(CONSULTANT) shall provide the following professional services to the County of Monroe, Florida (SPONSOR) including administrative and full-time construction observation and construction administration services during the Construction of the above project at Key West International Airport. PROJECT DESCRIPTION The project involves the construction of a new Airport Access road that includes parking areas, drainage, and lighting. Work includes demolition of several small buildings and improved access to the existing fuel farm. New construction generally consists of approximately 500 feet of two- lane road and 140 feet of single lane road, 50 parking spaces, 440 feet of 6-inch waterline, and fencing, drainage, storm water controls, and associated electrical service, luminaires and poles, and all other incidental construction items necessary to complete the project. • PROJECT BID PHASES:The project construction will be procured in one bid phase and a construction contract will be awarded to a single contractor. • PROJECT SCHEDULE: Construction of this PROJECT is anticipated to proceed and be completed according to the following schedule: • Notice to Proceed for Permits is scheduled for May 2021 • Notice to Proceed for Construction is scheduled for July 2021 The construction contract duration will be 270 calendar days (9 months) from NTP for construction. Construction close-out is anticipated to be complete in June 2022. • PROJECT BUDGET: The PROJECT's total construction cost based on bids received by Monroe County is$3,163,649.67. • PROJECT TEAM: The PROJECT will be executed by the following firms noting their primary scope of responsibilities: CONSULTANT McFarland Johnson, Inc. Construction Administration McFarland Johnson, Inc. Construction Observation/Inspection SUBCONSULTANT TSF, Inc. Materials Testing It is anticipated that one Resident Project Representative (RPR) with an average of five (5) days per week at 10-hours/day will be required during the duration of the on-site construction activities. In addition, support services will be provided to the field staff as necessary by the various design disciplines included in the project. RESPONSIBILITY OF THE SPONSOR The SPONSOR shall coordinate all efforts of the Airport Staff and Airport Tenants including the following tasks: • Establishment of project budget, project schedule, and project design criteria. • Engagement of FDOT and other project Stakeholders. • Coordination, determination and provision of temporary facilities and operations including any equipment. SCOPE OF WORK The CONSULTANT shall provide the following professional services including administration and full-time resident construction observation services during the construction of the PROJECT. The CONSULTANT will be supported by efforts from the SUBCONSULTANT as indicated above and throughout this Scope of Work. The proposed PROJECT will be performed and constructed by SPONSOR with grant assistance from the State of Florida Department of Transportation (FDOT). ADMINISTRATION/PROJECT MANAGEMENT: Services provided for under this phase typically include: 1. Consultation: CONSULTANT shall provide advice to the SPONSOR during construction, including the holding of a pre-construction conference and final inspection conference as required. 2. Weekly Meetings: For the duration of the PROJECT, a weekly meeting will be conducted by the CONSULTANT with anticipated participation by the SPONSOR, and the construction contractor(CONTRACTOR). Meeting will be held in-person at a location designated by SPONSOR. Other invitees may participate by audio conference. 3. Site Visits: CONSULTANT's Construction Supervisor and/or Project Manager shall make visits to the site at intervals appropriate to the various stages of construction, as CONSULTANT deems necessary, in order to observe the progress and adherence to the Contract Documents of the various aspects of the CONTRACTOR(s)' work. It is anticipated that the Project Manager or Construction Supervisor will visit the site twelve(12)times during construction for a period of two (2) days per visit. 4. Shop Drawing and Requests for Information (RFIs): CONSULTANT shall review and take other appropriate action with respect to Shop Drawings, RFIs, Material Submittals, Samples and other data which the CONTRACTOR(s) are required to submit, but only for conformance with the information given in the Contract Documents and compatibility with the design concept of the completed Project as a function of the whole as indicated in the Contract Documents. Such reviews and approvals or other action shall not extend to means, methods, techniques, sequences, or procedures of construction or to safety precautions and programs incidental thereto. TSF,as SUBCONSULTANT will provide Construction Materials Testing and Inspection Services as further described in SUBCONSULTANT scope attached as Attachment I, under the general supervision of CONSULTANT in addition to Section 01 4533 Code- Required Special Inspections as identified in the conformed construction contract documents. CONSTRUCTION OBSERVATION: Construction observation services shall be provided by a competent Resident Project Representative(RPR), and staff, familiar with airport operations at a facility similar to that of the SPONSOR's. 1. Applications for Payment: Based on 1)CONSULTANT's on-site observations of work progress; 