NOTICE OF INTENTION TO CONSIDER
ADOPTION OF COUNTY ORDINANCE
NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday, May
15, 2002 at 3:00 PM at the Key Largo Library, Tradewinds Shopping Center, Key
Largo, Monroe County, Florida, the Board of County Commissioners of Monroe
County, Florida, intends to consider the adoption of the following County ordinance:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, AMENDING CHAPTER 13.5, MONROE COUNTY CODE,
DELmNG PROVISIONS REGARDING THE 33RD STREET BOAT RAMP, MARATHON,
THE AVIATION BLVD. BOAT RAMP, MARATHON AND THE MILE MARKER 82.5 BOAT
RAMP, ISLAMORADA, AS WELL AS COCO PLUM PARK, JESSIE HOBBS PARK, AND
SOMBRERO BEACH PARK, ALSO AMENDING PROVISIONS REGARDING SUNSET
POINT PARK, ALLOWING DOGS THEREON AND RESTRICTING PARKING;
PROVIDING FOR SEVERABIUTY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO
THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE
DATE
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person
decides to appeal any decision made by the Board with respect to any matter
considered at the hearing, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the proceedings is
made, which record includes the testimony and evidence upon which the appeal is
to be based.
Copies of the above-referenced ordinance are available for review at the various
public libraries in Monroe County, Florida.

MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. Sec. 13.5-4(b), paragraphs 6, 7, and 8, MCC, are hereby deleted.
Section 2. Sec. 13.5-5(a), paragraphs 7 and 8, MCC, are hereby deleted.
Section 3. Sec. 13.5-5(d)(2) is hereby amended to read as follows:
(2) Park hours. The parks and beaches listed above are open to the
public, Monday through Sunday, from 7:30 AM until sunset with the following
exceptions:
Bay Point Park, and Bernstein Park are open everyday from 7:30 a.m. until
10:30 p.m.;
Friendship Park is open everyd~y from 7:30 a.m. until 8:30 p.m.;
Jessie Hobbs Park is el3E:n cycryday ffeFR 7:30 a.FR. until 9:00 I3.FR.;
Key Largo Community PaFk is open everyday from 7:00 a.m. to 8:30 p.m.
All persons and their vehicles that enter the parks during the open hours must
leave the parks by closing time, unless prior approval has been granted by the
Monroe County Parks & Recreation Coordinator by way of a use form for a specific
event. Any vehicles in the parks when the parks are closed will be towed away at
the vehicle owner's expense.
Section 4. Sec. 13.5-5(n) is hereby amended to read as follows:
(n) Pets are allowed at Key Largo Park, Old Settlers Park, Wilhelmina Harvey Park,
Sunset Point Park and in those parts of Harry Harris Park and Higgs Beach County Park
specified in (0), subject to the following regulations:
(i) Pets must be leashed on a leash no greater than 8 feet long, unless and
while in the water and wet sand area of Sombrero Beach Park.
(ii) Owners must clean up after pets and properly dispose of waste. The
County shall proVide Mutt Mitts and Doo-Drop In stations for this purpose.
(iii) Pets exhibiting aggressive behavior or creating a nuisance must be
immediately removed from the park.
Section 5. Sec. 13.5-5(p) is hereby created to read as follows:
(p) No person may stand or stop a motor vehicle or boat trailer within Sunset Point
Park or on the adjacent rights-of-way.
Section 6. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 7. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section 8. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 9. This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Florida that this ordinance has been filed
with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the day of , 2002.
