AGENDA ITEM WORDING: Approval to renew the License Agreement with the United States
Department of the Navy for use of Navy shoreline on Boca Chica Beach,
ITEM BACKGROUND: On December 31, 2001 the License Agreement with the Department of the
Navy to provide the public with a needed recreational area expired. The Department of the Navy is
willing to renew the License provided the County will work with the Naval Air Facility in closing off the
road to public access if the Naval Air Facility is placed in a high threat condition.
PREVIOUS RELEVANT BOCC ACTION: On March 28, 1990, the BOCC approved and
authorized execution of the License Agreement with the United States Department of the Navy for use
of Navy Shoreline on Boca Chica Beach. On January 18, 1996, the BOCC approved to renew the
License Agreement from January 1, 1996 through December 31, 2001, and on April 18, 2001, the
Board authorized to negotiate a licensing property agreement for U.S. Government Property, Dept. of
Navy, for the Southern Shoreline of Boca Chica Key for public recreational space,
CONTRACT/AGREEMENT CHANGES: To renew License Agreement for a term beginning
January 1, 2002 through December 31, 2007, providing the County will work with the Naval Air
Facility in closing off the road to public access if the Naval Air Facility is placed in a high threat
condition.
