ITEM BACKGROUND:
In its joint resolutions with the Florida Keys Aqueduct Authority (#227-2002) approved on May 15, 2002,
the BOCC committed to the securing of a site for a wastewater treatment plant to serve the Bay Point area.
The BOCC further agreed that it would exercise its powers of eminent domain, if it could not otherwise
expeditiously negotiate the purchase of this site.
The FKAA completed a evaluation of candidate sites in 2001, which was just recently provided to the
County staff. [A copy of this report is included in this package.] The County staff has conducted its
review and has prepared a staff report with recommendations.
The County needs to expeditiously move forward on securing a site to ensure that the Bay Point project is
not further delayed. Work by FKAA on completing its background preliminary engineering and related
work can not be completed top prepare the design/build package without the site being secured.

The BOCC adopted Resolution #227-2202 committing to acquire a site for the wastewater treatment plant.

A RESOLUTION OF THE MONROE COUNTY BOARD OF
COMMISSIONERS AFFIRMING THE RECOMMENDATIONS
OF THE FLORIDA KEYS AQUEDUCT AUTHORITY (FKAA)
FOR PRIMARY AND SECONDARY WASTEWATER
IMPROVEMENT PROJECT TREATMENT PLANT SITES AT
BAYPOINT, LOWER FLORIDA KEYS AND REQUESTING
THAT THE FKAA BEGIN WORK IMMEDIATELY TO
FULFILL OUR OBLIGATIONS TO FEMA FOR RECEIPT OF
FEMA UNMET NEEDS GRANT DOLLARS AT BAYPOINT.
WHEREAS, FEMA Unmet Needs dollars were awarded and are
available to complete wastewater improvements at Baypoint; and
WHEREAS, the FKAA has recommended a primary and a secondary
treatment plant site at Baypoint (see attached site review documents); and
WHEREAS, County staff has conferred with FKAA staff on the selection
of treatment plant sites and concurs generally with the FKAA findings; and
WHEREAS, the priority of the FKAA primary site at the Baypoint area
stands well above the secondary proj ect area for two reasons:
· Number of separate owners who own individual parcels making up the
overall proposed site, and
· Level of prior property improvement, and therefore the amount of site
improvement that will be required for preparation of the site prior to
treatment plant construction; and now therefore
BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, MONROE COUNTY, FLORIDA THAT:
Section 1. The BOCC endorses both the FKAA's primary and secondary
recommendations for FEMA Unmet Needs Wastewater Improvement Project
Wastewater Treatment Plant sites for Baypoint. These sites are in order of
priority and preference:

Section 2. The BOCC requests that the Monroe County Land Authority (MCLA)
enter into negotiations to purchase the prioritized sites, in order of preference.
In the event that there are no wHling sellers or that some of the property owners
holding portions of the preferred sites are unwilling sellers, the CoUnty
Attorney is directed to take necessary steps to condemn the properties involved.
S~tion 3. The BOCe requests that the FK.AA continue efforts to complete
mutual obligations with FEMA for receipt of FEMA Unmet Needs money.

Ref: Environmental Assessment of Potential WWT Sites, Baypoint
An environmental assessment was made on July 1, 2002 of the three potential sites
proposed by the FKAA at Baypoint with the following findings:
Site #1: B 1, L 1-7, Bay Point Amended Plat
As noted in the FKAA report, Lots 1-3 are developed with a commercial building. The
remaining lots are heavily infested with Brazilian Pepper and Australian Pine, interspersed
with buttonwoods. The site is considered scarified/developed and disturbed with invasive
exotics, with a buildable area of 80%. The shoreline is adjacent to a dredged canal, requiring
a 20-foot setback for development.
Site #2: B3, L 1-4, Bay Point Amended Plat
This site is scarified with landscape exotics (primarily coconut trees), with a buildable
area of 80%. The shoreline is adjacent to a dredged canal, requiring a 20-foot setback for
development.
Site #3: Portion of Tract 0, plat of Saddlebunch Recreational Vehicle Park
The site is scarified with a native vegetation fringe comprised primarily of
buttonwoods and mangroves. Development area is 80%, with a 50-foot setback from the
unaltered shoreline along the eastern boundary.

