ITEM BACKGROUND: In 2017, the County Commission started purchasing undeveloped single-
family lots from willing sellers to buy down potential takings liability in anticipation of the State
cutting off additional ROGO allocations in 2023. This effort is known as the Density Reduction
Program; lots acquired are often referred to as "density reduction lots."
On October 16, 2019, the Board authorized the County Attorney to initiate the statutory process for
disposing of County owned property with respect to 11 lots on Duck Key on the condition that they
be deed restricted so that no residential housing could be built upon them. Eight of the eleven lots
were previously put out for bid and successfully closed.
Duck Key residents have repeatedly inquired about the possible purchase of the remaining three (3)
lots for non-housing uses. Bids were solicited for those lots in April of 2021. The request for bids
was advertised in the Key West Citizen on April 2nd and April 9th. The Citizen is the County's only
local newspaper of general circulation that meets the statutory requirements for noticing sale of
excess property. In order to reach more readers, ads were also placed in the Keys Weekly on April
Pt and April 8th and the News Barometer on April 2nd and April 9th. Additionally, notice was
published on the County's website, DemandStar.com, and www.MonroeCountybids.com.
The minimum bid for Parcel ID No. 00379800-000000 was $22,460.
The Bids were opened on April 22, 2021. The highest Bid for Parcel ID No. 00379800-000000 was
$175,000. This Bid is presented to the Board of County Commissioners for acceptance and for
authorization to sell the parcel. Staff requests permission to negotiate with the next responsive
bidder should the parcel not close with the highest responsive bidder.
County staff has determined that these lots are not required to provide County services on Duck Key.
The sale of this lot would reduce the County's maintenance costs and liability exposure should

someone be injured on the lots, as well as return the lot to the tax rolls.
PREVIOUS RELEVANT BOCC ACTION: On 10/16/19, the BOCC adopted Resolution 378-
2019. On 1/22/20, the BOCC approved the sale of eight of the 11 lots. On 2/19/20, the BOCC took
no action on disposing of the remaining lots. On 3/17/21, the BOCC adopted Resolution 122-2021
authorizing the sale of the remaining three non-conservation density reduction lots on Duck Key.
