Grant Funding to Local Municipalities for Boating and Waterway Projects to be Performed in
FY2022 including Regulatory Buoy Maintenance by the Village of Islamorada ($10,000), Dinghy
Dock Improvements by the City of Key West ($15,465.75), and Boat Ramp Repairs by the City of
Marathon ($35,000) for a Total Amount of $60,465.75, and direction for staff to prepare an Inter-
Local Agreement(ILA) with each municipality.
ITEM BACKGROUND: At the February 15, 2012, BOCC meeting, the Board approved
Resolution No. 080-2012 (attached) establishing policies and procedures for the award of Boating
Improvement (BIF) reimbursement funding to the municipalities with Monroe County. The
procedures provide for submittal of annual funding requests, a project scoring and selection process,
and award of funding through Inter-Local Agreements (ILA)based on funding availability.
Staff has received three funding request applications (attached) for FY'22, including: The Village of
Islamorada in the amount of$10,000 for regulatory buoy maintenance; the City of Key West in the
amount of $15,465.75 for dinghy dock security lighting and potable water outlets; and the City of
Marathon in the amount of $35,000 for boat ramp drainage repairs. Staff has scored the funding
requests as indicated below. A detailed Score Sheet is attached for reference.

The total funding request is $60,465.75. Typically, a $40,000 annual budget threshold is set for this
grant program. However, with additional funding anticipated from the Florida Fish and Wildlife
Conservation Commission (FWC) for derelict vessel removal in FY'22, more BIF funding will be
available for this grant program. Therefore, staff recommends approval of all three projects at the
funding levels requested.
Upon Board approval, staff will prepare an ILA with each municipality for the work to be performed
in FY'22. Staff anticipates bringing the ILA's back to the Board in July 2021 for approval.

RESOLUTION NO. 080 -2012
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS RESCINDING RESOLUTION NO.
371-2011 AND ESTABLISHING POLICY FOR THE
EXPENDITURE OF BOATING IMPROVEMENT FUNDS AND
PROCEDURES FOR THE AWARD OF BOATING
IMPROVEMENT FUNDS TO THE MUNICPALITIES WITHIN
MONROE COUNTY.
WHEREAS, moneys from vessel registration fees designated for the use of the
counties is distributed by the tax collector to the Board of County Commissioners,
pursuant to F.S. 328.72, hereafter referred to as State Boating Improvement Funds; and

WHEREAS, State Boating Improvement Funds are for the sole purposes of
providing recreational channel marking and other uniform waterway markers, public boat
ramps, lifts, and hoists, marine railways, and other public launching facilities, derelict
vessel removal, and removal of vessels and floating structures deemed a hazard to public
safety and health for failure to comply with F.S.327.53; and
WHEREAS, State Boating Improvement Fund revenues provide approximately
$250,000 annually; and
WHEREAS, the County approved Ordinance No.034-2002 to impose an annual
registration fee on vessels registered, operated, or stored in the water within its --
jurisdiction pursuant to F.S.328.66, hereafter referred to as County Boating Improvement
Funds; and

WHEREAS, County Boating Improvement Funds shall be expended for the c
patrol, regulation, and maintenance of the lakes, rivers, and waters and for other boating- c
related activities of municipalities or counties; and a
WHEREAS, County Boating Improvement Fund revenues provide
approximately$400,000 annually; and
WHEREAS, State and County Boating Improvement Funds are utilized by the
County for County channel marker and boat ramp maintenance, derelict vessel removals,
pumpout program costs, and other boating and waterway related projects Keys-wide; and
WHEREAS, the County may provide Boating Improvement Fund dollars to the
various municipalities for boating and waterway projects in accordance with the allowed
uses described in F.S.327.53 and F.S.328.66; and
WHEREAS, the County approved Resolution No.371-2011 which established
criteria for the general use of Boating Improvement Funds and procedures for the
reimbursement of Boating Improvement Funds to the municipalities; and

WHEREAS, the County desires to revise the policy established by Resolution
No.371-2011, refining the purpose of reimbursement funding to the municipalities from
Boating Improvement Funds, establishing funding request submission procedures, and
providing for a selection process for the award of reimbursement funding;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. Resolution No.371-2011 is hereby rescinded.
Section 2. The Monroe County Board of County Commissioners shall expend
State and County Boating Improvement Funds only for County boating and waterway
related projects, and municipal boating and waterway related projects in the form of
reimbursement funding, in accordance with the allowed uses of Boating Improvement
Funds as described in F.S. 328.72 and F.S. 328.66.