Selection of Primary and Secondary Treatment Plaht Site
for Baypoint Wastewater

INTRODUCTION:
At its July 20, 2002 meeting, the Board of County Commissioners agreed to
move forward on several wastewater projects, including FEMA Unmet Needs
projects. In order to complete these projects, staff will be working with the Florida
Keys Aqueduct Authority as the lead on each Unmet Needs project. TheFEMA
Unmet Needs projects are located in Key Largo, Conch Key, and Baypoint.
Among a number of joint decisions that the BOCC and the FKAA will be
making is that of determining the preferred site for a wastewater treatment plant to
serve each area. This was done and is well on the way to being accomplished for
the Key Largo Unmet Needs project.
This report serves as the County staff assessment of potential treatment plant
sites in the Baypoint area based on a report prepared by the FKAA staff (see
attachment 1). The area is small and the number of sites is limited. This report
provides a recommendation for a primary and secondary site in concurrence with
the FKAA report.
BACKGROUND:
FEMA Unmet Needs dollars were awarded to Monroe County in the
summer of 1999 to offset future hurricane related impacts. These dollars were

awarded after the devastating impacts of Hurricanes Georges and Mitch. Nearly
$27 million dollars were awarded to the County and municipalities to make
necessary improvements in the County to avoid future hurricane damage.
Approximately $10.6 million of these dollars were provided for wastewater
improvements. Wastewater project areas included Key Largo, Conch Key, and
Baypoint. Of the $10.6 million allocated approximately $2.2 million dollars are to
be utilized in the Baypoint project.
The FKAA staff selected four sites in the Baypoint area as potential
wastewater treatment plant sites. The total area encompasses 429 parcels including
Baypoint, Bluewater RV Park, and Saddlebunch Shores. Within this area it is
estimated that there are 400 EDUs and there are 94 unknown systems. The area is
almost completely developed.
Since their initial review, Bluewater RV Park, which has its own treatment
plant, has determined that it would prefer not to participate in the project at this
time. Therefore, the area currently being assessed lies entirely on Baypoint. There
are 292 parcels within the Baypoint area and 89 unknown systems.
ASSESSMENT:
The FKAA identified four sites initially for its review. Minimum site
requirements were for a parcel or group of parcels of approximately three-quarters
of an acre.
One site (Site No.4 in its report) was located in an IS land use district on
Baypoint. This site was eliminated as the land development regulations did not
allow wastewater treatment plants in the IS district. A second site (Site No. 3 in
the FKAA report), located in Bluewater RV Park, was also eliminated as part of an
internal process to limit the scope of the project to Baypoint alone. TheFEMA
grant is specific to Baypoint. In addition, part of the purpose of utilizing the
Bluewater site was in consideration of a more regional approach, which would
include Big Coppitt.
The other two sites were located on Baypoint. Site maps are attached for
review as Figures 1 & 2.
Following the FKAA report format, Site No.1 consists of 7 parcels owned
by three individual owners. The site is approximately 0.85 acres in size. It has a
building on it, which would need to be removed to complete the project. It is

largely scarified, but does have exotic plant species on a portion of the property,
which could be removed as part of the project. The total 2001 assessed value of
the site is $378,406, based on the most recent Property Appraiser records.
Site No.2 consists of four properties owned by two individual owners. The
combined properties are approximately 0.91 acres in size. It is scarified and vacant
at this time. This is the former site of Knuckle Head's Restaurant, which was
recently removed from the property. The Knuckle Head's parcel was recently
denied a conditional use to rebuid the restaurant by the Planning Commission. The
total 2001 assessed value of this site is $195,962.
The FKAA utilized 14 criterion to assist in their assessment of the potential
wastewater sites on Baypoint. Of these, five criteria stood out todiscriminate the
character of each site from the others:
1. whether the site was vacant and scarified;
2. what the relative assessed value of the site was;
3. the number of parcel owners, holding parcels within the site;
4. whether the site was centrally located; and
5. what the site preparation costs were projected to be.
In this case Site No 2. stands out in each of the five categories over Site No.
1. The two most important issues are the number of comparative number of
owners (2 VS 3) and the fact that Site No. 1 has a building on it, which would
increase the site preparation costs for the project. Site No.2 is also assessed at a
lower value.
The FKAA siting evaluation report recommends that Site No.3 be selected
as the preferred site and Site No. 2 as the secondary site for the Baypoint
wastewater treatment plant. However, as Site No.3 is no longer an appropriate
option, With the elimination of Site No. 3 from consideration, and afterfurhter
discussion with FKAA staff, the best option is Site No.2 and the secondary site as
Site No.1. Based on a review of the FKAA Siting Evaluation report and an
environmental review of its own (see Attachment 2), County staff concur with the
FKAA recommendations.

