ITEM BACKGROUND: The Applicant, Patrick Garvey, has requested for Monroe County to vacate and abandon a portion of County right-of-way situated on Pine Drive in Pine Hammock, according to the Plat thereof as recorded in Plat Book 3, Page 163, of the Official Records of Monroe County, Florida, bounded on the north by Don's Court; bounded on the west by Tract D and E, Pine Key Acres; bounded on the south by Pine Drive; and bounded on the east by Block 1, Lots 5-10. The location of the proposed abandonment is on Big Pine Key, at approximate mile marker 30.7, to the north of U.S. Highway 1. The properties adjacent to the right-of-way proposed for abandonment are highlighted in blue below. Packet Pg. 1254 K.1 ti' t .r f u , I t � r The Applicant has requested for the County to vacate the portion of the right-of-way of Pine Drive that bisects his own property (three parcels)to create one contiguous property and to be able to share utility service(s)throughout. The Applicant owns three parcels of land, which are on both sides of the subject right-of-way: Lots 5-8 to the east and Tract D to the west. Pursuant to Monroe County Code Section 19-1(e) "a right-of- way may be abandoned only at the terminal portion of the road and in its full width..." Therefore, the Applicant has included an additional segment of Pine Drive in this abaondment request in order to include the terminal portion of the road to the north of his property. The parcels adjacent to the terminal portion of the road are owned by the Monroe County Board of County Commissioners (Lots 9 and 10 to the east), and the State of Florida ("BOT TIF" or "TIF"; Tract E, to the west). Per Monroe County Code Section 19-1(c), "In all other cases of abandonment, no right-of-way shall be abandoned unless there is an agreement to do so by all affected property owners." The Applicant has obtained consent for the proposed abandonment from both Monroe County and the State of Florida (see attached Letters of No Objection, and BOCC agenda item H3, May 20, 2020). The figure below shows current property ownership; the hatched portion comprises the portion of public right-of-way that the Applicant has requested to County to vacate in his favor, and shows how the land will be split between respective adjacent property owners. The area in question is fenced in and appears to have been fenced in for some period of time. The area is non paved and grown over with grass and small trees. The only structures adjoining the property in question belongs to the applicant. There are no public safety issues with abandoning the right of way.. Law enforcement has no need to use that area and creates no hazards. The only question that I had was regarding the ability for the State and County to access their lots located just past the applicants property and at the end of Pine road. The applicant when asked about this indicated that he , had written consent from bath property owners (State and County). 1 asked for a copy of those letters and Mr. Garvey did E-mail copies of those letter on Aug. 03ad 2020 (Copies attached).
