Item S2 BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: August 21, 2002 Division: County Attorney AGENDA ITEM WORDING: Request approval of Amendment to Special Service Arrangement Agreement with BellSouth for maintenance and service of the 911 system. ITEM BACKGROUND: Agreements were entered into for the acquisition and financing of 911 equipment and a separate agreement was entered Into for the installation and maintenance of said equipment and associated software. The acquisition and payment agreement was previously amended on August 16, 2000 providing for the maximum amount of monthly payments for equipment and services to not exceed $23,593 for the months of June, 1999 through December, 1999 and $24,357 for the remainder of the 84 month term. That amount applies to the services arrangement agreement as well as the acquisition of equipment agreement but the Special Service Arrangement Agreement was not amended at the same time. WHEREAS, the parties hereto did enter Into a Special Service Arrangement Agreement, desIgnated SS98-1910-03, on April 14, 1999; and WHEREAS, said contract provided for the Installation and maintenance of Positron E911 Equipment and associated software and equipment; and WHEREAS, County entered into a payment agreement for said equipment on June 9, 1999 wIth BSFS, the financing arm for BellSouth; and WHEREAS, the June 9, 1999 agreement was prevIously amendment on August 16, 2000, without ~ference to the Special Service Arrangement Agreement; and WHEREAS, It Is necessary to correlate the Special Service Arrangement Agreement to the Payment Agreement as amended; now, therefore The parties hereto agree to the following amendment to the Special Service Arrangement Agreement: 1. The amendment to Emergency 911 equipment and service contract, dated August 16, 2000, between the parties hereto is hereby incorporated by reference in the Special Service Arrangement Agreement, designated SF98-1910-03. 2. All other provisions of said Special Service Arrangement Agreement not Inconsistent herewith shall remain In full force and effect.