RECOMMENDATION:
Based on the preceding assessment of the two potential wastewater
treatment sites on Baypoint, County staff recommends that immediate efforts to
purchase Site Nos. 1 and 2 begin in order of preference.
The primary or preferred site is Site No.2 and the secondary site is Site No.
1. In the event that there are no willing sellers or that some of the owners are
unwilling sellers, staff should be directed to begin necessary efforts to condemn the
needed properties.

PURPOSE AND SCOPE
This report evaluates potential sites for a Wastewater Treatment Plant (WWTP) to serve the Bay
Point Key Wastewater Service District. The proposed plant is anticipated to be an advanced
wastewater treatment (A WT) facility with an annual average day flow capacity of approximately
100,000 gallons per day. A vacuum and pump station (VPS) required for the operation of a
proposed vacuum wastewater collection system will also be located on the WWTP site. It is
estimated that the site selected will need to be % acre in land area (inclusive of buffer zones and
building structure setback requirements) to serve the approximately 400 equivalent dwelling
units (EDU) of existing development within the Wastewater Service District.
BACKGROUND INFORMATION
An initial screening of available sites was performed in association with the preparation of an
Application for Federal Grant Assistance that was submitted to the Florida Department of
Community Affairs (DCA). The initial screening effort identified four (4) candidate sites for the
treatment facility and pump station. The following is a generalized description of each of the
four sites. Map(s) showing their location are attached.
Site #1: This prospective site is located on the ocean side. It consists of Lots 1 through 7,
Block 1 of Bay Point Amended Plat (P.B. 3, Pg. 75) and contains a total of approximately 0.89
acres. Lots 1 through 3 form one parcel by unity of title, resulting in a total of five parcels
comprising the site.
Zoning: Lots 1 through 7 are zoned Suburban Commercial (SC).
Ownership: Lots 1 through 3 are owned by Irving and Lynn Teplitsky.
Lot 4 is owned by David L. and Patsy Trujillo.
Lots 5 through 7 are owned by Dede J. Munger.
Improvements: Lots 1 through 3 are improved with an existing commercial warehouse-type
building (formerly the Bay Point Marina). Lots 4 through 7 are unimproved. None of the
unimproved lots are scarified.
Assessed Value: The assessed value of the properties as on file with the Monroe County Property
Appraiser's Office are:

Adjacent Land Uses: The lots are bordered on the east by Lower Sugarloaf Sound, on the south
by an existing single family residence, on the north by the Overseas Highway and on the west by
East Circle Drive. To the west directly across East Circle Drive from the site is an existing
County owned park (Bay Point Park) and a trailer that formerly housed the commercial business
known as Baby's Coffee.
Adjacent Land Zoning: Property to the north of the site on the opposite side of the Overseas
Highway is zoned Military Facilities (MF). Property to the west of the site across East Circle
Drive is in Bay Point Amended Plat (P.B. 3, Pg. 75) and is zoned Suburban Commercial (SC).
Lots south of the site are also in Bay Point Amended Plat (P.B. 3, Pg. 75) and are zoned
Improved Subdivision (IS).
Site #2: This prospective site is located on the ocean side. It consists of Lots 1 through 4,
Block 3 of Bay Point Amended Plat (P.B. 3, Pg. 75) and contains approximately 0.85 acres. Lots

