Approval of Settlement in the Cuda Lane Quick Take Action of BOCC v. Key Largo Ocean
Resorts Co-op, Inc. in the amount of $44,625.25.
nEM BACKGROUND:
Pursuant to BOCC direction, an eminent domain action was undertaken to acquire a strip of
land 10' in width, with a short T-type extension towards the end of the land to be acquired. A
complaint to take land adjacent to Cuda Lane was filed in the Circuit Court of Monroe County.
An order of quick take was entered after an April 29, 2002, hearing before the Court. The
property owner's attorney, Joaquin Fernandez, Esq. has requested a total amount of settlement
of $46,625.25. The components of that amount include $28,000, although the appraisal
submitted to the County by Trent Marr was $24,000. The property owners' rationale for the
additional $4,000 is noted in the letter supplied as back-up. Mr. Fernandez has stated that the
Co-op president will advocate that the owners accept an amount of $26,000 for the land
portion rather than drag this out by obtaining other appraisals.
Also included in the amount are consultant and attorney fees. State Statute requires the
petitioner to pay attorney fees and reasonable costs, including those for expert witnesses which
the consultant would constitute. Additionally costs of clearing, permitting and placing the
fence which triggered this action, are included since the County permitted the fence, resulting
in the cost, less than 4 months prior to the determination that the County should condemn the
property in question.

Dear Ms. "Hutton:
Enclosed you will find a number of invoices which I am submi to you in order to
agree to a final judgemnt in regards to the quick take of my client" s prope . that regard, I
have met with the Board and have shown them the revised survey of the property taken, which
included a so call "turn arourid" area at the rear of the property. This area includes an area which
cuts into the property forty feet from the existing prop~rty line.
In light of this additional area. the Board had always considered the 10 feet by the length
of the property as the area to be taken, they feel that a sum closer to $28,000.00 would be a more
reasonable amount for the property. I have not contracted officially anyone to appraise the
property and will not do so until we discuss this matter further.
I have made a compilation of all the invoices and costs and have arrived at the following:
