Item U3 NOTICE OF INTENTION TO CONSIDER ADOPTION OF COUNTY ORDINANCE NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday, August 21, 2002 at 3:00 PM at the Key Largo Library, Tradewinds Shopping Center, Key Largo, Monroe County, Florida, the Board of County Commissioners of Monroe County, Florida, intends to consider the adoption of the following County ordinance: AN ORDINANCE AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, PROVIDING FOR THE ESTABUSHMENT OF THE SCHOOL CROSSING GUARD TRUST FUND; PROVIDING FOR THE IMPOSmON OF A SURCHARGE ON PARKING FINES TO FUND A SCHOOL CROSSING GUARD PROGRAM; PROVIDING AUTHORIZATION FOR THE USE OF TRUST FUNDS FOR STARTUP COSTS AND RECURRING ADMINISTRATIVE COSTS RELATED TO THE PROGRAM; PROVIDING FOR QUARTERLY DISTRIBUTION OF FUNDS COLLECTED FROM THE SURCHARGE IN PROPORTION TO THE NUMBER OF CROSSING GUARDS IN EACH MUNICIPALITY AND UNINCORPORATED MONROE COUNTY; PROVIDING THAT SURCHARGE REVENUES ARE NOT THE EXCLUSIVE METHOD OF FUNDING SCHOOL CROSSING GUARDS; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person decides to appeal any decision made by the Board with respect to any matter considered at the hearing, he will need a record of the proceedings, and that, for such purpose, he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: , Section 1. The SchoQI Crossing Guard Trust Fund is hereby established pursuant to the authority of S318.21(12), Aa. Stat. 2002. Section 2. A surCharge of $_ is hereby imposed on each parking fine collected in the county. Section 3. All surcharge revenue will be deposited in the Schoo' Crossing Guard Trust Fund. Section 4. School Crossing Guard Trust Funds will be distributed quarterly to the Monroe County Sheriff's Office for sole purpose of funding school crossing guardS, inclUding without limitation the costs of printing tickets and administrative costs of implementing the program. Section 5. Parking tine surcharges shall net be the exclusive means of funding school crossing guards. Section 6. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 7. The provIsions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