Site #3: This site is located on the ocean side. It consists of a portion of Tract D in the plat
of Saddlebunch Recreational Vehicle Park (F.B. 7, Pg. 51). Tract D contains a total of
approximately 1.25 acres.
Zoning: The property is zoned Mixed Residential (MR).
Ownership: The parcel is owned by Bluewater Key RV Ownership Park.
Improvements: The property is partially cleared and is used primarily for the storage of
unoccupied recreational vehicles. There is also a package wastewater treatment plant located on
the parcel that currently serves the RV Park consisting of up to 80 RV units and a clubhouse.
Assessed Value: The assessed value of the property as on file with the Monroe County Property
Appraiser's Office is:

If a % acre portion of the property were purchased at it's the full assessed value of the entire
parcel, the estimated acquisition cost would be $112,605 and the estimated cost to the project
would be $281.51 per EDU.
Adjacent Land Uses: The site is bordered on the east by Saddlebunch No.2 Channel, on the
north by the Overseas Highway, and on the south and east by other undeveloped tracts and lots
for recreational vehicle use.
Adjacent Land Zoning: Property to the north of the site on the opposite side of the Overseas
Highway is zoned Native Area (NA). Property to the west of the site in the Saddle Bunch Shores
Subdivision is zoned Improved Subdivision (IS). Property directly south of the site is part of the

Improvements: Lots 6 and 8 are undeveloped and scarified. Lots 5 and 7 were originally
undeveloped and scarified, but each property now has a single family residence under
construction.
Due to the construction of single family residences on two of the four lots, the site is no longer of
sufficient size and has been eliminated from further consideration. In addition, current Monroe
County Land Development Regulations prohibit the installation of wastewater facilities within
areas zoned Improved Subdivision (IS).
APPROACH AND METHODOLOGY
The potential WWTP sites were ranked according to fifteen site evaluation criteria. Each
ranking criterion was assigned a score between 1 and 5, with 5 representing a very favorable
score, 4 favorable, 3 neutral or average, 2 unfavorable, and 1 very unfavorable. The scoring
system was applied to the fifteen criteria for each site to develop a composite total raw score.
The ranking matrix and total ranked scores for each site are presented in the following table.

Based on the evaluation conducted herein, the sites evaluated are ranked as follows:

Site #4 was eliminated from consideration due to the recently initiated construction of new single
family residences on two of the four lots that comprise the site.
Site #2 provides adequate available land area for the construction, operation, and long-term
maintenance of a WWTP and vacuum pump station. The property is centrally located within the
service area, resulting in reduced construction costs and more efficient operation of the vacuum
collection system. The current zoning and adjacent land uses are most conducive to
development of a WWTP. All surrounding land uses can be adequately buffered with the
installation of landscaping. The restaurant building that previously existed on the site has been
demolished and the property is almost completely scarified. The previous development that
existed on the site is also expected to result in reduced construction costs and minimal
environmental impacts. This site has the highest acquisition cost due to the development rights
that are attached to the property. However, these development rights, if included in the purchase
price of the property, could subsequently be sold and the resulting proceeds used to offset the
cost of property acquisition and/or project construction. As such, this property is ranked as the
primary site for acquisition.
Site #3 also contains adequate available land area. Only % acre out of the total 1.25 acres of the
site would be required for the project. The property is not as centrally located, however, it is
setback slightly from the Overseas Highway and is somewhat better screened and buffered.
Also, an existing WWTP serving the Bluewater Key RV Park is presently situated on a portion
of the property. The current zoning and adjacent land uses are suitable for development of a
WWTP. Site access may require ingress/egress and utility easements due to private ownership
of the roadways within the Saddlebunch Recreational Vehicle Park and limited accessibility to

CONCLUSIONS AND RECOMMENDATIONS
A primary and a secondary site are recommended as the location for a WWTP for the project. It
is recommended that Site #2 be pursued for acquisition as the primary choice for the location of
the Bay Point WWTP and vacuum pump station. In the event Site #2 cannot be secured, then the
second ranked site should be considered for acquisition.
With the approval of the FK.AA Board of Directors the following detailed surveys,
investigations, and supplemental information on the primary and/or secondary ranked sites
should be obtained prior to initiating or pursuing acquisition of either property:
