Item S3 BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: August 21, 2002 Division: County Attorney AGENDA ITEM WORDING: Rescission of approval of Spiegel Grove Artificial Reef Project agreement for use of Sheriff's Bomb Technician ITEM BACKGROUND: When the Spiegel Grove was being prepared for placement on the ocean floor, the BOCC approved (at the May 15, 2002 meeting) an agreement for the Sheriff's Bomb Technician to place explosives on the ship as part of the process of placing the ship on the ocean floor_ Before the Sheriff's Bomb Technician could arrive at the site, the ship sank prematurely and the Bomb Technician did not provide any services. Motion was made by Commissioner Nelson and seconded by Commissioner Neugent authorizing payment in the amount of $86,766 34 Motion carried unanimously TOURIST DEVELOPMENT COUNCIL Motion was made by Commissioner Neugent and seconded by Commissioner Nelson to table to the next Marathon meeting approval of one "at large" appointment to the Tourist Development Council District III Advisory Committee Motion carried unanimously Mr. Roberts announced the vacant position on the Tourist Development Council District I Advisory Committee for an "at large" appointment Executed: 37 Resolutions/4 Ordinances/59 Contracts/I3 Bills of Sale ~ / I 3:J'-'d SPIEGEL GROVE ARTIFICIAL REEF PROJECT AGREI!MENT FOR USE OF SHERIFF'S BOMB TECHNICIAN 1- Purpose: The Monroe County Board of County Commissioners in conjunction with the Upper Keys Chamber of Commerce has acquired title to former USS Spiegel Grove, a decommiSSioned naval vessel. The BOCC has contracted with the UKCC to place the ship as an artificial reef in the waters east of Key largo. The BOCC and UKCC desire the assistance of Sgt. Bobby Randolph, MCSO Bomb Technician in this endeavor, and MCSO is willing to provide assistance. This agreement sets forth the understanding of the parties. 2- Role of MCSO: A. MCSO agrees to permit Sgt. Bobby Randolph to assist In placing and detonating explosives in the hull of the Spiegel Grove in connection with placement of the ship as an artificial reef, with the understanding that the BOCC is not obliged to obtain additional insurance coverage for this activity. B. MeSO is not responsible for: 1. Obtaining permits or other approvals. 2. Preparation, execution, or supervision of the sink plan, other than placing and detonating explosives and supervision. 3. Coordination of volunteers. 4. Supervision of employees of any employer other than MeSO. S. Determination of the methods used to sink the ship or locations of explosive charges. Inspection and monitoring of the vessel and marine environment during and after sinking. 7.
