AND MONROE COUNTY,FLORIDA for POST-IRMA MARINE DEBRIS REMOVAL SERVICES THIS AMENDMENT TO CONTRACT is made and entered into this 25th day of May 2021, between Monroe County Board of County Commissioners (hereinafter "MONROE COUNTY" or the "COUNTY") and Adventure Environmental, Inc. (hereinafter"CONTRACTOR"). WHEREAS, the parties entered into a contract ("Contract") on March 17, 2021, for post- Hurricane Irma marine debris removal services (herein"service"or"services"); and WHEREAS,the compensation amount in the Contract totals$1,135,127; and WHEREAS, funding for this project is provided by the Florida Fish and Wildlife Conservation Commission (FWC) which totals$1,300,000; and WHEREAS,the remaining funding amount of$164,873 was set aside to cover disposal costs billed directly to Monroe County; and WHEREAS, only$4,000 in disposal costs are estimated by this project; and WHEREAS, providing the balance of the disposal funding ($160,873) to the CONTRACTOR will provide for additional removal services; and WHEREAS, it is deemed in the best interest of the County to fully utilize this funding by increasing the total compensation to the CONTRACTOR to provide additional debris removal services. NOW, THEREFORE, in consideration of the mutual covenants and obligations contained herein, and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the undersigned parties agree as follows: 1. The recitals contained herein are true and correct and are hereby incorporated as if fully set forth herein. 2. The Agreement between the parties is made a legally effective part of this First Amendment, except as expressly amended under this Amendment No. 1. 3. Section 3.1 is hereby amended as follows: FROM: The County, in consideration of the CONTRACTOR satisfactorily performing and carrying out the objectives of the County as to providing post-Irma marine debris removal services, shall pay to the CONTRACTOR up to the sum of One Million One Hundred Thirty- Five Thousand One Hundred Twenty-Seven DOLLARS and Zero Cents ($1,135,127.00) for the term of this contract, based on a Daily Rate calculated at$8,100/day/crew multiplied by the maximum Number of Crews for each day of work for a Total Daily Rate, as outlined on the Fee Schedule below. 1 of2 TO: The County, in consideration of the CONTRACTOR satisfactorily performing and carrying out the objectives of the County as to providing post-Irma marine debris removal services,shall pay to the CONTRACTOR up to the sum of One Million Two Hundred Ninety- Six Thousand DOLLARS and Zero Cents($1,296,000.00)for the term of this contract, based on a Daily Rate calculated at$8,100/day/crew multiplied by the maximum Number of Crews for each day of work for a Total Daily Rate,as outlined on the Fee Schedule below. 4.