2) information provided by the RPR; 3) review of the CONTRACTOR'S applications for payment by RPR and SUBCONSULTANTS including the accompanying data and schedules: a. CONSULTANT shall determine the amounts owing the CONTRACTOR(s) and recommend in writing payments to CONTRACTOR(s) in such amounts. Such recommendations of payment will constitute a representation to the SPONSOR based on such observations and review,that the work has progressed to the point indicated, and that, to the best of the CONSULTANT's knowledge, information and belief,the quality of such work is generally in accordance with the Contract Documents(subject to an evaluation of such work as to a functioning whole prior to, or upon, Substantial Completion, to the results of any subsequent tests called for in the Contract Documents and to any other qualifications stated in the recommendation). b. By recommending any payment, CONSULTANT will not thereby be deemed to have represented that exhaustive,continuous or detailed reviews or examination have been made by CONSULTANT to check the quality or quantity of CONTRACTOR(s) work as it is furnished and performed beyond the responsibilities specifically assigned to CONSULTANT in the Agreement and the Contract Documents. CONSULTANT agrees that he will exercise reasonable professional judgment in verifying that the adherence to the Contract Documents and quantity of the work meets requirements of the Contract Documents for which CONSULTANT is contractually responsible. CONSULTANT's review of CONTRACTOR(s)'work for the purposes of recommending payments will not impose on CONSULTANT responsibility to supervise,direct,or control such work or for the means, methods, techniques, sequences, direct, or procedures of construction or safety precautions or programs incident thereto or CONTRACTOR(s) compliance with laws, rules, regulations, ordinances, codes, or orders applicable to their furnishing and performing the work. It will also not impose responsibility on CONSULTANT to make any examination to ascertain how or for what purpose any CONTRACTOR has used the monies paid on account of the Contract Price, or to determine that title to any of the work, materials, or equipment has passed to Key west International Airport r Access Road ci> McFarland Johnson Full-Time Construction Administration and Resident Inspection—Scope or Services 4 Si McFarland Johnson SPONSOR free and clear of any lien, claims, security interests, or encumbrances, or that there may not be other matters at issue between SPONSOR and CONTRACTOR(s)that might affect the amount that should be paid. c. It is assumed that ten (10) contractor applications for payment will be reviewed and recommendations for payment provided during the project. 2. Resident Inspection: Provide technical observation of construction by one (1) Resident Project Representative (RPR) and supporting staff as required on an average of five(days)per week and 9-hours/day during construction,who will also: a. Maintain a project record in conformance with the Florida Dept. of Transportation (FDOT) construction record keeping standard forms, as adopted for use on an Airport Project. b. Complete, review, and verify requests for monthly and final payments for CONTRACTOR(s). c. Prepare, compile, and negotiate change order documentation and supplemental agreements with the CONTRACTOR(s) on behalf of the SPONSOR. d. Conduct regular project progress meetings on site with all interested parties, and coordinate documentation of these meetings. These meetings will be held on a weekly schedule as the contract work continues on the project. e. The CONSULTANT will employ qualified materials testing firms qualified to perform materials testing and special inspections. The CONSULTANT shall assure that all requirements, as applicable to specified materials, are adhered to. f. Inspection days and hours may be adjusted to meet the contractor's schedule, emergency work, or other factors that affect the need for inspection during a specific day. If budgeted hours are exceeded due to extensions in construction contract time, additional budget hours will be required. 3. Contractor(s)'Completion Documents: CONSULTANT shall receive and review maintenance and operating instructions, schedules, guarantees, bonds, and certificates of inspection, test and approvals which are to be assembled by CONTRACTOR(s). Inspections: CONSULTANT shall conduct an inspection to determine if the work is substantially complete and a final inspection to determine if the work is acceptable so that CONSULTANT may recommend, in writing, final payment to CONTRACTOR(s) and may give written notice to SPONSOR and the CONTRACTOR(s) that the work is acceptable (subject to any conditions therein expressed), but any such recommendation and notice will be subject to the limitations expressed in this Section `B.I.b". CONSULTANT shall be the Design Professional in Responsible Charge with regards to the Special Inspection Program. As such the CONSULTANT will retain the services of and coordinate with a Special Inspector who will perform the Code required Special Inspections. The CONSULTANT will review the inspection and testing reports and will submit interim and final reports to the Building Official. 5. Completion Certificates: Issue certificates of completion to the SPONSOR. 6. Limitation of Responsibility: CONSULTANT shall not be responsible for the acts or omissions of any CONTRACTOR(s),or of any Subcontractor or supplier,or any of the CONTRACTOR(s)' work, nor shall the CONSULTANT have the responsibility to supervise, direct, or control CONTRACTOR(s)' work or for the means, methods, techniques, sequences, or procedures of construction or for the safety precautions or safety programs of the CONTRACTOR(s). 8. Limitations of Authority: (RPR, Inspector and On-Site Staff) a. Shall not authorize any deviation from the Contract Documents or substitution of materials or equipment, unless authorized by the CONSULTANT. b. Shall not exceed limitations of CONSULTANT's authority as set forth in the agreement or the Construction Contract Documents. c. Shall not undertake any of the responsibilities of CONTRACTOR, subcontractors or CONTRACTOR's superintendent. d. Shall not advise on, issue directions relative to or assume control over any aspect of the means, methods, techniques, sequences or procedures of the construction unless such advice or directions are specifically required by Contract Documents. e. Shall not advise on, issue directions regarding or assume control over safety precautions and programs in connection with the work. Shall not accept Shop Drawing or sample submittals from anyone other than CONTRACTOR. g. Shall not authorize SPONSOR to occupy the Project in whole or in part. h. Shall not participate in specialized field or laboratory tests or inspections conducted by others except as specifically authorized by CONSULTANT. 9. Responsibilities/duties of Construction Observation Staff: In general,the on-site project representative and staff are responsible for monitoring construction activity on a project and documenting their observations in a formal project record. The formal project record for this project will follow the format and guidelines of the Florida Dept. of Transportation (FDOT) Construction Record Keeping Standard Forms adopted for an airport project. The formal project record consists of the following entries and duties: a. CONSULTANT's Project Diary b. Inspector's Weekly Reports c. Summary of Inspector's Weekly Reports d. Prime/Subcontractor Work Summary e. Preparation of Material Acceptance Reports £ Preparation of Certification and Testing Log Book g. Review Subcontractor approval forms h. Prepare statement of days charged on a weekly basis Conduct project meetings with Owner and Contractors j. Field measure quantities at regular intervals. k. Review and/or preparation of Periodic Payment Requests Record deviations from the contract plans for preparation of Record Drawings m. Preparation and review of Change Orders/Force Account Work The Resident Project Representative is also responsible for monitoring construction activity as it relates to airport operations. Days and hours of on-site activity by the Resident Project Representative will average five(5)days per week over the course of construction but may be utilized as needed during various phases of work. Contract Period: CONSULTANT agrees to provide the services in this phase of the Agreement during the construction contract period, which is estimated to be 365 calendar days during 2021 and 2022, including 30 days prior to on-site construction, 270 days during on-site construction, and 65 days thereafter to complete the project records. The fee contained in the Exhibit "B" is based on the stated anticipated hours of effort. If these hours are exceeded, through no fault of the CONSULTANT, the CONSULTANT shall be entitled to additional compensation. C. PROJECT CLOSEOUT: 1. Record Plans: Prepare and furnish two (2) copies of the Record Plans for the completed project to the SPONSOR. The record plans must be supplied as a requirement of the contract. These plans will show the completed construction per the inspector's and contractor's records. They are, however, not to be construed as being 100 percent accurate. 2. Construction Testing Report: A Quality Control Testing report is not required for this project, nor included in this scope of work. 3. Airport GIS As-built Survey: An as-built survey in accordance with FAA AC 150/5300-I8B is not required for this project, nor included in this scope of work. D. ASSUMPTIONS 1. RPR hours are anticipated at 45-hours per week. If additional effort is subsequently required by SPONSOR, an amended or separate agreement will be made to cover this additional scope of work. 2. Provisions for Hazardous Materials Abatement such as sampling, laboratory testing of samples, abatement design, environmental monitoring or reviewing CONTRACTOR submittals pertaining to Hazardous Materials Abatement are not included in this scope or agreement. If such effort is subsequently required by SPONSOR, an amended or separate agreement will be made to cover this additional scope of work. E. SCHEDULE The CONSULTANT agrees to complete the work under this phase of the Agreement in a manner satisfactory to the SPONSOR within twelve (12) months after award of a construction contract and receipt of an executed copy of this contract from the SPONSOR accompanied by a resolution Key West International Airport Access Road '� McFarland Johnson Full-Time Construction Administration and Resident Inspection—Scope of Services 8 McFarland Johnson from its governing body authorizing said execution or within such extended periods as agreed to by the SPONSOR.
