrecipient agreement. This resolution will also authorize the designated Coordinator to
undertake the Fair Housing activities required in the agreement. Examples of activities that may be
required include maintaining a log of fair housing calls, displaying fair housing posters, making fair
housing presentations to schools, civic clubs and neighborhood associations, manning a booth at
community events, and conducting workshops for county staff, realtors and apartment complex
owners.
Resolution 1 SO-2020 requires that Monroe County staff implement the VHBP in compliance with all
requirements imposed by Federal statues, regulations and the terms and conditions of DEO's Federal
Award, which includes the U.S. Department of Housing and Urban Development's (HUD) fair
housing activities. The VHBP Subrecipient Agreement requires that the County affirmatively further
fair housing in its community and demonstrate its commitment to affirmatively further fair housing
through activities as prescribed.
While the Monroe County Housing Authority is tasked with supporting these types of activities, it is
in the best interest of the County to ensure that the specific grant requirements under the VHBP are
satisfied in accordance with the VHBP Subrecipient Agreement. This Resolution seeks to authorize
County staff and specifically the VHBP project manager to perform the fair housing activities to
ensure grant compliance and therefore seeks authorization for the VHBP project manager to act as
the Fair Housing Coordinator for the VHBP and to perform the Fair Housing Activities as required
under the VHBP Subrecipient Agreement. This Resolution will be effective for the period of the
VHBP Subrecipient Agreement and the activities will resume as normal upon completion or
termination of the VHBP Subrecipient Agreement.
PREVIOUS RELEVANT BOCC ACTION:
On July 22, 2019, the BOCC approved the CDBG-DR VHBP grant application to DEO (Agenda
Item B.1).
On May 20, 2020, the BOCC approved Resolution 1 SO-2020 allowing the county to execute the
CDBG-DR VHBP Subrecipient Agreement with DEO (Agenda Item D.2).
On March 17, 2021 the BOCC approved the first amendment to the VHBP Subrecipient Agreement
(Agenda Item D.4.).
