Item Background: This item is a contract amendment proposed to resolve closing issues and a resolution authorizing conveyance of the entire property to the State of Florida for management as a CARL property. The Teatable Hammock site consists of 136 acres located on the bays ide of Upper Matecumbe Key at MM 80 behind Papa Joe's Restaurant. The Land Authority is purchasing the property with Preservation 2000 funds. Advisory Committee Action: The Committee approved the contract amendment and resolution on July 25,2002 by a 3/0 vote. Previous Governing Board Action: The Board approved the original contract on March 20,2002. Contract/Agreement Changes: The contract amendment adds a 3.1-acre parcel of land to the conveyance, excludes a OA-acre encroachment area, eliminates a requirement that the Land Authority grant an ingress and egress easement to the Seller, increases the purchase price of the entire site by $40,500 (from $2,100,000 to $2,140,500), and sets a closing date of August 30,2002. Choate, Trustee, as Seller, and the Monroe County Comprehensive Plan Land Authority, as Buyer, executed by the Seller on March 1, 2002. The parties hereby mutually agree as follows: 1. The portion of Parcel 58 (RE #96900-000000) located on the bays ide of the canal, said portion of Parcel 58 being more particularly described in Exhibit A, shall be included in the lands to be conveyed from the Seller to the Buyer. 2. A 25-foot wide strip of land along a portion of the northeast edge of the property, said 25-foot wide strip being more particularly described in Exhibit B, shall be excluded from the lands to be conveyed from the Seller to the Buyer. 3. The provision in Paragraph 16 of the original Agreement whereby the Seller would retain a non-exclusive perpetual easement for vehicular, legal ingress and egress purposes is hereby deleted. 4. The purchase price shall be increased by $40,500.00 as consideration for the above amendments. 5. The closing deadline for this transaction is extended to August 30, 2002. A RESOLUTION OF THE MONROE COUNTY COMPREHENSIVE PLAN LAND AUTHORITY AUTHORIZING THE CONVEYANCE OF THE TEATABLE HAMMOCK CARL SITE TO THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND. WHEREAS, the Monroe County Comprehensive Plan Land Authority (hereinafter "Land Authority") serves as a local partner with the State of Florida to assist the State in acquiring . Conservation and Recreation Lands (CARL) in the Florida Keys; and WHEREAS, the Land Authority has entered into a contract to acquire the Teatable Hammock CARL site in the Florida Keys Ecosystem project on Upper Matecumbe Key for subsequent conveyance to the State of Florida; and WHEREAS, on July 25, 2002 the Land Authority Advisory Committee voted 3/0 to approve conveying the Teatable Hammock site to the State of Florida for inclusion in the CARL program and management by the appropriate State agencies; NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY COMPREHENSIVE PLAN LAND AUTHORITY that the Chairman of the Umd Authority Governing Board is hereby authorized to sign a deed conveying the Teatable Hammock CARL site (RE #96840, part of 96850, part of 96860, 96870, 96880, 96890, part of 96900, and 96910) to the Board of Trustees of the Internal Improvement Trust Fund for inclusion in the CARL program and management by the appropriate State agencies.