Section 3. The Monroe County Board of County Commissioners and
municipalities within Monroe County shall only perform boating and waterway related
projects that serve the general boating public.
Section 4. The Monroe County Board of County Commissioners may provide
reimbursement funding from Boating Improvement Funds to the various municipalities
for the purpose of providing for repair and maintenance of existing infrastructure, as well
as for capital improvement projects. The following procedures are established:
Funding Requests. Reimbursement funding requests shall be received by the
County no later than April 1 of the fiscal year for funding from the upcoming
fiscal year. Funding request forms will be available accompanied by
guidelines including the following criteria: co
1- Projects for consideration must occur over public upland or public bay c
bottom. y
2- Funding shall not be provided for projects previously completed.
3- Requests for repair and maintenance funding for projects involving
revenue producing infrastructure (such as, but not limited to, mooring
fields or marinas or fee generating boat ramps) which should be
completely self-funding are discouraged. Requests for project funding for
revenue producing infrastructure shall include evidence and written
analysis by the applicant of unmet costs, such as a current annual financial
report, indicating total revenue, total expenses, and unmet availability of
funds for repairs and maintenance. Boater Improvement Funds should not
be used to simply supplant repair and maintenance funding.
4- Requests for new improvement funding for projects that may involve
future revenue producing infrastructure should include a fiscal analysis
and assurance from the municipality that the improvement will be self-
supportive and include operating and maintenance funding for future
needs.

5- Project Selection. Municipality funding request forms received shall be
reviewed by County Growth Management staff(Staff) after April 1 of the
fiscal year. Staff shall score each funding request and make selection
recommendations based on community need, project merit, and funding
availability. Staff recommendations may include awarding all of, or a
portion of the amount requested. Staff shall provide funding requests and
selection recommendations to the BOCC by June of each fiscal year. The
BOCC shall evaluate the staff s recommendations and provide Board
approval in ranking order, based on funding availability.
6- Funding Awards. After the Board approved projects are known, each
applicant shall enter into an Inter-local Agreement (ILA) with the County
indicating the municipality shall expend the funds and show evidence of
expenditures, prior to reimbursement.

The Key West Mooring Field is a first come first serve public use facility. W
This new infrastructure project will add much needed lighting for the dinghy docks as well as the parking lot
where the mooring field boaters park their cars. Current lighting is on the bath house facility and three street
light poles in the parking lot.These areas currently are dimly lit which creates safety issues and increased
chance of theft. The new additional lighting will significantly light up the docks and parking lot providing safety
and security. There will be back to back lights added on raised poles facing both the five docks and the
parking lot.
Currently there is one potable water outlet for all of the 140 mooring rigs in the mooring field. This project will
add five additional water outlets, one at the end of each dinghy dock. This will allow for much needed access
to potable water for the people using the mooring field.
Fiscal year Budget projections(Attached)show Revenues of$405,000 and Expenditures of$464,643 for a
net loss of$59,643.

WHEREAS, by Resolution No. 15-033 of the City Commission of the City of Key West,
Monroe County, Florida, passed and adopted on January 21st, 2015, the foregoing conveyance
was approved by the Grantee. A copy of Resolution No. 15-033 is attached hereto as Exhibit "B".
NOW, THEREFORE, THIS INDENTURE WITNESSETH: That the Grantor does hereby
remise, release and quitclaim unto the Grantee, and its successors and assigns, forever, all the
right, title and interest of the Grantor, pursuant in all that certain land situate in Monroe County,

TO HAVE AND TO HOLD, the said premises and the appurtenances thereof unto Grantee.
REVERTER — The Property herein described is to be used in perpetuity for the Public

RESERVING UNTO GRANTOR and its successors, an undivided three-fourths interest in
all the phosphate, minerals and metals that are or may be in, on, or under the said land and an
undivided one-half interest in all the petroleum that is or may be in, on, or under said land with the
privilege to mine and develop the same on all lands wherein the grantor holds the requisite
interest, provided, however, that in no event shall the exercise of Grantor's rights hereunder
interfere with Grantee's use of the Property.
THIS CONVEYANCE IS made subject to access control requirements, any unpaid taxes,
assessments, liens, reservations, or easements of any kind which may be in place, or
encumbrances of any nature whatsoever which the Grantee hereunder and herein assumes.

Project description and purpose (explain the community need and project merit):
The community, both residents and visitors alike, use the City of Marathon's 33rd St. boat ramp due to its W
easy access to the waterway and its location as one of the few public boat ramps in the middle keys. The
drainage collection system adjacent to the ramp has been compromised and requires repair in order to c
mitigate the water quality component of the system, which is also jeopardizing the safety of users as they
navigates their boats and trailers. The request for repair funding does not supplant existing repairs and
maintenance funding for the boat ramp and serves to improve boating and waterway access, safety, and
water quality for the general boating public.

Description of how project may promote public water access:
Currently the trench drain is failing and does not work properly and and can potentially be a hazard for the
users of the facility. Repair of the drain would improve access to the boat ramp, increasing boater safety as
they maneuver their vehicles and boat trailers. As the population of the boating public increases, the City of
Marathon is aware of the demand for safe water access. This proposal promotes public water access to one
of the only bayside boat ramps in the Marathon area. It's convenience for the boating public cannot be under
estimated.
Status of project (is the project designed/permitted if applicable?)
The applicant will provide any pertinent documentation to assist with the review and evaluation of the funding request
such as site plans(verifying property ownership), design plans, permits, etc.
The project has been designed and no permits are required as all work to be performed is upland of the
waterway. Please refer to the attached documentation.
